The Secretary of the Council of Cetireni village, Ungheni, informed the Central Election Commission about the death of Alderman Leo Capria elected on the list of the Liberal Democratic Party of Moldova and conveyed the Declaration of consimțămînt the following alternate candidate.
On the basis of electoral documents in its possession, Central Electoral Commission, the mandate of village Council Cetireni the responsibility of the candidate on Kay V. the alternate list of the Liberal Democratic Party of Moldova, confirmed by the decision of the Court on 23 June 2015 and Ungheni.
At the same time, the Central Electoral Commission finds that the death certificate was issued on 16 January 2017, and necessary documents of the applicant's counsel's mandate is issued alternate received by the Commission on 21 March 2017, which denotes the failure by Council Secretary of Cetireni village established in paragraph 20 of the Regulation in respect of the seizure and the validation of mandates of Councillor approved by the decision of the Central Election Commission no. 1931 of 23 April 2013.
Pursuant to article 1. 18 paragraph 1. (2), art. 22 lit. v), art. 133 paragraph 2. (12) of the electoral code no. 1381-XIII of November 21, 1997, art. 5 para. (2) (a). g) and paragraph 3. (3) of law No. 768-XIV of 2 February 2000 on the status of local public servant, art. 24 para. (3) of law No. 436-XVI dated December 28, 2006 on local public administration, and in accordance with paragraphs 20 and item 29 of the Regulation in respect of the seizure and the validation of mandates of Councillor, approved by the decision of the Central Election Commission no. 1931 of 23 April 2013, the Central Electoral Commission h a t â r and t e: 1. It is hereby declared vacant a village Council Cetireni.
2. the mandate assigned to it by the Council Cetireni village, Ungheni, Alternate candidate on Kay V. list of Liberal Democratic Party of Moldova.
3. Attila V. preavizează Adviser on the obligation to respect the time limit of 30 days to remove the incompatibility condition in the event of its occurrence.
4. reminds the Council Secretary Cetireni village on the need to respect the time limit set in point 20 of the Regulation in respect of the seizure and the validation of mandates of Councillor, approved by the decision of the Central Election Commission no. 1931 of 23 April 2013.
5. this decision shall enter into force on the date of its adoption, shall be published on the official website of the Central Election Commission and the Official Gazette of the Republic of Moldova.
