Parliament adopts this organic law.
Art. I. - Law no. 451-XV of 30 July 2001 on regulating the licensing of entrepreneurial activity (republished in the Official Gazette of the Republic of Moldova, 2005, no. 26-28, art. 95), as amended, is amended and supplemented as follows:
1. Article 8 (1):
complement paragraph 391) as follows:
'391) renewable fuel production; "
paragraphs 40) and 41) will read as follows:
" 40 ) power generation; operation of the electricity market; transmission of electricity; centralized management of the power system; distribution of electricity; supply of electricity;
41) producing gas; transportation of gas; gas distribution; storage of natural gas; natural gas supply; supply compressed natural gas vehicle filling stations; ".
2. Article 20 is completed with paragraph (21) as follows:
"(21) The license shall be suspended in other cases expressly provided for by the laws governing the type of licensed activity."
March. Article 23 is completed with paragraph (8) as follows:
"(8) Licences for electricity transmission to supply electricity at regulated tariffs for supply of electricity at unregulated tariffs for natural gas supply at regulated tariffs, supply of natural gas at unregulated tariffs, issued before the entry into force of Law no. 107 of May 27, 2016 on electricity and Law no. 108 of May 27, 2016 on gas, be considered valid until their expiry. "

Art. III. - Offences Code of the Republic of Moldova no. 218-XVI of 24 October 2008 (Official Gazette of the Republic of Moldova, 2009, no. 3-6, art. 15), as amended, is amended and supplemented as follows:
1. Article 163 reads as follows:
"Article 163. Violation of Regulations on
protection of power grids
Violation requirements of Regulation on the protection of power grids, which led to the creation of a power failure, the disruption of normal operation of power grids, damage to power grids, the challenge of failures, fires, accidents, that result in endangering human life or damaging,
is fined from 50 to 100 conventional units for individuals and by a fine of 50 to 150 conventional units for responsible, a fine of 100 to 200 conventional units for legal entities. "
2. Code is supplemented by Article 1631 as follows:
"Article 1631. Failure to comply with regulations issued by
State Energy Inspectorate within
Failure by the owners and management of electrical installations, electrical networks prescriptions to exclude violations and infringements of normative-technical documentation for the development and operation of electrical systems, electrical networks, which may result causing damage, fires, explosions or endanger human life,
Is punishable by a fine of 25 to 50 conventional units for individuals and by a fine of 50 to 100 conventional units for responsible, a fine of 100 to 200 conventional units for legal entities. "
March. Article 169 reads as follows:
"Article 169. Violation of rules of conduct
activity by market participants
electricity, gas market
Natural and petroleum market
Violations by participants in the electricity market, the gas market and oil market rules of activities set out in the regulations in the field, evidenced by
a) refusal to allow checks, verifications and inspections ordered by the National Energy Regulatory Agency or hindering their performance;
B) failure within the data, the information required by the National Agency for Energy Regulation or providing incorrect or incomplete data and information;
C) undue delay in connection of electrical installations, installations of natural gas to end consumers of potential electricity networks, networks of gas or reconnecting electrical installations, installations of natural gas to end consumers of electricity networks, networks natural gas;
D) incorrect application of tariffs, regulated prices for electricity and natural gas or application fees for ancillary services rendered, which have not been approved by the National Agency for Energy Regulation;
E) the unjustified refusal of suppliers that fulfill public service obligations to conclude a contract for the supply of electricity, natural gas;
F) unjustified refusal of the transmission system or distribution system operators to conclude a contract for transmission services of electricity, natural gas distribution service contract for electricity, natural gas;
G) failure of the transmission system operators, distribution system operators by the regulatory normative acts on the extension of electricity networks, gas networks, approved by the National Agency for Energy Regulation;
H) failure of the transmission system operators, distribution system operators by the obligation announcement of final consumers about scheduled interruptions in the supply of electricity, natural gas in the terms and conditions set out in the Regulation on service quality transmission and distribution of electricity, the Regulation on the quality of transmission and distribution of natural gas;
I) failure of the distribution system operators the duty on metrological periodic measurement of household equipment;
J) an unjustified disconnection of electrical installations, installations of end consumers of natural gas from the mains, the mains gas or limiting unwarranted disconnection of electricity supply, natural gas to customers;
K) unjustified refusal of transmission system operators, distribution system operators on the issuing of connection to the electricity, natural gas network;
L) practicing without a license, without authorization of activities licensed, authorized under laws governing the electricity market, the gas market and oil market or delegated powers and functions licensed, authorized by a third party not licensed, authorized to conduct the type of activity concerned;
M) within the non-enforcement of measures ordered by decisions or decisions, the National Agency for Energy Regulation or failure in due time the instructions to eliminate violations found by the National Agency for Energy Regulation;
N) failure to comply with technical standards and operating electricity networks, gas networks, power plants, production facilities, natural gas and fuel storage facilities and fuel storage, which can result reducing the reliability and quality of delivered electricity, natural gas or fuel to consumers;
A) comply with other conditions set out in licenses and permits for activities in the energy market, natural gas or petroleum products
is punishable by a fine of 50 to 150 conventional units for individuals, a fine of 100 to 500 conventional units for responsible, a fine of 200 to 500 conventional units for legal entities. "
4. Article 411 (1), the words "art. 108, 161-169 "are replaced by" art. 108, 161, 162, 164-169 ".
May. Code is supplemented by Article 4111 as follows:
"Article 4111. State Energy Inspectorate
(1) The contraventions stipulated in art. 163 and in 1631 it appears the State Energy Inspectorate.
(2) shall be entitled to establish contraventions and to prepare documentation Head of State Energy Inspectorate, deputies, heads of territorial energy inspections, inspectors empowered with control functions.
(3) Documentation on contraventions shall be submitted for examination to a competent court. "
