Published: 31.03.2017 in Official Gazette No. 92-102 art No.: 670 on 13 February 2017, by letter from the Ministry of information technologies and communications of the Republic of Moldova nr. 01/167 of 10 February 2017, media watchdog CCA came for examination and approving the draft law on completion of article 4. 27 of the Moldovan broadcasting Code No. 260-XVI of 27 July 2006.
The project submitted was developed in order to eliminate the shortcomings that have been identified in the process of implementing it.
Article 27, subparagraph (c). (d)) of the Broadcasting Code stipulates the withdrawal of licence if the holder does not begin broadcasting broadcasting service of not more than one year from the date of issue of the licence. Thus, this term is one reasonable where the broadcaster shall build a station/electronic communications network and Studio where he produces programs for broadcast service.
If the broadcaster has the Studio that produces the service programs, the time for the start of emission would be up to 3 months. This term is made available to the broadcaster to negotiate the terms of the contract with the supplier of the network and ensure the transport of the signal for broadcast. That loophole in the law allows the broadcaster to delay the start of the broadcast for one year from the date of issue of the licence.
This situation hampers the implementation of digital terrestrial television. Thus, 15 broadcasters-emission licence holders only have concluded contracts with the supplier of the multiplex. Therefore, delaying the start of the broadcast service programs bring not only material damage, but also hinder the possibility of broadcasters who have not obtained a licence to broadcast transmitting its programs through the multiplex.
This Bill will permit avoid delays the start of the broadcast service programs through an electronic communications network used in the contract, by specifying and some reasonable time for this purpose, and for the other broadcasters being kept the term of one year. As a result of the examination project nominated, given public debate, pursuant to the provisions of art. 39-41 audiovisual code no. from 260 of BCC is supervised, approved by Decision No. 433 from 28.12.2006 the Moldovan audiovisual Coordinating Council DECIDES: 1. To approve and submit to the Ministry of information technologies and communications of the Republic of Moldova to the opinion on the draft law on completion of article 4. 27 of the Moldovan broadcasting Code No. 260-XVI dated July 27, 2006 (PRO-(6)-HAMMER, o. BARBALATA, Iu. CARLSON, b. DAMASCUS, c. d., and DUCA VALENTINO; CONS-(2)-o. GUȚUȚUI and m. OBI-HADIRCA).
