All who read this will see or hear, greetings! do: So We have considered, that it is desirable to adopt rules in itself not serious conduct in breach of traffic regulations, made by the road traffic Act and some other laws, rather than on administrative criminal manner to be able to do;
So it is, that we heard, the Council of State, and with agreement of the States-General of the Netherlands, as we find good goedgevonden and have understood and understand to this: chapter I definitions Article 1 1 In this Act, the following definitions shall apply: Our Minister: Our Minister of security and justice;
trailer, motor vehicle, license plate and driver's license: which include in article 1, paragraph 1, of the road traffic Act 1994;
driver: all road users except pedestrians;
license plate registry: the registry referred to in article 42 of the road traffic Act 1994;
conduct: conduct referred to in article 2, paragraph 1;
administrative penalty: to pay to the State the amount of money referred to in article 2;
address: indication of street name, house number, city name and postal code of the residence of the person concerned.
2 this Act shall also have the following meanings: driver: the one who is considered a motor vehicle under its supervision to do immediately;
license plate: the badge including a motor vehicle abroad is registered, the registration number, indicated on the registration certificate, issued for a motor vehicle used for the benefit of the armed forces, as well as any other registration number including a motor vehicle may be registered in Netherlands;
license plate registry: a foreign register motor vehicles registered there, the registration relating to motor vehicles used for the benefit of the armed forces, kept by Our Secretary of Defense, as well as any other registration relating to motor vehicles, which the holder is entitled to enter this in Netherlands;
driver's license: a by the competent authority licence issued abroad, as well as a driving licence issued by the military authority.
Chapter II. 6 An order in Council, as referred to in paragraph 5, shall be adopted on the recommendation of our Minister and the Minister of infrastructure and the environment.

Article 2a the titles 4.4, 5.1 and 5.4 of the General Administrative Law Act do not apply to the imposition and recovery of an administrative penalty and the administration costs under this Act.
Chapter III. Article 3 1 administrative penalty for ensuring compliance with the requirements referred to article 2, paragraph 1, have been charged the officials appointed by order in Council.
2 The officials referred to in the first paragraph shall have the authority to impose an administrative penalty in respect of the conduct adopted by them or by automated means to persons who have reached the age of twelve years.

Article 4 1 The administrative penalty is imposed by a dated decision. The decision contains a short description, having regard to the indication in the annex, of the conduct in respect of which it was given and the amount of the administrative penalty for that conduct certain, date and time when, and the place where the conduct has been detected. A ministerial order are the model of the decision and that of the announcement of the decision, or the requirements that the model must meet.
2 The publication of the decision must be made within four months after the conduct has taken place, by sending the decision to the person concerned has specified address or, if that is not possible and the conduct has taken place with or by means of a motor vehicle for which a license is specified, to the address that is included in the license register. Article 5 if it is established that the conduct has taken place with or by means of a motor vehicle for which a license is specified, and not immediately established who the driver is, and without prejudice to article 31, paragraph 2, the administrative penalty imposed on the person in whose name the license plate registry at the time of the conduct in the badge was registered. He is drawn to the provisions of article 8 thereof.

Article 5a If it has been established that the conduct has taken place with or by means of a motor vehicle authorised to tow trailers, for which a license is required, or to which a trailer is moved, for which a license is required, is associated with, and not immediately established who the driver is, and without prejudice to article 31, paragraph 2, the administrative penalty imposed on the person in whose name the license plate of the motor vehicle at the time of the conduct in the license plate registry was registered. If the registration of the motor vehicle is not fixed, and without prejudice to article 31, paragraph 2, the administrative penalty imposed on the person in whose name the license plate of the trailer at the time of the conduct in the license plate registry was registered. In both cases, he referred to the provisions of article 8.

If the license plate of the trailer has not been set, or if the trailer does not kentekenplichtig, the administrative penalty imposed on the person who was at the time of the practice owner or holder of the trailer.
3 if there is a case referred to in paragraph 1 or 2 then is referred to the provisions of article 8.

Chapter IV. Administrative appeal and objection in Article 6 1 the Prosecutor against the imposition of the administrative penalty for the person to whom the decision is addressed, appeal to the Prosecutor in the district in which the practice is carried out. Article 7 1 articles 6:14, second paragraph, 7:16, second paragraph, 7:24, second and fifth member, and 7:26, fourth paragraph, of the General Administrative Law Act do not apply.

In the cases referred to in points (a), (b) and (c) the Prosecutor is competent to impose an administrative penalty to the one who has done the conduct or to the person who is the lessee of the motor vehicle or the trailer was, or to the person to whom the motor vehicle or the trailer was handed over. Articles 4, 6 and 7 shall apply mutatis mutandis, it being understood that the decision no later than eight months after the conduct has taken place shall be published.
Chapter V appeal to the District Court against the decision of the Court Article 9 1 the Prosecutor may the one who has set up an administrative appeal, appeal to the Court; the appeal is dealt with and decided by the district judge. 2 The appeal in this respect that: a. the conduct has not been performed or that, outside the case of article 5, the person to whom the decision is addressed, not the prescribed conduct;
b. the Prosecutor would have had to decide that the conditions under which the conduct has taken place, does not justify the imposition of an administrative sanction or that he, having regard to the circumstances in which the person concerned is, should have a lower amount of the administrative penalty;
c. the Prosecutor incorrectly the decision not on the basis of article 8 has destroyed.
3. Article 6, paragraph 2, shall apply mutatis mutandis.

Article 10 brings the notice of appeal and the Prosecutor on the case-related documents to the Court of the district in which the conduct is carried out, or, in the case referred to in article 6, first paragraph, second sentence, in the Court of the district in which the place of residence of the person concerned is located.

Article 11 1 and the notice of appeal on the case-related documents are submitted by the Prosecutor to the Court be notified within six weeks after the applicant has provided security for the payment of the penalty and the administration costs, or after the deadline has passed.

Article 12a of title IV of the fourth book of the code of criminal procedure shall apply mutatis mutandis.

Article 13 1 If the district judge is that the appeal is admissible and that the decision of the Prosecutor not or not fully can be maintained, the Sub-District Court declares the appeal well founded and destroys, in whole or in part, or modify it in the contested decision.
2 the decision of the Sub-District Court is reasoned and is either immediately, or within fourteen days afterwards, on an open court.

Article 13b


1 In case of withdrawal of the appeal because the Prosecutor in whole or in part to the submitter of the notice of appeal is met, the Prosecutor upon request of the petitioner by a separate decision in application of article 13a costs. The request is made at the same time as the withdrawal of the appeal. If this requirement is not met, the application shall be declared inadmissible. The request is submitted to the Prosecutor.

Chapter VI. Article 15 1 by way of derogation from article 6:4 of the General Administrative Law Act is made appeals by filing a notice of appeal with the Court of the Court of first instance against whose decision the appeal is directed.
2 after the time limit for lodging an appeal has expired, the Registrar of the Court shall forward the received notice of appeal with the pieces of the proceedings and a copy of the judgment shall, without delay, at the registry of the Court of appeal in Arnhem-Leeuwarden.

Article 20 the Court may require the parties and, if necessary, instruct witnesses and experts to give information in writing within a specified period or among them-based pieces.

Chapter VII. Expired security Article 21 1 the guarantee waiver shall expire in respect of the administrative penalty imposed after a final decision is taken.
(2) if the decision referred to in the first paragraph implies that the administrative penalty imposed is maintained in whole or in part, the administrative penalty payable on the security.
Chapter VIII. The collection of administrative sanction Article 22 1 with the collection of administrative sanctions is the Prosecutor in charge.

5 If the documents referred to in paragraph 3 have not been properly produced, the Registrar shall inform the submitter of the statement of opposition that these pieces within two weeks of the date on which his statement should have been submitted at the registry. If the latter is not within that period has been declared inadmissible, unless the resistance cannot reasonably be held that the applicant is in default.
6 the Registrar shall deliver the statement of opposition and the relevant documents to the Prosecutor in the District of Leeuwarden, in order to allow him the necessary comments.
