On 21 December 2015 the Moldovan Prosecutor General's letter no. 28-1d / 15-472 of 12.15.2015, to address CCA has received for review and comment the draft law amending and supplementing the Criminal Procedure Code of the Republic of Moldova no. 122-XV of 14 March 2003
The project is submitted for approval submitted in accordance with art. 21 of Law no. 780 of 27.12.2001 on legislative acts.
Examined project aims to protect the individual, society and state crimes. The purpose of the proposed amendments resulting from the need to streamline the process of documenting the many categories of crime, namely by empowering the institutions will get the status of organ failure, which will be obliged to submit documents to ascertain and as evidence in short terms the criminal investigation body suitable. Thus it will exclude transmission of material criminal investigative body after a long period of time after completion of checks, remittance acts of referral unfounded and formal, presented only in order to mimic an efficient activity or to place on account of organs legal responsibility for taking decisions on cases that clearly do not fall under criminal law.
After reviewing the nominated project, given the public debate, pursuant to Art. No 39-41 of the Broadcasting Code. 260 of 27.07.2006, the Statute CCA, approved by Decision no. 433 dated 28.12.2006 of the Parliament of Moldova, the Broadcasting Coordinating Council
DECIDED:
1. To approve and present Moldovan Prosecutor General Opinion on the Draft Law amending and supplementing the Criminal Procedure Code of the Republic of Moldova no. 122-XV of 14 March 2003 (PRO - (8) UNANIMOUSLY - D. hammer, Iu. COLESNIC, A. COZMA, N. DAMASCHIN, O. Gututui C. bribery, VICOL D., M. ONCEANU-Hadirca).
2. Control over execution of this Decision exercised Legal and regulations.
