Law of 6 November 1991 laying down rules on the implementation of the Convention on Conventional Forces in Europe

All of them, who will see or hear these, saluut! do know:

In this regard, we considered that the implementation of the Convention on Conventional Forces in Europe and its part form an integral part of the Protocol on Inspection, with due regard to Article 12 of the Constitution (i) it is necessary to lay down rules on the cooperation of any surprise inspections and the entry into service of dwellings without the consent of the occupant in connection with verification of the provisions of the Treaty;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

For the purpose of this Act:

  • (a) the Convention: the Convention of 19 November 1990 on Conventional Forces in Europe and it an integral part of its Protocol on Inspection ( Trb. 1991, 31);

  • Inspectors: inspectors referred to in paragraph 1 (E) of Title I of the Protocol on Inspection;

  • c. guidance team: the guidance team referred to in paragraph 1 (H) of Title I of the Protocol on Inspection;

  • d. surprise inspection: the surprise inspection referred to in Title VIII of the Protocol on Inspection.

  • 1 In the event of a surprise inspection, the Head of the Guidance Team shall be responsible for the recovery of any cooperation necessary for the performance of the tasks conferred on the inspectors and the accompanying team for the purpose of carrying out the tasks conferred upon it by the Treaty.

  • 2 He intentionally fails to comply with a claim as referred to in paragraph 1 and, on the occasion of a surprise inspection, he intentionally took a single action by an inspector or a member of the accompanying team. the execution of their duties as defined, impeding, obstructing or obstructing the task of the Treaty shall be subject to a maximum of three months ' imprisonment or a fine of the second category.

  • 2 The inspectors and members of the accompanying team shall be competent in derogation from Article 2 of the General Act on entering without permission to enter a dwelling without the permission of the occupant.

  • 3 The head of the guidance team shall make the written report as referred to in Article 10 of the General Act on indoor reason . In this report, he shall also state the names and status of the members of the accompanying team and of the inspectors.

If, following the exercise of the tasks of the Treaty, the inspectors have been ordered to pay compensation, the State of the Netherlands shall, for that purpose, be liable to exclusion.

This Act shall enter into force from the day following the date of issuance of the State Sheet where it is placed.

This law can be cited as: CSE Convention.

Burdens and orders that are in the State Sheet will be placed, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
