Law of 6 October 2005 adapting special laws to the Law for the dualisation of the Provincial Executive (dualisation of the Provincial Co-propended Powers Act)

In this regard, we have taken the view that it is desirable to bring the division of powers into special laws into line with the Law for the dualisation of the provincial government ;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

  • 1 This Act has no effect on the legal force of decisions taken before the date of entry into force of this Law, in respect of which, after that date, another governing body shall be competent.

  • 2 By way of derogation from the first paragraph, decisions to the delegation of a power of provincial States shall cease to be taken by Member States and shall, at the time of the entry into force of this Law, act as a result of those States.

  • 3 By way of derogation from the first paragraph, decisions shall be taken to set up committees as referred to in the Articles 81 and 82 of the ProvincieAct who, on 12 March 2005, did not meet the requirements of those articles, on that date by law.

  • 4 In respect of decisions taken before the date of entry into force of this Law, the object of which is that other administrative body shall be subject, after that date, to any other administrative body.

  • 5 Arrangements to affect which, after the date of entry into force of this Law, another governing body of the province of participating Member States shall be deemed to have been affected by that other authority from that date. Administrative organ.

This Law shall enter into force on a date to be determined by Royal Decree, which may be adopted in a different way for the various articles or parts of such articles. The Royal Decree shall apply where necessary to: Article 16 of the Temporary Referendum Act .

This law is cited as: Law dualisation provincial co-bewindsprivileges.

Burdens and orders that it will be placed in the Official Gazette, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
