with respect to the determination of the amount of subsidies from the State budget for the year 2016 intended political parties according to the performance obtained in the parliamentary elections of 30 November 2014 and local general elections of June 14, 2015



Published: 16.09.2016 in Official Gazette No. 306-313 art No.: 1528 date of entry into force: 18.08.2016 1 July 2016 was adopted Law No. 154 concerning the State budget for the year 2016, published in Monitorul Oficial nr. 230-231/486 of 26 July 2016. In accordance with paragraph 1. (9) article. 2 of the Act, the amount of the allowance is called from the State budget for the year 2016 for the funding of political parties constitute 39850.0 thousand lei, and under art. 27(2). (1) of law No. 294-XVI of 21 December 2007 on political parties, the amount of countervailable subsidies established shall be distributed as follows: 50% of)-political parties in proportion to the performance obtained in parliamentary elections;
b) 50%-of political parties in proportion to the performance it's obtained in local elections.
In accordance with section 39 of the regulation on the financing of the activity of political parties, approved by the decision of the Central Election Commission no. 4401 from 23 December 2015, independent candidates, no matter who the candidate function, do not receive subsidies from the State budget, and the performances obtained by them in the context of elections shall be excluded from the calculation formula for establishing the amount of subsidies from the State budget according to art. 27(2). (6) (a). b) of law No. 294-XVI of 21 December 2007 concerning political parties, are entitled to allowances from the State budget cannot be harnessed by political parties, if: (a) their activity) was limited pursuant to article. 21-for the whole period of limitation of political party activity;
b) lose their legal personality;
c) are in the process of liquidation.
Thus, by decision of the Ministry of justice no. 1 of 25 January 2016, political party "the Communist Party Reformer" lost its legal personality, being removed from the register of political parties held by the Ministry of Justice.
At the same time, according to paragraph 1. (2) of article 9. 27 of law No. 294-XVI of 21 December 2007 on political parties, electoral blocs, in the case of the grant will be divided according to the prior understanding between the members of the electoral bloc or, in the absence of an agreement, according to the number of mandates obtained by each component. Given the fact that the constituent agreements of the electoral bloc "Moldova-Customs Union", registered for the parliamentary elections of 30 November 2014, the electoral bloc "Moldova's European Popular Platform-Iurie Leanca" and the electoral bloc "PEOPLE'S LIST", recorded for the General local elections of 14 June 2015, do not contain provisions in this respect, political formations as components of electoral blocs have been above shown by the Cec through steps no. CEC-8/130, 8/131, 8/132 of 10 august 2016 and no. CEC-8/141 of 12 august 2016, to be submitted to the understanding of information-sharing subsidies from the State budget between members of blocs or, where appropriate, the information relating to the number of seats obtained by each party of the electoral bloc.
On august 12, 2016, the CEC came from the Democratic Action Party (PAD) Political Party and Liberal Reformer (hereinafter-PP PLR), as well as parts of the electoral bloc "Moldova's European Popular Platform-Iurie Leanca," additional agreement of 11 august 2016, by which the Commission is informed of the fact that the monthly allowances to be made to the PAD and PP will distribute PLR in size by 50% and 50% to the PAD PP PLR.  
In the context of those above referred to and to enforce the provisions of art. 27(2). (3) of law No. 294-XVI of 21 December 2007 concerning political parties, determine the amount of the monthly subsidy intended for the funding of political parties in proportion to the performance obtained by them in the election, as follows: a) for parliamentary elections of 30 November 2014, the amount of the monthly subsidy for every valid vote expressed constitute 1.1060957 lei, set amount according to the formula: (19925000.00 lei: 1501151 valid votes cast): 12 months where 19925000.00 lei constitutes 50% of the amount of the allowance provided for the funding of political parties, according to the annual budget law, and 1501151 represents the total number of valid votes cast for political parties and electoral bloc, having obtained performance within the parliamentary elections of 30 November 2014, according to the Central Election Commission decision nr. 3103 5 December 2014 regarding election results summed up in the Moldovan Parliament on 30 November 2014, being excluded the number of valid votes obtained by the political party "the Communist Party Reformer"-and obtained 78716 candidates independents-18651;
(b)) for the General local elections of 14 June 2015, the amount of the monthly subsidy for every valid vote expressed constitute 0.4682758 lei, set amount according to the formula: (19925000.00 lei: 3545809 valid votes cast): 12 months 19925000.00 lei, where 50% of the amount of the allowance provided for the funding of political parties, according to the annual budget law, and 3545809 represents the total number of valid votes cast for the election of Councillors rayon, communes (communes), municipal mayors, in the first round of elections, political parties and electoral blocs, namely the candidates nominated by them, in the context of the General local elections of June 14, 2015, according to extracts of the minutes concerning the voting totals, drawn up by the electoral organs hierarchically inferior.
Starting from calculations carried out in accordance with article 27(2). (1) and (2) of law No. 294-XVI of 21 December 2007 concerning political parties, art. 2 (2). (9) of law No. from 1 July 2016 154 concerning the State budget for the year 2016, art. 18 paragraph 1. (2) and article 3. 22 paragraph 1. (2) (a). the electoral code) No. 1381-XIII of November 21, 1997, the decision of the Central Election Commission no. 3103 5 December 2014 regarding election results summed up in the Moldovan Parliament on 30 November 2014 and in accordance with paragraphs 38 to 46 of the Regulation on the financing of the activity of political parties, approved by the decision of the Central Election Commission no. 4401 from 23 December 2015, Central Electoral Commission h a t â â t e r, and others: 1. the amount of the subsidy shall be fixed monthly 1.1060957 lei for each valid vote expressed by political parties and granted electoral bloc in parliamentary elections on November 30, 2014.
2. Approves, in accordance with the annex. 1, the amount of monthly subsidies allocated to political parties and the electoral bloc of State budget for the year 2016, according to performance achieved in the parliamentary elections of 30 November 2014.
3. the amount of the subsidy shall be fixed monthly 0.4682758 lei per month for each valid vote granted political parties expressed and electoral blocs under the General local elections of 14 June 2015.
4. Approves, in accordance with the annex. 2, the amount of monthly subsidies allocated to political parties and electoral blocs from the State budget for the year 2016, according to performance achieved in local general elections of June 14, 2015.
5. Undertake political formations-the Social Democratic Party and party of regions of Moldova, members of the electoral bloc "constituents of CHOOSING MOLDOVA-CUSTOMS UNION", registered for the parliamentary elections of 30 November 2014, political formations and Social Democratic Party Political Party and centrist Union of Moldova, members of the electoral bloc "LIST of people", recorded for the General local elections of 14 June 2015, submit to the Central Electoral Commission until September 15, 2016 including information on how Division of subsidies from the State budget between members of electoral blocs.
6. Political parties are the beneficiaries of subsidies from the State budget, will open a special bank account for this purpose, and shall transmit to the Central Election Commission data bank to make the transfer.
7. Subsidies from the State budget shall transfer monthly starting august 2016.
8. this decision shall enter into force on the date of adoption shall be published on the official website of the Central Election Commission and the Official Gazette of the Republic of Moldova.
