on the creation of the Working Group in order to ensure, in the framework of the constitutional rules of the autonomous territorial unit Gagauzia functionality and the legal provisions of the Republic of Moldova in relation to the special status of Gagauzia



Published: 08.12.2015 in Official Gazette No. 330-331 art No.: 633 date of entry into force: 20.11.2015 considering the need for modernising the Moldovan legislation and taking into account the recommendations of the OSCE High Commissioner for national minorities of the Council of Europe, as well as the provisions of the European Charter of local self-government, the Parliament has adopted the following decision.
Art. 1.-pursuant to article. and article 32. 47 of regulation of the Parliament shall be formed on a permanent working group to ensure the mechanism of cooperation between the Parliament and the people's Assembly of Gagauzia.
Art. 2. The working group consists of representatives of the people's Assembly of Gagauzia and the factions within Parliament, in equal numbers. The composition of the representatives of the people's Assembly of Gagauzia and Moldovan Parliament is established by the President of the people's Assembly's disposal of Gagauzia and the disposal of the President of the Moldovan Parliament, the appointment of a village near Kisumu in the working group.
Art. 3.-for the purposes of achieving the objectives of its work, the group can exercise specialists within Parliament's secretariat (Directorate General legal services, legal Commission appointments and immunities, the Commission for economy, budget and finance), other specialists, upon necessity.
Art. 4.-the objectives of the working group are: 1) the imposition of a continuous dialogue between Moldovan Parliament and people's Assembly of Gagauzia in order to ensure, in the framework of constitutional rules, the functionality of the ATU Gagauzia and the legal provisions of the Republic of Moldova;
2 analysis of compliance of law) No. 344-XIII of 23 December 1994 on the special legal status of Gagauzia (Gagauz-Yeri) with the provisions of the Constitution of the Republic of Moldova and presentation of proposals relating to the necessary amendments that would exclude any contradictions;
3) elaboration of the action plan to ensure the functionality of the special status of Gagauzia and Moldovan legislation in accordance with the constitutional provisions and the law nr. 344-XIII of 23 December 1994 on the special legal status of Gagauzia (Gagauz-Yeri);
4 strengthening national legislation) in relation to the special status of Gagauzia and the delimitation of the competences of the central organs and autonomy through analysis of national legislation and of the autonomy and the formulation of draft amending and supplementing them;
5) recommendations for improving cooperation between the central authorities and Gagauzia in compliance with good practice;
6) creation of a permanent mechanism of consultations for the prevention and settlement of possible setbacks of the central authorities and the ATU.
Art. 5.-If necessary, the Working Group may request the support of the international partners of the Republic of Moldova, as well as non-governmental organisations, which shall manifest express willingness to provide observation, mediation and technical support, consultancy, training and expertise. In order to avoid contrapunerilor, international donors are encouraged to coordinate with working group activities and projects to be implemented in the Gagauz ATU.
Art. 6.-in order to make the work of the Working Group, members of the Committee shall approve the rules of procedure which shall lay down the manner of functioning of the working group. Internal rules will be approved within short terms, but not later than the last day of the meeting from the autumn session of the Parliament of the Republic of Moldova by 2015.
Art. 7.-Working Group will inform on a semi-annual basis by reference in writing by representatives of the Moldovan Parliament and the representatives of the people's Assembly of Gagauzia about the progress. 
Art. 8.-This decision shall enter into force on the date of its adoption.
