The Government DECIDES: Government decision No. 948 from august 7, 2008 "approving the regulation on procedure for repatriation of children and adults-victims of trafficking in human beings, smuggling of migrants, as well as unaccompanied children" (Official Gazette of the Republic of Moldova, 2008, no. 152-153, 949), with subsequent amendments and additions, is modified and completed as follows: 1) in the title and in the text of the decision as well as in the title the words "smuggling of migrants" shall be replaced with the words "persons in case of difficulty";
2) in regulation: a) throughout the text, the words "Ministry of informational development" at any grammar, replace the words "Ministry of information technology and Communications", the corresponding shape grammar;
b) Nos 1 and 19, the words "victims of the smuggling of migrants", in whatever form, shall be substituted with the grammatical words "persons in situation of difficulty", corresponding to grammatical form;
c) in point 2, the term "victim of smuggling of migrants" shall be replaced with the term "a person in the situation of difficulty" with the following contents: ' a person in case of difficulty-person aged over 18 years, and identified with the status confirmed by social welfare bodies, who is unable to return to his home (in the country of origin) because of the State of vulnerability in which is located the person in the territory of another State caused by the aggregation of the following circumstances: serious health problems, lack of financial resources, lack of or loss of documents which cannot be restored by that person in an independent manner, and lack of support from family members; ";
(d) in point 4) the words "Ministry of education and Youth" shall be replaced with the words "Ministry of education";
e) points 17 and 18 shall read as follows: ' 17. The transport expenses of the returnee (victims of trafficking in human beings (adults and children), as well as children victims of trafficking in human beings), unaccompanied children and their companions will be charged in accordance with the provisions of this regulation.
18. in the case of the person in difficulty, costs for ensuring the procedure for repatriation will be handled in accordance with the international treaties to which Moldova is a party. In case of lack of such treaties, these expenses will be covered by the Ministry of labour, social protection and family;
f) shall be completed properly, with 501 points, 581, 582 and 601 with the following content: "501. In the case of identification of persons in situation of difficulty in the territory of a foreign State, Ministry of labour, social protection and family will require institutions (social and/or medical) in that State, who identified the person, information about its situation and the need for repatriation. ";" 581. to achieve repatriation procedures for persons specified in item 2 of this regulation, the Ministry of labour, social protection and family will pay subsistence for the passenger/companions within the specialized institutions subordinated to the Ministry of health, Ministry of Internal Affairs and the Ministry of labour, social protection and family. Subsistence expenses will be financed from funds of the State budget to the budget of the Ministry of labour, social protection and family.
582. The funding at the expense of the State budget to the Ministry of labour, social protection and family for carrying out the procedures for repatriation of adults with any designated assistance will be covered and the actual expenditure for feeding persons referred to in item 2 of this Regulation and, where appropriate, the purchase of clothing, footwear and medicines. " 601. The monitoring of the process of social inclusion, family and professional adult persons repatriated, as specified in item 2 of this Regulation, shall be carried out within the framework of the National System for the protection and assistance of victims and potential victims of trafficking in human beings by the multidisciplinary team of the territorial place of residence of the recipient for a period of two years. If that cannot be determined, the place of residence, the monitoring will be carried out by the multidisciplinary team of the locality where the social inclusion of the beneficiary. Multidisciplinary team responsible for territorial, at the request of the National Coordination Unit within the National System of reference, will inform you in writing about the inclusion of returnee progress. "
