On 22 October 2015, the Broadcasting Coordinating Council adopted Decision no. 36/179, which imposed a fine of 5,400 lei SC "Tele- Crio" LLC, founder of cable TV studio "Cryo TV" in the town. Criuleni, according to art. 38 para. (2) e), para. (3) b) of the Broadcasting Code, the exemption repeated in art. 28 para. (1) of the Broadcasting Code, art. 36 para. (2) of the Regulation on the procedure and conditions for issuing broadcasting licenses and retransmission authorizations and non pts. 1.4, 2.2, 3.1 lit. (B) the conditions to permit relay series AB no. 000 205 of 07.03.2015 issued "Tele-Crio" SRL. Namely:
- offer services programs were not approved retransmitted 11 TV stations: TVR Moldova, Cheers TV, TV Basil, Gurinel TV, Other TV, Euro TV, TV 5 Monde, Русский бестселлер, MBC, Viasat Nature and Viasat History;
- Outside offer 30 TV channels were relayed: Союз, ТВ Центр International, RBK, A-One, Mир 24, Ethno TV, Трофей 1 Music Channel, Nickelodeon, 1 + 1 International, EEZ TV, CTC Mega , ТВ 3 National 24 Plus, National TV, Пятница, Россия 2 NGC, Euronews, Eurosport, Сарафан, Kanal D, Звезда, Моя планета, Наука 2.0 Favorit TV, MTV, НТВ (Ru), ТРО and reality TV Moldova .
On 21 December 2015 the CCA received the appeal SC "Tele-Crio" SRL, declaring that disagrees with the sanction imposed.
In the appeal, the petitioner argues that: "It is not the fault of the company as most TV stations (Cheers TV, Other TV, Euro TV, Moldova TVR, TV5 Monde,) can not be received in DVB-T2 format of the month June 2015 ; Owners of television stations basil TV, Gurinel TV, MBC TV Cheers, Alt TV and Euro TV all promise that soon will procure all necessary equipment for cable operators; Viasat channels: Nature, History, 1000 RU-network; Русский бестсейлер company had no contract and is not in the network; RBK, Mir 24, CTC-Mega, National TV, National 24, Favorit TV, Realitatea TV, Moldova 1, Sarafan, Moya Planeta, bewildered 2.0, A-One, SC "Tele-Crio" SRL has contracts with these channels; Belarusian TV channel ONT replaced; Trofey, EEZ TV, Rossy 2 are not networked; Kanal D, Zvezda, NGC, Euronews, Eurosport negotiations lasts. "
The petitioner claims that" asked that the matter be postponed to the next meeting of the CCA. "
Examine the appeal SC "Tele-Crio" SRL, the Broadcasting Coordinating Council finds its groundlessness and neargumentarea request invoked. Thus, it is established that the contested decision was adopted in strict compliance with the Broadcasting Code and the grounds for revocation were not submitted.
Following the public examination of the complaint under the Broadcasting Code no. 260 of 27.07.2006, the Law no. 793 of 10.02.2000 and CCA Statute, approved by Decision no. 433 dated 28.12.2006 of the Parliament of Moldova, the Coordinating Council of Audiovisual DECIDED
:

1. He rejects as unfounded the appeal SC "Tele-Crio" SRL CCA No decision should be annulled. 36/179 of 22 October 2015 (the PRO - (7) UNANIMOUSLY - D. hammer, Iu. COLESNIC, A. COZMA, O. Gututui C. bribery, M. and D. ONCEANU-Hadirca VICOL).
2. Control over execution of this Decision exercised Legal and regulations.
March. This Decision will be published in the Official Gazette of the Republic of Moldova and the BCC website.
