Village Council Horodişte, Riscani, decision no. 11/13 of 10 December 2015 raised about absence without valid reason from three consecutive meetings of the Council, the mandate of the elected list Gorodişcean Vasile Democratic Party. It became vacant mandate assigned counselor party nominees.
Same time, the Central Election Commission has received the resignation of councilor elected on the list Scutelnic Agulceana Liberal Party and documents necessary mandate advisor award next alternate candidate. The set of documents submitted and the decision contains no. 05/03 of 13 July 2015 on waivers before the term of the mandate of Scutelnic Agulceana.
When examining the documents submitted were found to decision no. 05/03 of 13 July 2015 Horodişte Village Council, was adopted by overcoming the material competence. Thus, contrary to the provisions of art. 5 paragraph. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected council raised Scutelnic Agulceana under the mandate of the resignation request submitted by this, but this lies in the competence of the Central Election Commission. In order to comply with current legal framework and considering that the local council's decision as an act beyond the powers given is invalid, the Commission recommends to the Council to repeal the village Horodişte decision no. 05/03 of 13 July 2015.
Based electoral documents that it holds the Central Election Commission mandates advisor in their respective Village Council Horodişte Anton Lilia alternate candidates on the list of Democratic Party and the Party list Basil Scutelnic Liberal. Lists of deputy candidates were confirmed by the Court's judgment of 29 June 2015. Rīşcani of mandates to take into account statements Anton Elena alternate candidates on the list of Democratic Party and Vladimir Balan on the Liberal Party list, which they refuse to award mandates adviser.
Pursuant to art. 18 para. (2) art. 22 para. (1) u), art. 133 par. (12) of the Election Code no. 1381-XIII of 21 November 1997 art. 5 paragraph. (2) f) and para. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected and in accordance with section. With pt. ​​18 lit. c), 23, 25 and 29 of the Regulation on the procedure of removing and validation of councilors' mandates approved by CEC Decision no. 1931 of 23 April 2013, the Central Election Commission decides:
1. It notes the holidays a warrant for Horodişte village councils.
2. Amounts in connection with the resignation, the mandate of the elected list Scutelnic Agulceana Liberal Party Horodişte Village Council.
March. It assigns mandates Horodişte village councils, Riscani, Anton Lilia alternate candidates on the list Scutelnic Democratic Party and the Liberal Party list Basil.
4. It preavizează councilors Basil Anton Lilia Scutelnic the obligation to comply with the deadline of 30 days to remove the incompatibility if it develops.

. This decision shall enter into force upon adoption, will be published on the official website of the Central Election Commission and in the Official Gazette of the Republic of Moldova.
