All of them, who will see or hear these, saluut! do know:

In this regard, we considered that the revision of the International Convention for the Protection of New Varieties of Plants, which was adopted in Geneva on 19 March 1991, was adopted in Geneva on 31 December. Article 91, first paragraph, of the Constitution , the approval of the States-General need to be approved before the Kingdom can be bound by it, and that it is necessary under the said Treaty to grant the Seeds and Plantation Law and the Law on economic crimes to be modified by parts;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

The revision of the International Convention for the Protection of New Varieties of Plants, adopted in Geneva on 19 March 1991, in which the French and English texts were published in Geneva, Tractatenblad 1992, 52 and the translation into Dutch in Tractatenblad 1993, 153, is approved for the Netherlands.

  • 1 This law applies to varieties for which a plant variety right has already been granted before the date of entry into force of this Law, but on the understanding that acts as referred to in Article 40, first paragraph, relating to material of such varieties, which occur before the date of entry into force of this Act, Seeds and Plantation Law , as they lude until that date, apply.

  • 2 Article 40, fourth and fifth paragraph, shall not apply to harvested material or to products obtained directly therefrom, obtained before the date of entry into force of this Law by propagation of propagating material which is not authorized was granted.


ARTICLE V

This Act shall enter into force from the day following the date of issuance of the State Sheet in which it is placed, with the exception of the Articles II , III and IV , which enter into force at a time to be determined by royal decree.

Burdens and orders that are in the State Sheet will be placed, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
