In accordance with art. 18 paragraph (1) and position 22 of Annex 3 to the Law 235 of 1 December 2011 on accreditation and conformity assessment (Official Gazette of the Republic of Moldova, 2012, No. 46 -47, Article 136), the Government DECIDES:
1. Approving the Technical Regulation on cableway installations designed to carry persons (attached).
2. Ministry of Economy, within 6 months from the date of publication of this decision, will develop and approve the list of relevant standards and implementation plan Technical Regulation on lifts transporting people.
March. This decision shall enter into force 24 months after its publication in the Official Gazette of the Republic, except for points 46, 48, 50, 52 and 54 of the Technical Regulation on cableway installations to carry persons, which will come into force upon signature Agreement on conformity assessment and acceptance of industrial products between Moldova and the European Union.
4. Before signing the Agreement between Moldova and the European Union:
1) is allowed providing marketing and operation of cableway installations to carry persons whose safety component bearing the mark of conformity SM, and subsystems for their accompanied by the declaration of conformity, applied under the provisions stipulated in Law 235 of 1 December 2011 on accreditation and conformity assessment;
2) the manufacturer or his authorized representative, legal person established in the Republic of Moldova, affix the mark of conformity SM where cable installations and conformity assessment of safety components for home use shall be performed by assessment bodies compliance recognized using the procedures set out in Chapter III of the technical regulation on cableway installations to carry persons;
3) prohibits, under the terms of the Technical Regulation on cableway installations to carry persons, applying the same safety component mark of conformity and CE marking SM;
4) The Ministry of Economy recognize conformity assessment bodies carrying installations for home use in accordance with the procedures laid down in Chapter III of the Technical Regulation on cableway installations to carry persons;
5) requirements relating to conformity assessment bodies and notified bodies apply the conformity assessment recognized. To conduct conformity assessment procedures, conformity assessment bodies recognized conformity assessment performed cableway installations to carry persons will draw type examination certificates;
6) comprising the list of recognized conformity assessment bodies, the specific tasks for which they have been recognized and their identification numbers are published in the Official Gazette of the Republic of Moldova.
May. Obligations and liability of the manufacturer, his authorized representative, importer or distributor, legal persons located in the Republic of Moldova, on the lifts put into service mark of conformity SM correspond to those contained in this decision for the lifts with CE marking.
June. Control over the execution of this decision is the responsibility of the Ministry of Economy.
