Pursuant to the provisions of article 18 paragraph 1. (1) and 22 of annex 4 to position 3 in the law No. 235 of 1 December concerning the activities of accreditation and conformity assessment (Official Gazette of the RM, no. 46, -47, art. 136), with subsequent amendments and additions, the law No 435-XVI dated December 22, 2006 on technical regulation activity (Official Gazette of the Republic of Moldova, 2007, no. 36-38, art. 141), as amended and supplemented, and in furtherance of the national action plan for the implementation of the Association Agreement Moldova-European Union during the period 2014-2016 approved by Government decision No. 808 of 7 October 2014 (Official Gazette of the Republic of Moldova No. 2014, 297-309, article 851), with subsequent amendments and additions, the Government DECIDES: 1. Approving the technical regulation regarding the making available on the market of pressure equipment (to be attached).
2. Ministry of the economy, within 6 months from the date of publication of this judgment, will develop and approve the list of harmonized standards to technical regulation concerning making available on the market of pressure equipment.
3. this decision shall enter into force 24 months after the date of its publication in the Official Gazette of the Republic of Moldova, except the 94 points, 96, 105, 130, 135, 136, 159, 161 and 168 from technical regulation concerning making available on the market of pressure equipment, which will enter into force on the date of entry into force of the agreement on conformity assessment and acceptance of industrial products (ACE) , protocol to the association agreement between the Republic of Moldova, on the one hand, and the European Union and the European Atomic Energy Community and their Member States, of the other part.
4. Until the entry into force of the agreement on conformity assessment and acceptance of industrial products untill times Moldova's accession to the European Union: 1) is allowed in making available on the market and putting into service of pressure equipment and assemblies bearing the CE marking of conformity SM, accompanied by the EC declaration of conformity, applied under the provisions of law No. 235 of 1 December concerning the activities of accreditation and conformity assessment;
     2) the manufacturer or his authorised representative, established in the Republic of Moldova, affixes the CE marking of conformity SM where conformity assessment of pressure equipment and assemblies for the domestic market shall be carried out by the conformity assessment bodies recognized by using the procedures described in Chapter VIII of the common technical regulation concerning making available on the market of pressure equipment with the exception of module A;
     3) it is prohibited, under the regulation of the data available on the market of pressure equipment, applying the same pressure equipment of the CE marking of conformity and the CE marking SM;
4) requirements relating to conformity assessment bodies notified also applies to conformity assessment bodies recognized. To conduct conformity assessment procedures, of the conformity assessment bodies recognized performing conformity assessment of pressure equipment shall furnish the type-examination certificates;
5) cuprizînd list of conformity assessment bodies recognized, the specific tasks for which they have been recognised and their identification numbers shall be published in the Official Gazette of the Republic of Moldova.
5. Ministry of economy recognizes the bodies carrying out conformity assessment of pressure equipment and assemblies for the domestic market in accordance with the procedures set out in Chapter VIII of the common technical regulation concerning making available on the market of pressure equipment.
6. the obligations and liability of the manufacturer, his authorised representative, the importer or the Distributor, based in the Republic of Moldova, concerning pressure equipment and assemblies made available on the market and put into service, branded with the mark of conformity SM correspond to those laid down in this decision for pressure equipment and assemblies with the CE marking.
7. Following the entry into force of this Decision shall be repealed decisions No. 262 of 3 April 2009 approving the technical regulation "pressure equipment" (Official Gazette of the Republic of Moldova, 2009, no. 75-77, art. 320).
8. The control over the execution of the given decision is put in charge of the Ministry of economy.
