I. At 13.06.2013, by decision No. 99, the audiovisual Coordinating Council issued the license for broadcasting undertaking "Video-Content" S.R.L., for the tv station with satellite broadcasting "Film".
By letter f/No. of 11 April 2014, the "Video-Content" S.R.L. has informed the CCA that will temporarily stop broadcasting television station "Movie" starting April 15, 2014, for a period of 45 calendar days, the time needed to resolve technical problems occurring.
It should be mentioned that by the same letter, the Director of the enterprise "Video-Content" S.R.L. has assumed the responsibility to inform in advance about emission CCA replay tv "Movie".
The date of May 30, 2014, those 45 days have expired, and the Director of the enterprise "Video-Content" S.R.L. has not informed nor so far about replay tv emission "Movie", which denotes that the post has not resumed broadcasting and never activates.
It should be mentioned that according to the decision by ABOUT No. 30/144 of 22 July 2015, Audiovizualui Coordinating Council warned the public enterprise "Video-Content" S.R.L., founder of satellite television broadcasting "Film", for derogations from article 2. 27(2). (1) (a). e) of the broadcasting code and item 3.1 lit. the emission licence) of the AC series nr. 000009 from 13.06.2013, in accordance with article 5. 38 para. (1) (a). the broadcasting code).
By letter No. 447 of 31 July 2015, the Manager of the enterprise "Video-Content" S.R.L., Irina silver, was notified about the penalty meted out by the CCA, the same letter was requested to report on the execution of the CCA Decision nr. 30/144 of 22 July 2015. Until now, the CCA has not come to this address any letter from the administrator in question.
II. At 25.03.2013, by decision No. 36, the audiovisual Coordinating Council issued the license for broadcasting undertaking "SHOW-style" S.R.L. for television station "TV Style", whose service programmes to be broadcasted through networks of distributors of services in the country.
Until now, the Manager of the enterprise "SHOW-style" S.R.L., Stela Ladson, has informed the CCA about the start of the broadcast service.
III. At 23.05.2012, by decision No. 72, the audiovisual Coordinating Council issued the license for Broadcasting Company "Status" for Marketing S.R.L. tv station "OTV", whose service programmes to be broadcasted through networks of distributors of services in the country.
Until now, the Manager of trading company "Marketing Status" S.R.L., Iulia Dubcoveţki, has informed the CCA about the start of the broadcast service.
In the context of those mentioned above, art. 27(2). (1) (a). d and e)) of the Broadcasting Code stipulates: "the audiovisual Coordinating Council can withdraw the license for broadcasting only where: e) pensioner ceased to broadcast service programs for which he was awarded the license for more than 45 days for reasons of a technical nature and more than 72 hours of any other causes;
(d) the proprietor does not start broadcasting) service of not more than one year from the date of issue of the licence ".
At the same time, art. 27(2). (2) of the broadcasting code States: "the audiovisual Coordinating Council apply to the withdrawal of the license in accordance with the procedure and the rights established by this code and other legislative acts, only after having exhausted other ways to sanction referred to in article 38".
In accordance with the provisions of art. 27, 38-41 of the broadcasting code no. 260-XVI of BCC is supervised, status, art. 27 of the regulation on the procedure and conditions for issuing licences and permits, approved under Resolution No. 433-XVI dated 28.12.2006 on Moldova's Parliament, under national laws, the audiovisual Coordinating Council DECIDES: 1. To apply a fine amounting to 1800 lei enterprise "Video-Content" S.R.L., founder of satellite television broadcasting "Film", for derogations from article 2. 27(2). (1) (a). e) of the broadcasting code and item 3.1 lit. the emission licence) of the AC series nr. 000009 from 13.06.2013, in accordance with article 5. 38 para. (1) (a). the broadcasting code) (PRO-(7)-UNANIMOUS HAMMER, m. OBI-MÎŢU, c. HADARCA, Iu. CARLSON, b. DAMASCUS, a. CASTILLO, o. GUŢUŢUI).
2. To apply the public warning "SHOW-style" S.R.L., founder of television station "TV" Style, for derogations from article. 27(2). (1) (a). (d)) of the broadcasting code and item 3.1 lit. the emission from the licence) series AA No. 082900 from 25.03.2013, according to art. 38 para. (1) (a). the broadcasting code) (PRO-(7)-UNANIMOUS HAMMER, m. OBI-MÎŢU, c. HADARCA, Iu. CARLSON, b. DAMASCUS, a. CASTILLO, o. GUŢUŢUI).
3. To apply the public warning S.C. " Marketing status "S.R.L., founder of television station" OTV ", for derogations from article 2. 27(2). (1) (a). (d)) of the broadcasting code and item 3.1 lit. the emission from the licence) series AA No. 082895 from 23.05.2012, according to art. 38 para. (1) (a). the broadcasting code) (PRO-(7)-UNANIMOUS HAMMER, m. OBI-MÎŢU, c. HADARCA, Iu. CARLSON, b. DAMASCUS, a. CASTILLO, o. GUŢUŢUI).
4. Television stations sanctioned will, within 15 days from the time the knowledge of this decision, a report on the measures taken with a view to the liquidation of infringements ascertained.
