Secretary of Pojăreni village, Ialoveni, the Central Election Commission submitted the resignation of councilor Ludmila Chicerman chosen the Liberal Democratic Party ticket and documents necessary mandate advisor award next alternate candidate. The set of documents submitted and the decision contains no. 06/08 of 7 December 2015 Pojăreni Village Council.
When examining the documents submitted were found to decision no. 06/08 of 7 December 2015 the Council adopted village was overrun Pojăreni material competence. Thus, contrary to the provisions of art. 5 paragraph. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected council raised under the mandate of Chicerman Ludmila resignation request submitted by this, but this lies in the competence of the Central Election Commission. In order to comply with current legal framework and considering that the local council's decision as an act beyond the powers given is invalid, the Commission recommends to the Council to repeal the village Pojăreni decision no.
06/08 of 7 December 2015. Based electoral documents that it holds the Central Election Commission, a council mandate rests in Pojăreni Village Council Svetlana Stratan alternate candidate on the list of the Liberal Democratic Party, confirmed by the decision further Ialoveni Court of 12 august 2015. the mandate award took into account the statement of the candidate substitute Anatolie Căldare on the same party list, which it refuses award councilor mandate.
Pursuant to art. 18 para. (2) art. 22 para. (1) u), art. 133 par. (12) of the Election Code no. 1381-XIII of 21 November 1997 art. 5 paragraph. (2) f) and para. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected and in accordance with pt. ​​23, 25 and 29 of the Regulation on the procedure of removing and validation of councilors' mandates approved by CEC Decision no. 1931 of 23 April 2013, the Central Election Commission decides:
1. Amounts in connection with the resignation, Ludmila Chicerman mandate of the elected Liberal Democratic Party ticket in Pojăreni Village Council.
2. It assigns council mandate in Pojăreni Village Council, Ialoveni, Svetlana Stratan alternate candidate of the Liberal Democratic Party ticket.
March. Svetlana Stratan is preavizează adviser on the obligation to meet the deadline of 30 days to remove the incompatibility if it develops.
4. Village Council is recommended to repeal Pojăreni decision no. 06/08 of 7 December 2015.
May. This decision shall enter into force upon adoption, will be published on the official website of the Central Election Commission and in the Official Gazette of the Republic of Moldova.
