Secretary of Telenesti transmitted CEC demands resignation of councilors Ioxa Eugenia selected list Liberal Democratic Party of Moldova, Cazacu Andrian elected on the list of Democratic Party, Loreti Anton elected Liberal Party list and the required documents awarding mandates councilor candidates alternates.
Same time, by application, registered at the Central Electoral Commission no. CEC 7/14398 2 December 2015 Orhei Territorial Office of the State Chancellery informed the Commission about the incompatibility of the Diana Manoli councilors elected on the list of the Liberal Democratic Party, and Gori Stefan Vasile Harghel elected Democratic Party ticket. The notification is accompanied by documents showing that Mrs. Manoli Diana, dated 27 June 2015, holding the office of President of Telenesti district, Mr. Harghel Vasile, 27 June 2015, was elected vice president of Telenesti district, and Mr. Stephen Gori, from January 2, 2008, shall act as deputy director of PMSI Teleneşti district Hospital.
Examined the documents submitted reveals the incompatibility provided for in art. 7 paragraph. (1) a) and d) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected, which states that the mandate of locally elected is inconsistent quality of person with a dignitary and as head, deputy head (including the interim these functions) subordinate structures of local public authorities ( public institutions, services, municipal enterprises).
Thus, in accordance with art. 8 paragraph. (1) of the act, a local representative who is in one of the cases of incompatibility will resign as incompatible with the office held or will file its mandate within 30 days of the occurrence of incompatibility.
Given that Ms Diana and Mr Harghel Vasile Manoli and Stephen Gori have resigned from one of the incompatible functions within the deadline, the Central Election Commission decides lifting mandates under Article adviser. 8 paragraph. (21) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected at the request of interested persons.
According to the documents it holds elections the Central Election Commission mandates advisor in their respective Teleneşti District Council deputy candidates Barscov Rodica Anton Octavian and the Liberal Democratic Party ticket, Eşanu Tudor Rosca Ion Popa Adela and the list Cuculescu Democratic Party and Liberal Party Iurie on the list. Lists of deputy candidates were confirmed by the Court's judgment of 23 June 2015. Teleneşti of mandates to take into account statements Badan Nicholas and alternate candidates on the list Chicu Nelea Liberal Democratic Party of Moldova and Angela Sirbu, Manoli Ludmila, Ţurcanu Tudor, Pasat Anatolie and Vasile Ozun on the list of Democratic Party, which they refuse adviser of mandates.
Pursuant to art. 18 para. (2), paragraph 22. (1) u) and 133 para. (12) of the Electoral Code 1381-XIII of 21 November 1997 art. 5 paragraph. (2) f), par. (3) and. (31) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected and in accordance with pt. 21, 23, 24, 25 and 29 of the Regulation on the procedure of removing and validation of councilors' mandates approved by CEC Decision no. 1931 of 23 April 2013, the Central Election Commission decides:
1. Amounts in connection with the incompatibility of functions, mandates Manoli Diana councilors elected on the list of the Liberal Democratic Party, and Gori Stefan Vasile Harghel elected Democratic Party ticket in Teleneşti District Council.
2. Amounts in connection with the resignation, mandates Eugenia Ioxa councilors elected on the list of the Liberal Democratic Party, Adrian Cazacu elected on the list of Democratic Party and Anthony Loreti elected Liberal Party list in Teleneşti District Council.
March. It assigns mandates adviser Teleneşti District Council deputy candidates Barscov Rodica Anton Octavian and the Liberal Democratic Party ticket, Eşanu Tudor Rosca Ion Popa Adela and the list Cuculescu Democratic Party and Liberal Party Iurie on the list.
4. It preavizează advisers Anton Octavian, Barscov Rodica, Eşanu Tudor, Cuculescu Iurie Rosca Ion Popa Adela and the obligation to comply with the deadline of 30 days to remove the incompatibility if it develops.
May. This decision shall enter into force upon adoption, will be published on the official website of the Central Election Commission and in the Official Gazette of the Republic of Moldova.
