to amend and supplement the regulation on voting citizens of the Republic of Moldova abroad dependent country, approved by the decision of the Central Election Commission no. 3375 of 27 July 2010



Published: 23.09.2016 in Official Gazette No. 315-328 art Nr: 1565 date of entry into force: 23.08.2016 in order to adjust the provisions of the regulation with regard to Moldova's citizens voting abroad dependent country, approved by the decision of the Central Election Commission no. 3375 of 27 July 2010 with the new provisions of the electoral code, adopted by law No. 147 of 15 July 2016, and pursuant to article 6. 18 paragraph 1. (2), art. 22 lit. c) electoral code no. 1381-XIII of November 21, 1997, art. 59 of law No. 317-VI of 18 July 2003 on the regulatory acts of the Government and of other authorities of Central and local public administration, the Central Electoral Commission h a t â â t e r, and others: 1. Regulation on the citizens of the Republic of Moldova abroad dependent country, approved by the decision of the Central Election Commission no. 3375 of 27 July, 2010, shall be amended and completed as follows: 1) in paragraph 1, after the word "parliamentary" comma is inserted the word "presidential";
2) in point 7, the words ' for exit and entrance in the Republic of Moldova "is excluded;
3 point 7) insert a new point, 71, with the following content: "71. Citizens of the Republic of Moldova with voting that election day will find themselves abroad can register in advance, in accordance with the procedure laid down in the regulation on registration of prior approved by the CEC decision nr. 2547 of 21 may 2014. ";
4 paragraph 8): after the word "parliamentary" comma is inserted the word "presidential";
the text "(including permanent representations advising international bodies)" is excluded;
in section 5) 9, at the end of the second sentence after the words "Government" insert the comma following "based on prior registration of citizens in foreign countries and the number of voters who participated in previous elections";
6) in point 10: the word "established" shall be replaced by the word "established";
the words "other than those of diplomatic missions and consular offices," are mutually exclusive;
the words "will bring" shall be replaced by the words "make up";
After the phrase "available to the public shall be supplemented by the words ' by the Central Electoral Commission,";
7) in point 11: in the first sentence, after the words "electoral Council of Chisinau municipal electoral district" insert text "(hereinafter CECEM)";
After the second sentence insert a new sentence to read "the identification of premises shall take account of the conditions laid down in the instruction regarding securing the infrastructure of the polling, which was approved by the CEC decision nr. 2625 of 12 august 2014. ";
8 point 12), after the words "States concerned" insert prepoziția "about", and the text "on their web page" shall be replaced by the text "on their official web pages";
9) after paragraph 12 insert a new point, 121, with the following content: "121. Voting by citizens who have registered in advance will be informed voting bureaus opened in the country for which you have registered and the e-mail address indicated at the time of registration. ';
in point 13 10): after the words "of the electoral voting section from abroad ' shall be supplemented with the following text" operate in accordance with the provisions of the regulation with regard to the work of bureaus of polling stations, approved by the CEC nr. 2689 of 7 October 2014. ";

12) in point 14 ' for completing bureaus polling stations abroad "is excluded;
the words "are completed" shall be replaced by "cuvinteele" shall be added;
13) at the end point, after the words "in due time" there shall be added the words "and requests the bodies", and "accreditation" is substiuie by the word "host" at the end after the words "the voting section" insert the words "and its security."
14) point 16 is excluded;
15) in point 17, the words "24 hours prior to day of departure ' shall be replaced by the words" through the Ministry of Foreign Affairs and European integration.
16) point 18 shall exhibit in a new editorial board: "18. For voting bureaus established outside the country, voter lists shall be drawn up on the basis of data collected by diplomatic missions/consular posts operating in the territory of those States, as well as statements regarding the registration, in accordance with the regulation on the procedure for drawing up, administration, dissemination and updating of the voter approved by CEC nr. 2674 of 25 September 2014, and with the regulation on registration of prior approved by the CEC decision nr. 2547 of 21 may 2014. ";
17) points 19 and 20 shall be excluded;
18) in point 21, the word "request" shall be replaced by the word "proposes" and after the words "the number" insert text "to be printed";
19) point 22 is exposed in a new editorial board: "22. Voters who were not registered voters in the district, but the polling station on election day or by referendum, may be entered into an additional list, in accordance with the model set out in the regulation on the procedure for drawing up, administration, dissemination and updating of voter lists, the presentation of identity documents that allow participation in elections. "
20) section 23 is exposed in a new editorial board: "23. Voting at elections/referendum is secret. The Chairman of the electoral Board's voting section will ensure that the arrangement of polling place in accordance with the provisions of the instruction regarding securing the infrastructure of the polling, which was approved by the CEC decision nr. 2625 of 12 august 2014. ";
21) after paragraph 24, insert a new item, 241, as follows: "241. Voters who vote in polling stations set up bureaus outside the country will give a statement on oath that he refrains from voting on multiple and is informed about criminal liability in case of breach of this obligation, will sign for those declared in the relevant section of the electoral list form, approved by the regulation on the procedure for preparing, administering, and updating the electoral lists ";
22) point 25 is excluded;
23) Insert after point 27 a new point, 271, as follows: "271. The procedure for drawing up and submission of reports on the results of the counting of votes, as well as other election documents, shall be carried out in accordance with the regulation on activity of the bureaus of the polling stations and the instruction concerning the order of packing, sealing and transmitting documents and election materials to the polling precinct and district electoral councils to parliamentary elections , and a presidential referendum.
24) point 28 shall exhibit in a new editorial board: "28. The minutes drawn up by the electoral offices of polling stations abroad, accompanied by all the complaints lodged on the operations of the electoral voting, shall be sent to: CECEM Chișinău) by electronic means (including fax), no later than 24 hours after the closure of the polling. Accuracy of these reports is confirmed by phone, by fax or email, and in case of discrepancies and blemishes tested enough, these shall be corrected by CECEM Chisinau;
b), through the diplomatic mail, not later than 48 hours after the closing of the sections. Accuracy of these reports is confirmed by the signatures of the members of the bureaus, and in case of discrepancies and blemishes tested enough, these shall be corrected by the Chisinau CECEM, a fact confirmed by issuing a report, signed by all members CECEM. In the latter case, the transmission ensures CECEM Chisinau Central Electoral Commission of the minutes counting the votes received in diplomatic mail, and signed by all members of the corrected CECEM. "
25) point 29 is excluded;
26) points 30 and 31 are exposed in a new editorial board:

"30. Monitoring of elections/referendum at polling stations set up outside the Republic of Moldova is carried out by national and international observers accredited by the Central Electoral Commission.
31. The procedure of accreditation of observers, rights, obligations and responsibility of the accredited observers are stipulated in the Regulation relating to the status of observers and their accreditation procedure, approved by the decision of the Central Election Commission no. 332 of 24 October 2006.
27 32) is excluded;
28) in point 33, the words "media representatives" shall exclude the word "insured" shall be replaced by the word "permitted", and the phrase "with" shall be replaced by the phrase "together with".
2. this decision shall enter into force on the date of its adoption, shall be published on the official website of the Central Election Commission and the Official Gazette of the Republic of Moldova.
