Law of 11 February 2012 establishing rules on the special duty of care for veterans (Veterans Law)

We Beatrix, at the grace of God, Queen of the Netherlands, Princess of Orange-Nassau, etc. etc. etc.

All of them, who will see or hear these, saluut! do know:

Thus, we have taken into consideration that veterans have served the Kingdom of the Netherlands as a military under war, or by participating in a mission to maintain or promote the international legal order;

that recognition by the Dutch society of the merits of veterans and of the possible consequences of the deployment as a military for their health, as well as the appreciation that is due to veterans on the basis of their merits, should be fostered;

that the particular care required by veterans and their relations related to the deployment as military need must be ensured;

That is what we, the Council of State heard, and with the mean consultations of the States-General, have been well-liked and understood to be right, and understand that:


Article 1. Conceptual provisions

For the purposes of this Act and the provisions based thereon, the following definitions shall apply:

  • a. Our Minister: Our Minister of Defence;

  • b. Military: the military official in actual service as referred to in Article 1, first paragraph, point (b) of the Military Staff Regulations 1931 , including mental carers treated as such, including those treated with military professionals;

  • c. Veteran: the military, the former military officer, or the former officer of the service, of the Dutch armed forces, or of the Royal Netherlands Indies Army, and the person who belonged to the skilled merchant staff, the Kingdom of the Having served the Netherlands under conditions of war or having taken part in a mission to maintain or promote the international legal order in so far as this mission has been designated by the Minister of the European Union;

  • ed. commitment: Serving as military under war conditions or participating as military personnel in a mission as referred to in point (c);

  • e. Relationship: the spouse, registered partner or other person and blood and relatives in the veteran ' s first or second degree;

  • f. material concern: the claims made by the veteran on the basis of a statutory provision on remuneration or on benefits and provisions relating to unemployment, sickness, incapacity for work, invalidity or death arising out of the exercise of the military service under the conditions or in the case of a mission as referred to in point (c);

  • g. personal data, processing of personal data, responsible: which is understood to be in the Personal data protection law .


Article 2. Recognition and Measurement for Veterans

  • 1 Our Minister is pursuing a policy aimed at promoting the recognition of the merits of veterans, acknowledging the possible consequences of the commitment to their health and of valuing veterans on the basis of their merits.

  • 2 In the case of, or under general rule, rules shall be laid down in any case relating to:

    • a. The facilitation of public and private initiatives in the field of recognition of and appreciation for veterans, including Dutch Veterans Day;

    • b. the manner in which veterans are able to distinguish themselves as such through, among other things, the veterans pass and the carrier badge veterans;

    • c. facilitating the participation of veterans and their relationships to meetings and reunions.


Article 3. Duty of care for and during deployment

  • 1 Our Minister has a duty of care for military personnel who are deployed. This duty of care means that military personnel and their relationships are well prepared for the deployment and are well supervised during deployment.

  • 2 For the purpose of carrying out the duty of care referred to in paragraph 1, rules shall be laid down in or pursuant to general rules of administration concerning:

    • a. The determination of the temporary agency of military personnel;

    • b. preparing military personnel for the actual deployment;

    • c. providing for social medical guidance of military personnel during deployment;

    • d. mentoring the relations of military personnel during deployment;

    • e. informing military personnel and their relationships about health risks of deployment;

    • f. informing military personnel and their relations about the care that is available to them.


Article 4. Duty of care after deployment

  • 1 Our Minister has a duty of care for veterans who have been deployed. This duty of care means that veterans and their relationships are properly supervised after the deployment.

  • 2 For the purpose of carrying out the duty of care referred to in paragraph 1, rules shall be laid down in or pursuant to general rules of administration concerning:

    • a. providing for social medical counseling of veterans and their relationships after the deployment;

    • b. Supporting the veteran in finding another regard if resignation as a military officer is on the order;

    • c. organizing meetings for veterans and their relationships in the context of aftercare;

    • d. facilitating the participation of veterans and their relationships to meetings as part of aftercare.


Article 5. Special duty of care for veterans

  • 1 Our Minister has a special duty of care for veterans who need care as a result of deployment. This duty of care means that veterans and their relationships are assisted in their rehabilitation and re-integration as well as in obtaining material care, social support or mental health care.

  • 2 For the purpose of carrying out the duty of care referred to in paragraph 1, rules shall be laid down in or pursuant to general rules of administration concerning:

    • a. the establishment of the rehabilitation and reintegration of veterans and their relationships;

    • b. mentoring veterans and their relationships in obtaining material care;

    • c. mentoring veterans and their relationships in gaining societal support or mental health care.


Article 6. Care delimitation

The duty of care, intended in the Articles 3 , 4 and 5 , leave material care under statutory regulations relating to unemployment, sickness, incapacity, disability and death, on the basis of the Military Civil Service 1931 or the Military Pensions Framework Law and the care in the area of social support and mental health care and are in line with that.


Article 7. Provision of income related to care

  • 1 Our Minister affects the veteran adequate income provision for the duration required in connection with the rehabilitation, re-integration and guidance of the veteran as intended. Article 5 .

  • 2 For the purpose of carrying out the income referred to in paragraph 1, rules shall be laid down by or pursuant to general rules of administration concerning:

    • a. the conditions to which the veteran must comply in order to qualify for the income supply;

    • (b) to determine the amount of the income to be paid, on the basis of an allowance of 80% of the amount of the income he received during the year prior to his notification to the site, Article 8, second paragraph, point (c) Have been in a position to enjoy the practice of his profession or business;

    • c. the reckoning of other income with the income supply.


Article 8. Veterans ' care cooperation (veterans contact and care coordination)

  • 1 Our Minister promotes because of the special duty of care, intended in Article 5 , the cooperation between the implementing bodies involved in rehabilitation and rehabilitation and material care, as well as the health care institutions involved in social support and mental health care.

  • 2 After consultation with our Minister of Social Affairs and Employment and Our Minister of Health, Welfare and Sport, rules on:

    • the establishment of the cooperation between the implementing bodies involved in rehabilitation and reintegration and material care and the health care institutions involved in social support and mental health care;

    • (b) provide, where possible, joint management of the application, assessment, allocation and payment of benefits, pensions and provisions relating to sickness, incapacity for work and disability;

    • c. organizing the access to rehabilitation and re-integration and material care and social support and mental health services by establishing a lure for veterans and their relationships;

    • d. assign care coordinators for the personal guidance of the veteran and his relationships in rehabilitation and re-integration, material care, social support and mental health care.


Article 9. Veteran registration system

  • 1 For the purposes of the identification of veterans and of the possibility of informing veterans about the application of the Articles 2 to 8 and for the benefit of scientific research, personal data of veterans is processed in the Veterans Registration System. Our Minister is responsible for this processing.

  • 2 In the case of a general measure of governance, detailed rules relating to the establishment and management of the Veterans Registration System and the possibility of the provision of personal data to third parties performing activities in the framework of recognition and appreciation for veterans.


Article 10. Scientific research

Our Minister promotes scientific research into diseases that may be related to the exercise of service under conditions and in a mission as intended Article 1 (c) .

The nomination for a general measure of management to be adopted under this Law shall not be made more than four weeks after the draft has been submitted to both Chambers of the States General.


Article 14. Accountability

Within two years of the entry into force of this Act, and thereafter every two years thereafter, our Minister shall send to the States-General a report on the effectiveness and effects of this law in practice.


Article 15. Citation Title

Article 16. Entry of

This Law shall enter into force on a date to be determined by Royal Decree.

Burdens and orders that it will be placed in the Official Gazette, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
