On 29 March 2016, the Broadcasting Coordinating Council adopted Decision no. 9/44, which withdrew the right to broadcast advertisements for a period of 72 hours SC "TELEPROIECT" LLC, founder of TV station "Ren Moldova", for transmission of program services in violation of section 3.1. Lit. a) AC series of broadcasting license no. 000006 of 07/12/12 (breach of Art. 6 para. (1), Art. 7 para. (4) a), b), c), art. 10 para. (1), (2) and (5) of the Broadcasting Code and breach of Art. 1, art. 2, art. 4 art. 7 and 9 of the Code of Conduct for Broadcasters adopted by Decision No CCA. 127 of 26.12.2007), in accordance with art. 38 para. (2) b), f) and para. (3) c) of the Broadcasting Code.
On 23 May 2016, BCC address was received prior request SC "TELEPROIECT" SRL, which claims that disagrees with the sanction imposed and CCA seeks annulment of Decision no.
9/44 of 29 March 2016. In the preliminary application, the petitioner argues that "show" Военная тайна "concerned initiative, is part of the broadcasts telecanalului" Рен ТВ "of the Russian Federation and was only retransmitted SC "TELEPROIECT" SRL, without interfering with its contents and without participating in the publishing activity telecanalului ".
The petitioner further states that: "The content of the show, the author outlined his position on the socio-political situation in Moldova in how it is perceived by him, which fall in conceptions even self expression guaranteed national and international acts ... given the fact that the content data do not show any instigation to violence resulting from violence or incitement to hatred on grounds of race, religion, nationality, sex, lewd etc., that decision is one unfounded ". Having prior request
SC "TELEPROIECT" SRL, the Broadcasting Coordinating Council finds its groundlessness and neargumentarea request invoked. However, it is established that Decision. 9/44 of 29 March 2016 was adopted in strict compliance with the Broadcasting Code and grounds for revocation were not submitted.
As a result of repeated examination of the monitoring report by the Directorate monitoring the derogations TV were confirmed by SC "TELEPROIECT" SRL.
It is noted that the above-mentioned decision have not been proven competence and procedural violations by the CCA or not there are grounds for cancellation thereof.
As a result of public demand prior examination under the Broadcasting Code no. 260 of 27.07.2006, the Law no. 793 of 10.02.2000 and the Statute of CCA, approved by Resolution no. 433 dated 28.12.2006 of the Parliament of Moldova, the Broadcasting Coordinating Council

DECIDED:

1. A SC rejects appeal "TELEPROIECT" SRL on the annulment of Decision No. CCA. 9/44 of March 29, 2016 (PRO - (9) UNANIMOUSLY - D. hammer, Barbalić O. Iu. COLESNIC, A. COZMA, N. DAMASCHIN, O. Gututui C. bribery, M. ONCEANU-Hadirca and D . VICOL).
2. Control over execution of this Decision exercised Legal and regulations.
March. This Decision will be published in the Official Gazette of the Republic of Moldova and the BCC website.
