All of them, who will see or hear these, saluut! do know:

Having considered that it is necessary to lay down rules implementing the Convention on the pursuit of fishing activities in the North Atlantic Ocean, which was established in London on 1 June 1967, with Annexes and Appendix;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:


Article 1

  • 1 This law is governed by:

    • a. "Convention": the Convention on the pursuit of fishing activities in the North Atlantic Ocean, established in London on 1 June 1967, with Annexes and Appendix ( Trb. 1968, 54);

    • (b) "fishing vessel" means any vessel used by business to fish for those parts of the Atlantic Ocean and the Arctic Ocean, and the seas connected therewith, to which the Convention applies;

    • c. "vessel" means any fishing vessel and any vessel used for the processing of fish, the supply of, or the provision of services to, fishing vessels;

    • d. "skipper" shall mean any commander of a vessel or the person who replaces it.

  • 2 A vessel shall be regarded as Dutch if it is operated in the Netherlands as a whole, as a rule in the Netherlands, and for at least two thirds of the vessel belongs to:

    • (a) one or more natural persons having the nationality of one of the Member States of the European Communities or of any other State party to the Agreement on the European Economic Area, or

    • (b) one or more legal persons established in accordance with the law of a Member State of the European Communities or of any other State party to the Agreement on the European Economic Area and who are registered office, central administration or principal place of business within the European Communities or within any other State party to the Agreement on the European Economic Area.

  • 1 The skipper of a Dutch fishing vessel shall be obliged to ensure that a document on board the nationality of the vessel is present on board.

  • 2 The document referred to in the previous paragraph shall be issued by the holder of the Central Fisheries Register. Rules governing the form of the document and the documents to be presented in the application shall be laid down in the form of a general measure.

The skipper of a Dutch fishing vessel shall ensure that a Dutch flag in good standing is present on board, and that it be lifted upon the request of the competent authorities. He shall refrain from any action which may raise doubts as to the nationality of his vessel.


Article 4

The skipper of a Dutch fishing vessel shall be obliged to comply with the requirements laid down in Annex III to the Treaty in respect of lamps, signals and signals to be used on board.


Article 5

The skipper of a Dutch fishing vessel is obliged to observe the requirements laid down in Annex IV of the Treaty with regard to the marking of fishing gear.


Article 6

The owner or, in the case of hull-charting, the bareboat charterer of a Dutch fishing vessel ensures that it is equipped such that the skipper is on the inside. Article 2, first paragraph , 3 , 4 and 5 It may meet obligations defined. It shall also ensure that it clearly indicates the name of the municipality where it is registered in the local fisheries register, and the name under which it is registered.

The skipper of a Dutch vessel is obliged to comply with the rules laid down in Annex V of the Treaty with regard to the manoeuvring of vessels and the non-handling of operations causing damage to other vessels. vessel or gear may arise.


Article 8

The Article 2, first paragraph , 3 , 4 , 5 and 7 they apply mutatis mutandis to the skippers of vessels which are nationals of another State which is a party to this Treaty if the vessel is in the fishing zone established under the conditions of the Control of fishing zone .

Officials shall, in accordance with the provisions of Article 9 of the Treaty, be responsible for monitoring compliance with the provisions of the Treaty. The supervisory authority is empowered, with the necessary equipment, to enter a dwelling without the permission of the occupant. The supervisory authority does not have the power specified in the Article 5:18 of the General Administrative Law .

  • 1 Act or omission contrary to the rules laid down in or pursuant to the rules Article 2, first paragraph , 3 , 4 , 5 , 6 and 7 of this law shall be subject to detention with custody not exceeding six months or a fine of the third category.

  • 2 The facts, punishable in the first member, are offences.

  • 1 The Law of 7 December 1883, Stb. 202), which is to be implemented in the light of the agreement reached on 6 May 1882 in the Hague, on the rules for the police of fishing activities in the North Sea, outside territorial waters.

  • 2 If the vessel has issued a certificate in accordance with Article 4 of said law, shall replace that declaration Article 2, first paragraph This document, as provided for in this Act, has not expired five years after the date of entry into force of this Act.

This law may be cited as: Implementing Law Fisheries Convention 1967.


Article 15

This Law shall enter into force from the date of the entry into force of the Treaty of London of 1 June 1967 on fishing in the North Atlantic for the Netherlands.

Burdens and orders, which are in the State Sheet All ministerial departments, authorities, colleges and civil servants, with whom this is concerned, will keep their hands on the precise implementation.
