Law of 9 July 1970, establishing the Education and Training Experiments Act

All of them, who will see or hear these, saluut! do know:

In this regard, we considered that it would be desirable for the development of education to provide for a system of training which could be carried out on educational grounds beyond the limits of the individual Member States, and to the benefit of the education laws and in the Law on secondary education ( Stb. (387) to increase the possibilities for derogation by reason of the special establishment of education;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:


Article 1

This law shall be governed by:

"Our Minister": Our Minister of Education, Culture and Science and, in respect of agricultural education, Our Minister for Economic Affairs;

'educational laws' means: Law on primary education , the Law at the centres of excellence , the Law on secondary education , the Primary Education Act BES , the Secondary Education Act BES ;

'school' means a school or establishment within the meaning of an educational law;

'competent authority': as regards:

  • a. a state school: Our Minister;

  • b. a municipal school: the college of mayor and aldermen, to the extent that the council decides otherwise and, if the council considers it appropriate, taking into account the rules to be laid down by the council;

  • (c) a special school: the school board;

  • d. a public school in the public bodies Bonaire, Sint Eustatius and Saba: the administrative board of the public body Bonaire, Sint Eustatius or Saba.

'pupil' means an apprentice or a student within the meaning of an educational law.

  • 1 If it is the responsibility of the Minister to give an experiment that falls outside the limits of the individual educational laws, our Minister may decide that this education is financed from the public purse.

  • 2 Our minister makes his decision on an application as referred to in paragraph 1, known to the applicant within nine months of receipt of that application.

  • 3 Our minister decides not to pay the funding referred to in paragraph 1 if it is reasonable to expect that, as a result, the number of schools in schools of the same direction in the food area will be reduced in such a way as to continue to exist. Threatened.

  • 4 Our Secretary of State shall ensure that decisions taken under this Article are in accordance with the principle of a balanced set of educational provisions where possible.

  • 6 The financing provided for under paragraph 1 may be terminated before the expiry of the period fixed for that date:

    • a reasoned request of the competent authority;

    • b. by Our Minister if no more is being met on the rules and conditions referred to in Article 4, first paragraph ;

    • c. by our Minister if the experiment proves not to lead to the ends envisaged;

    • d. if our Minister is of the opinion, that continuation of the experiment would not be in the interests of the students.

  • 1 If application of Article 2, first paragraph , is required for a municipal, special school or public school in the public body Bonaire, Sint Eustatius or Saba, the competent authority shall make a request to our minister under the insertion of an experimental plan. and a budget of expenditure.

  • 1 At a school funded by Article 2, first paragraph , the rules and conditions laid down by our minister in his decision, given by or under any of the educational laws, apply. In so far as it is not regulated by the preceding sentence, our Minister shall determine the rules and conditions of payment as well as the manner in which it is to be granted when deciding on the terms and conditions for the payment of the aid.

  • 2 If the funding of an experiment is terminated to a school immediately prior to the application of Article 2, first paragraph , from the public purse, compensation is again granted under the same rules and conditions as for the school type to which the school belonged before the start of the experiment.

  • 1 In respect of higher vocational education to which this Law applies at the time of the entry into force of the Law on higher education and scientific research , it shall continue to apply to or pursuant to this Law until the time when the funding for the experiment in question is terminated.

  • 2 If an experiment concerns a school of teacher training, that school shall not be subject to further training without prejudice to the first sentence of Article XIV of the Law of 7 July 1993 ( Stb. 405).

With regard to education and vocational education to which this Law applies on the day before the entry into force of the relevant provisions of the Law on education and vocational education , it shall continue to apply to or pursuant to this Law until the time when the funding for the experiment in question is terminated.
