Law of 30 September 1954 setting up a product for ornamental plants

We JULIANA, at the grace of God, Queen of the Netherlands, Princess of Orange-Nassau, etc., etc., etc.

All of them, who will see or hear these, saluut! do know:

In this regard, we considered that it would be desirable to proceed, in accordance with the opinion of the Economic and Social Affairs Council, on the establishment of a product as defined in the Law of the Business Organization ( Stb. 1950, K 22, since amended) for undertakings in the cultivation and marketing of ornamental plants and of the holding company;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

  • 1 There is a Product for Siercrops.

  • 2 The product shall have its seat in the Hague.

  • 1 The product is set up for the undertakings in which:

    ornamental plants are grown;

    the trade-with the exception of the landing, transit and triangular trade-shall be carried out in ornamental plants or parts thereof;

    Further work is carried out.

  • 2 In the case of undertakings referred to in paragraph 1, auctions of the products referred to in that paragraph shall be regarded as undertakings.

  • For the purposes of this Act, ornamental plants shall mean:

    • (1st. bulbs, tubers and rhizomes of flower crops;

    • (2nd) flowering plant products, including breeding materials other than seeds;

    • 3rd. nurseries and nurseries, including breeding materials other than seeds.

  • 4 In this Act, the following definitions shall apply:

    ornamental plants: fruit trees, including small-protein crops, fruit tree sub-trunks, planting stock of strawberries, forest and sawplantings, rose stems, Christmas trees and wild-grown products, with a view to its ornamental value in the economic sector transport;

    Trade: the activity of intermediaries.

The Board of Directors of the Product shall consist of 24 members. The following are hereby appointed:

The Steering Board shall be empowered to appoint an alternate from among its members for each member of the Executive Board.

  • 1 The product shall have commissions of assistance for matters relating to:

    • Bulbs, tubers and rhizomes of flower crops;

    • (b) flowering plant products and hovening activities;

    • c. Tree nurseries products.

  • 2 The commissions shall be the board of advice each for its working area.

  • 1 The members of the committees of assistance shall be appointed by organisations of entrepreneurs and of workers appointed by the Economic and Social Council. In the case of designation, the representatives of the economic operators concerned and of the workers concerned shall be the subject of the opinion of the Council only and shall be the associations with full jurisdiction.

  • 2 The organisations shall also appoint an alternate for each member, which they appoint.

  • 3 The Social-Economic Council shall determine the number of members of each assistance committee, as well as the number of members, which may appoint any organisation designated by it. The chairman of the product shall also be chairman of the committees of assistance. The term of office of the members of the committees shall coincide with those of the members of the Board of the Committee of the Product.

  • 4 In a committee of assistance, the organization of entrepreneurs and of workers, working in the field of cultivation, has as many members as the organizations of entrepreneurs and of employees, working in the field of commerce.

  • 1 The product is left to the scheme or further arrangement of the following subjects:

    • (a) matters relating to economic movement between different stages of production and marketing, including, if or to the extent defined by the Commission, the prices;

    • (b) the registration of the undertakings for which the product is established;

    • (c) providing the information necessary for the performance of the task of the product;

    • d. the inspection of books and records and visits for the performance of the task of the product, and the incorporation of company resources and supplies of undertakings.

  • 2 As matters referred to in the preceding paragraph, A The following shall not be regarded as:

    • (a) the establishment, extension and closure of undertakings;

    • b. The import and export.

  • 3 Regulations on the subjects referred to in paragraph 1 do not cover the landing, transit and triangular trade.

  • 4 Regulations on matters referred to in the first paragraph, C and Ed , keep in place safeguards against misuse of the information to be provided pursuant to those Regulations.

On a land-based basis Article 93, First paragraph, of the Law on Business Organization (a) Regulation may be laid down to bind the natural and legal persons referred to or pursuant to that Regulation other than the natural and legal persons referred to in that Article, in so far as such acts are carried out, to be engaged in business in the undertakings for which the product is established.

  • 1 Regulations under which Article 126, First paragraph, of the Law on Business Organization a levy is imposed on a purpose other than cover for the operating expenses of the product, by way of derogation from the third paragraph of that Article, the approval of Our concerned Ministers; (v) immediately after its adoption to the Economic and Social Council, has been notified.

  • 2 The establishment of a fund in the interests of the company's benefit is to be decided by a Regulation. Such a regulation requires the approval of Our Concerted Ministers.

  • 3 The Ministers concerned may provide for decisions to be made by a fund in the interests of the company's own business.

For the purposes of this Act and of the Articles 94 , 100 , third member, and 104, 2nd paragraph, of the Law on Business Organization in the case of the product, the Ministers concerned are considered to be our Minister for Agriculture, Fisheries and Food and, in cases to be determined by general management, our Minister for Economic Affairs.

This law will enter into force on a date to be determined by Us.

Burdens and orders, which are in the State Sheet will be placed, and that all Ministerial Departments, Authorities, Colleges and Officials, who so concern, will keep their hands on the precise execution.
