I. In the public meeting on March 10, 2016, in the context of public explanations on job neactivitatea television broadcasting satellite "A.Film" administrator "A. Video - Content "SRL, Irina Silver, said the station will be retransmitted since March 14, 2016, cable networks of" BAS-DIGITAL "SRL and" Cimişeni "LLC the same day, the administrator has registered letter f / No. of March 9, 2016 informing about this.
On 7 April 2016, the CCA employees conducted pursuant to art. 37 paragraph (3) a) of the Broadcasting Code, control of verifying the authenticity of what was said by administrator "A. Video - Content "SRL
Control has shown that cable networks of distributors the" BAS-DIGITAL "SRL and" Cimişeni "SRL is relayed station" A.Film ".
It is worth mentioning that the Decision 30/144 of 22 July 2015, the Broadcasting Coordinating Council imposed public warning "A. Video - Content "LLC, founder of the TV station with the satellite broadcasting" A.Film "for derogations from Article. 27 para. (1) e) of the Broadcasting Code and section 3.1. lit. a) AC series of broadcasting license no. 000009 from 13.06.2013 and the Decision no. 43/215 of 23 December 2015, the Audiovisual Coordinating Council imposed a fine of 1,800 lei "A. Video - Content "SRL, for the same violations.
II. At the public meeting of 10 March 2016, the Broadcasting Coordinating Council, by Decision no. 6/36, sanctioned SC "Status Marketing" LLC, founder of the TV channel "OTV" with a fine of 1,800 lei, for derogations from Article repeated. 27 para. (1) d) of the Broadcasting Code and section 3.1. lit. a) the broadcasting license Series AA no. 082 895 from 23.05.2012 in accordance with art. 38 para. (1) a) of the Broadcasting Code.
By pt. 4 of that decision, the station "OTV" was obliged to submit, within 15 days from the time of notification of the decision, a report on measures taken to eliminate the breaches certificates and confirmation of payment fine.
On 29 March 2016, the Broadcasting Coordinating Council, by registered letter no. 185, sent Decision. SC 6/36 of March 10, 2016 "Status Marketing" SRL
According to the notice of reception, the SC "Status Marketing" LLC, founder of the TV channel "OTV" received the letter from 04.01.2016.
SC "Status Marketing" Ltd. will present up to 16 April 2016 a report on measures taken to eliminate the breaches certificates and confirmation of payment of the fine.
On May 10, 2016 by letter no. 01/05 of 6 May 2016 SC "Status Marketing" SRL has informed the CCA about paying the fine and the fact that "... the company will temporarily cease the activity in this area over a period of six months by reason of technical difficulties."
It is noted that the SC "Status Marketing" LLC can not stop their work because it has not even begun, for which CCA applied more sanctions.
In the context of the above, art. 27 para. (1) e) and d) of the Broadcasting Code stipulates: "The Broadcasting Coordinating Council may withdraw the broadcasting license only if:
e) has ceased to broadcast the program service license which has been granted more than 45 days because of technical and more than 72 hours from any other cause; d) does not start broadcasting the program service of one year from the date of issue. "
Also para. (2) art. 27 states: "The Broadcasting Coordinating Council applied the broadcasting license in accordance with the procedure and manner prescribed by this Code and other legislative acts, only after exhausting other means of sanction under Article 38".

In accordance with Art. 27, 38-41 of the Broadcasting Code no. 260-XVI from 27.07.2006, the Statute of CCA art. 27 of the Regulation on the procedure and conditions for issuing broadcasting licenses and retransmission authorizations approved by Decision no. 433-XVI from 28.12.2006 the Parliament of Moldova, the provisions establishing compliance with legislation on audiovisual communication of 7 April 2016, the Broadcasting Coordinating Council DECIDED
:



1. Apply a fine of 5,400 lei company "A. Video - Content "LLC, founder of the TV station with the satellite broadcasting" A.Film "for repeated exemptions from art. 27 para. (1) e) of the Broadcasting Code and section 3.1. lit. a) AC series of broadcasting license no. 000009 from 06.13.2013 in accordance with art. 38 para. (1) a) of the Broadcasting Code (PRO - (9) UNANIMOUSLY - D. hammer, Barbalić O. Iu. COLESNIC, A. COZMA, N. DAMASCHIN, O. Gututui C. bribery, M. and D. ONCEANU-Hadirca VICOL ).
2. Apply a fine of 5,400 lei SC "Status Marketing" LLC, founder of the TV channel "OTV" for repeated exemptions from art. 27 para. (1) d) of the Broadcasting Code and section 3.1. lit. a) the broadcasting license Series AA no. 082 895 from 23.05.2012 in accordance with art. 38 para. (1) a) of the Broadcasting Code (PRO - (9) UNANIMOUSLY - D. hammer, O.BARBĂLATĂ, Iu.COLESNIC, A. COZMA, N. DAMASCHIN, O. Gututui C. bribery, M. and D. ONCEANU-Hadirca VICOL ).
3. Broadcasters sanctioned will submit, within 15 days from the time of notification of this decision, a report on measures taken to eliminate the breaches certificates and confirmation of payment of the fine. Bank details for the payment of fines
