Under Act No. 150 of 29 June 2012 on the declaration of public utility of national interest for rehabilitation and expansion of national roads (Official Gazette of the Republic of Moldova, 2012, no. 149-154, art. 492), art. 8, 71 and 83 of the Land Code nr.828-XII of December 25, 1991 (republished in the Official Gazette of the Republic of Moldova, 2001, no.107, Art. 817), as amended and supplemented, art. 12 para. (4) of Law No. 1308-XIII of 25 July 1997 on the normative price and sale and purchase of land (republished in the Official Gazette of the Republic, 2001 nr.147-149, art.1161), as amended and subsequently, the Government DECIDES:
1. Amend category of destination of agricultural land, public property, managed by the Ministry of Transport and Roads Infrastructure (manager - State enterprise "State Administration of Roads"), passed in the category of land for industry, transport, telecommunications and other special purpose in order roads rehabilitation and expansion of M3 and R1, as annexes. 1 and no. 2.
2. Ministry of Transport and Roads Infrastructure (State enterprise "State Administration of Roads"), which will use the land for construction will get under the conditions provided by applicable law prior to initiating construction work, building permit, the positive opinion of State Ecological expertise in project execution and will hold soil scraping topsoil from such areas.
March. Land Relations and Cadastre Agency will make the change cadastral documentation at the request of the right holder in accordance with the provisions of this decision.
