with respect to the amended regulations on the purchase of drugs and other medical produsede health system needs



Published: 18.12.2015 in Official Gazette No. 340-346 art no: 956 Repealed by HG1128 from 10.10.16, MO353-354/11.10.16 art. 1210 pursuant to law No. 96-XVI of 13 April 2007 on public procurement (Official Gazette of the Republic of Moldova, 2007, no. 107-111, art. 470), as amended and supplemented, and in order to ensure the effectiveness of the procurement of medicines and other medical products for the needs of the health system, the Government DECIDES: 1. Regulations on the purchase of drugs and other medical products for the needs of the health system approved by Government decision No. 568 of 10 September 2009 (Official Gazette of the Republic of Moldova, 2009, 144-147, 632), with amendments and additions thereto, shall be amended as follows: 1) in regulation: a) to paragraph 17 the letter p), the words "the drug agency and medical devices" shall be replaced with the words "medical institutions";
(b) in paragraph 36): in the first sentence, the words "after the signing of the contracts in question at the headquarters of the Agency of the medicines and medical devices by the operators of the nominated winners and medical institutions" shall be replaced with the words "after receiving their contracts from healthcare institutions";
the second sentence shall read as follows: "at the conclusion of the contract the operator appointed to present the winner must also guarantee medical institution for the proper performance of the contract.";
c) 57:2): the text of the letter c), the words "invites the parties to contracts" shall be replaced with the words "requests the contracts";
Letter c) 1 shall be excluded;
the letter d) shall read as follows: "d) coordinates (countersigned) contracts following open invitations to tender, after which it presents, in a centralized manner, the public procurement Agency towards recording";
letter "e") are excluded;
menu item 3): (a)) and (b)) shall read as follows: ' a) conclude supply contracts of medicines and other medical products with bidders you designate (s);
b) presents in four copies of the medicines agency and medical devices, for coordination (signature), contracts concluded with operators of the nominated winners ";
2) in annex No. 3 to Regulation: a) in section 6.1, ' total contract "shall be replaced with the words" Goods not delivered ";
b) in point 6.2, the words "total agreement" shall be replaced with the words "Goods not delivered".
2. Amendments to the annex. 3 the Regulation shall apply, including for procurement contracts for drugs or other medical products which are to be concluded following the award procedures under way on the date of entry into force of this judgment.
