Act of 27 September 2012 approving the Treaty of 2 December 2010 in Brussels on the establishment of the Functional Airspace Block 'Europe Central' between the Federal Republic of Germany, the Kingdom of Belgium, the Republic of France, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Swiss Confederation (Trb. 2011, 27) and amendment of the Air Aviation Act implementing Regulation (EC) No. Regulation (EC) No 1070/2009 of the European Parliament and of the Council of the European Union of 21 October 2009 amending Regulations (EC) No 1070/2009 549/2004, (EC) No 550/2004, (EC) No 551/2004 and (EC) No 552/2004 in order to improve the performance and sustainability of the European aviation system (PbEU 2009 L 300)

In this regard, we considered that the Treaty on the establishment of the functional airspace block 'Europe Central' between the Federal Republic of Germany, the Kingdom of Belgium, the Republic of Germany, was established in Brussels on 2 December 2010. France, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Swiss Confederation pursuant to Article 91, first paragraph, of the Constitution the approval of the States-General need, before the Kingdom can be bound by it; and, furthermore, that it is necessary to Aviation Law to be amended to take account of the implementation of Regulation (EC) No 248/EC Regulation (EC) No 1070/2009 of the European Parliament and of the Council of the European Union of 21 October 2009 amending Regulations (EC) No 1070/2009 549/2004, (EC) No 550/2004, (EC) No 551/2004 and (EC) No 552/2004 in order to improve the performance and sustainability of the European aviation system (PbEU 2009 L 300);

For instance, we, the Department of Advising the Council of State, and with the mean consults of the States-General, have been well-liked and understood to be right and to be understood as saying:

• The Treaty establishing the Functional Airspace Block "Europe Central" between the Federal Republic of Germany, the Kingdom of Belgium, the Republic of France, the Grand Duchy of Luxembourg, established in Brussels on 2 December 2010, Kingdom of the Netherlands and the Swiss Confederation, of which the Dutch, French and German texts have been published in Tractatenblad 2011, 27, is hereby approved for the European part of the Netherlands.

• 2 The decisions of the FABEC-Council, drawn up in accordance with Article 23 (2) of the Treaty referred to in paragraph 1 of this Article, do not require the approval of the States-General.

This Act shall enter into force from the day following the date of issuance of the Official Gazette in which it is placed.

Burdens and orders that it will be placed in the Official Gazette and that all ministries, authorities, colleges and public servants who so far as to do so will keep their hands on the precise execution.
