JOSE LOPEZ PORTILLO. Constitutional President of the United Mexican States in the exercise of the power conferred on me by Article 89 (I) of the Political Constitution of the United Mexican States and based on Articles 38 of the Organic Law of the United States of Mexico. Federal Public Administration 14, 52, 53, 54, 55 and 56 of the Federal Education Act, I have had the following to issue the following:
Object and Attributions
ARTICLE 1o.-This Regulation shall govern the organisation and operation of the associations of parents who are established in the Pre-school, primary and secondary schools, dependent on the Secretariat of Public Education and in schools of these types that the Secretariat itself authorizes, recognizes or registers, in accordance with the Federal Education Act.
ARTICLE 2o.-Associations of parents must be constituted and registered in accordance with the Federal Law of Education and this rules.
ARTICLE 3o.-Parents, guardians and those who exercise parental authority shall have the right to be part of the associations which refers to this order.
ARTICLE 4.-The object of the parents ' associations will be:
I.-To present to the school authorities the interests that are common to the partners in educational matters;
II.-Collaborate on the improvement of the school community and propose to the authorities the measures they estimate to be conducive;
III.-Participate in the application of the cooperation in numerary, goods and services that the associations do to the school establishment, and
IV.-Contribute to the adult education of its members, in the terms of the national law of the matter.
ARTICLE 5o.-Family parent associations shall be referred to as follows:
I.-Associations of parents of schools;
II.-State associations of parents or the Federal District, and
III.-National Association of Parents.
Regional associations of parents may be established when the Secretariat of Public Education so establishes and points out the respective territorial constituencies.
ARTICLE 6o.-For the fulfilment of their object the associations of parents will have the following attributions:
I.-Collaborate with the authorities and educational institutions in the activities they perform;
II.-Propose and promote, in coordination with school principals and, where appropriate, with school and educational authorities, actions and works necessary for the improvement of school establishments and their operation;
III.-Reunite funds with voluntary contributions from their members for the own purposes of the partnerships;
IV.-To foster the relationship between teachers, students and parents themselves, for better use of the learners and the compliance with educational plans and programmes;
V.-Promote the establishment of adult education promotion and counseling centers and services;
VI.-Promote the realization of training activities for the work;
VII.-Collaborate in the implementation of adult education programs that improve the family and social life of its members and their situation in the employment, income and production;
VIII.-To participate in the promotion of school savings school cooperatives, school plots and other auxiliary systems of the education where appropriate, in accordance with applicable laws;
IX.-Provide the Secretariat of Public Education with the information it requests for the purposes of this Regulation, and
X.-Cooperate in the health promotion programs and participate in coordination with the competent authorities in the actions that these To improve the physical and mental health of learners, the detection and forecasting of learning problems and the improvement of the environment.
The privileges that precede will be exercised in a coordinated manner with school principals or with school and educational authorities competent and shall require their express agreement for any activity which is understood as one of the exclusive functions and responsibilities which the authorities are responsible for.
ARTICLE 7o.-For the fulfillment of its object in the terms provided for in this regulation:
(a) Represent the parents, guardians and the parents of the family members of the parents:
b) They will deal with their problems, proposal of solutions and offers of collaboration with the respective directors of the school supervisors and schools with the state associations to which they belong;
II.-State and Federal District associations:
a) Represent the parent associations of each federative entity;
(b) Develop their respective work and cooperation programmes and address their problems and the solutions they offer with the delegations General of the Secretariat of Public Education and, in the Federal District, with the competent Directorates-General of the Secretariat itself;
III.-The National Association of Parents:
a) It will represent the state associations and the Federal District;
b) Raise and implement their cooperation plans for the general benefit of schools, pupils and associations, and
c) Develop its work programs and address the issues of state and Federal District associations, and those that agree the national association itself, with the higher authorities of the Ministry of Public Education.
ARTICLE 8o.-The associations that antecedent will establish and approve their statutes, those that will strictly observe the dispositions of this a regulation for its organisation and operation and in all matters relating to its relationship with the education authorities.
ARTICLE 9o.-In each preschool, primary and secondary education establishment, dependent on the Ministry of Public Education and the These rates, which the Secretariat itself authorizes, recognizes or registers, in accordance with the law, shall be an association made up of parents, guardians or those who exercise parental authority.
ARTICLE 10.-In the premises where there are two or more schools mentioned in the previous article, an association of parents of family for each educational institution. If they have more shifts, a partnership will be set up for each shift.
ARTICLE 11.-The principals of the pre-school, primary and secondary schools shall convene the persons referred to in the article 9o. of this regulation, within the first 15 days following the initiation of each school cycle, so that, gathered in assembly, they constitute the association of parents of the schools and choose their board of directors, in the terms that they are established, the corresponding minutes being raised, with the formality referred to in Article 49.
Assemblies to be held to elect the boards of directors, will appoint a provisional discussion table composed of a president, a secretary, and three tellers. Those who obtain a majority of votes shall be declared elected.
ARTICLE 12.-The relevant educational authorities of the Secretariat of Public Education will agree on what is necessary for the the integration of regional, and, where appropriate, state, Federal District and national association associations referred to in Article 5o. prior to the election of their boards of directors, in the terms of this regulation.
ARTICLE 13.-To constitute state associations of parents, the following rules shall be observed:
I-A 30-member and 30-member council of 30 members will be integrated into each state: 25 of them by means of an insaculation of all the presidents of the associations of the schools referred to in Article 1. of this Regulation and, the remaining 5, by the presidents of the associations of schools in urban and rural areas whose educational importance has improved their incorporation;
II.-the councils will elect to the boards of the state associations of parents, according to the forecasts of this rules;
III.-The members of the councils will last for two years, and
IV.-The alternate members shall replace the owning members in their final or temporary absences.
ARTICLE 14.-To integrate the association of parents of the Federal District, the rules that set the preceding article will apply.
ARTICLE 15.-The National Association of Parents will be constituted with the presidents of the state associations of parents and the of the Federal District Association, which shall form the advice of the national association itself and its board of directors shall be chosen in the terms of the call to be issued in accordance with Article 12 above.
ARTICLE 16.-The domicile of the associations of the schools shall be the same of the school establishments in which they are constituted.
State associations, that of the Federal District and the national association referred to in this Regulation, shall have their addresses in the the respective capitals of the States and the Federal District, in the premises they occupy or in which they decide to make available to them the Secretariat of Public Education.
ARTICLE 17.-The associations of parents mentioned in Article 5o. of this order, they shall agree on a statutory basis or through special agreements, the financing for their operation.
The Secretariat of Public Education may consider specific programmes to be presented by the associations, within the legal framework corresponds, to eventually grant your financial support.
Rights and Obligations of the Associates
ARTICLE 18.-They are rights and obligations of members of parents ' associations;
I.-To request the intervention of the association for the approach, before the competent school authorities, of problems related to the education of their children, pupils or represented;
II.-Exercise voting in assemblies;
III.-Be elected to be part of the boards and councils of the associations referred to in this Regulation;
IV.-Cooperate for the best functioning of partnerships;
V.-Participate in adult education activities to be undertaken by the associations;
VI.-To collaborate, at the request of the school authorities, in the cultural and social activities carried out in the plant:
VII.-To perform the commissions that are conferred on them in the assemblies;
VIII.-To participate, according to the educators, in the treatment of the problems of conduct and learning of their children, represented, and
IX.-To comply with those who in exercise of the homeland power or guardianship, they point to them the legal provisions.
ARTICLE 19.-The members may be suspended in their rights when the assembly of parents, for serious infractions to the (a) this Regulation and the statutes of the associations, after having been heard in accordance with the law, which they have to rely on in their defence and, at the same time, may be restored to their rights by agreement of the assemblies themselves.
Likewise, their rights to parents will be suspended when they cease to exercise their homeland of protest through judicial resolution.
ARTICLE 20.-They are governing bodies of parents ' associations.
I.-Assemblies of the associations of each school;
II.-The councils of the state associations and the Federal District, which are their own assemblies;
III.-The advice of the National Association of Parents, which is their assembly, and
IV.-The boards of the associations.
ARTICLE 21.-The quorum of the assemblies, councils and boards of directors shall be integrated with the majority of its members.
ARTICLE 22.-Parents and parents, guardians, and those who exercise parental authority, will each have one vote in the assemblies of the associations of schools.
ARTICLE 23.-The agreements of the governing bodies of the associations of parents will be taken by a majority of votes. In case of a tie the president shall have a vote of quality.
ARTICLE 24.-The assemblies of the associations of parents of the schools, as well as the councils of the state associations and the Federal District referred to in this order, will meet to know the following matters:
I.-Choose the members of the tables that represent them, in the form that this chapter prescribes;
II.-Know the affairs of your object;
III.-Agreed and propose voluntary contributions in numerary, goods and services of associates;
IV.-Study, propose and manage the implementation of adult education programs;
V.-Develop and approve their statutes and specifications to them;
VI.-Punish the reports of the representatives of the associations, if any;
VII.-Appoint the members of the committee of sponsors and those of the advisory board, in accordance with Article 40 of this regulation;
VIII.-Decide on suspending and resetting the rights of associates, and
IX.-Solve other matters which according to the object of the associations of parents, are subject to their consideration the associates
ARTICLE 25.-Assemblies shall be held in extraordinary form twice a year, at least, and extraordinary when requested from the Board of directors, in writing, at least one quarter of its members.
ARTICLE 26.-The councils of the state associations and the association of the Federal District, will hold two regular annual sessions (a) at least and extraordinary when the President or the President so requests, in writing, 10 of its members.
ARTICLE 27.-The advice of the National Association of Parents, will know of the following matters:
I.-The Board of Directors of the Board shall be elected in accordance with the call issued in accordance with the terms of Article 12 of this Regulation;
II.-Approve its status and modifications;
III.-shall examine and approve its work programme and the activities it deems necessary within its object;
IV.-It will sanitize reports from the board;
V.-Resolve the issues that put the boards of state associations and the Federal District, which are raised, to their consideration. in compliance with its object;
VI.-You will know the conflicts that arise in the integration of the state associations, in that of the Federal District and in the election of their tables;
VII.-Elect the members of the advisory board and the committee of sponsors of the national association, and
VIII.-Those who submit to the council members themselves, within the legal margin of this regulation.
ARTICLE 28.-The council of the national association shall hold two ordinary annual sessions, at least, and extraordinary, when the president or request it in writing, at least 10 of its members.
Sessions shall be held at the official address of the national association or in which its members determine to meet in other entities federative.
ARTICLE 29.-The tables will be integrated into the following form:
I.-In the parents ' associations of schools with a president, a vice president, a secretary, a treasurer and six vowels;
II.-In the state associations of parents and in the Federal District, with a president, a vice president, a secretary general, a treasurer and eight vowels: two for preschool education, two more for primary education, equal numbers for secondary education, and the remaining two: one for advisory councils and one for the sponsor committees to which the Article 40 of this Regulation, and
III.-In the National Association of Parents, with a president, a vice president, a secretary general, a treasurer and ten vowels: six for pre-school, primary and secondary education, at the rate of two per educational level; two for advisory councils and two more for the sponsor committees which refer to the previous fraction
ARTICLE 30.-The tables that precede will be chosen for two years and will be renewed annually half of its members, with the exception of the tables Preschool education school directives, which will last for a year.
The applications of the persons holding posts on the boards of the associations referred to in Article 5o shall not be admissible. of this Regulation, for a new period, with equal representation.
The president and treasurer of the outgoing boards will deliver to the new presidents and elected treasurers, the documentation of income and expenditure from the previous period and the accounting and working information in accordance with the rules issued by the Secretariat of Public Education.
If you resign or leave office for which any member of the boards of the associations that has been elected has been elected Under this order, the Board of directors shall be elected to the substitute, except for the case of the President, who shall be replaced by the Vice-Chair.
ARTICLE 31.-The boards of the associations of the schools, the associations of the state and the Federal District, will have the following attributions:
I.-Represent the aforementioned organizations for the due fulfillment of their object;
II.-Propose the treatment of matters to assemblies and councils within the object of associations;
III.-Reporting of your activities to the appropriate assembly or council;
IV.-Develop the draft statute and submit it to the consideration and approval of the respective assembly or council, as well as its modifications;
V.-Convocation to ordinary and extraordinary assemblies or councils;
VI.-Meet the agreements of assemblies and councils;
VII.-To propose to the assemblies or the corresponding councils the designation of the members of the committees of sponsors and the councils advisory, and
VIII.-The others who entrust them with this regulation and the status of the association.
ARTICLE 32.-The boards of directors shall hold regular sessions every two months and extraordinary when they are convened by their president or upon request in writing, at least four of its members.
ARTICLE 33.-The board of directors of the National Association of Parents, will have the following attributions:
I-Represent the interests that in educational matters, at the national level, are common to the associations of parents, for the due compliance with your object;
II.-Coordinate the activities of the councils of the state associations and those of the Federal District council for the best performance of their tasks;
III.-Present to the council its specific work programmes and activities,
IV.-Fulfill council agreements;
V.-Propose members of the advisory board and the committee of sponsors of the national association, and
VI.-The others who trust this regulation and the rules that govern it.
ARTICLE 34.-The legal representation of the associations of parents referred to in this regulation shall be:
I-Mancomunately in the president and treasurer of the board of directors, in all matters involving management of funds and, in general, of acts domain;
II.-In the chair of the board of directors in other cases, if the association has not established any special representative, and
III.-In those presidents who for specific purposes designate the association itself.
ARTICLE 35.-The Vice-Presidents will have a voice and will only vote in the sessions when the presidents are replaced.
ARTICLE 36.-If the presidents of the boards are subsequently elected as presidents of a higher-grade association, of a State association, of that of the Federal District or of the national association, will cease in their functions from the date of their inauguration in the new order and until the term of the same, period during which they will be supplied by the respective vice-.
ARTICLE 37.-The directors of the plant, by themselves or through their representatives, may participate, as advisers, in the assemblies of parents.
ARTICLE 38.-Officials responsible for carrying out the task of school supervision in the Secretariat of Public Education will serve as advisors of the associations of parents with their registered office in their respective territorial constituencies and shall cooperate with them for the best performance of their object, in accordance with the instructions they receive from the said Secretariat for the competent authorities ' conduct.
ARTICLE 39.-General delegates of the Secretariat of Public Education in the States and the Directors General of the Department of Public Education, in the Federal District, in itself or by the representatives who credit, may participate, as advisors, in the respective assemblies of the state associations and in those of the Federal District association.
ARTICLE 40.-The associations mentioned in this order, may have two auxiliary agencies: a committee of sponsors that In addition to the work of the associations of prominent people of the community in the area of influence of schools, in the States and at the national level, and by an advisory board composed of persons with experience in the activity of the associations themselves.
ARTICLE 41.-The vowels representing the advisory councils and the committee of sponsors in the tables, according to Article 29 of this regulation, they will only have a voice.
ARTICLE 42.-The internal conflicts that arise in the associations of parents, will be known in the following way:
I-The councils of the state associations, and the Federal District Association, on the proposal of its boards, will attend to the associations of the schools that form them, and
II.-The associations concerned may use the higher step in jurisdiction in the second instance in accordance with the list in Article 5o. of this regulation.
ARTICLE 43.-They shall be honorific and, consequently, unpaid, the work carried out by the members and representative of the associations, for the fulfillment of its object.
ARTICLE 44.-In accordance with the program authorized by the Secretariat of Public Education, and with the collaboration that is agreed between the associations State, the Federal District and the national association, may convene directly or through its general delegates of the States, to regional or state regional meetings of the associations of parents for the examination of (a) a special educational interest, within the framework of the the federal Education Act, and this regulation, point out to such associations.
ARTICLE 45.-The Ministry of Public Education will carry and keep up to date the National Register of Family Parents Associations, in which free of charge:
I.-The act of constitution of the associations referred to in this order;
II.-The statutes of the organizations mentioned above, and
III.-The minutes of the election of the boards, members of the councils and representatives as appropriate, as well as the names and charges of those who are elected, their acceptance and protest, and any subsequent changes that take place.
ARTICLE 46.-The General Delegations of the Secretariat of Public Education in the States shall, within their respective (a) the registration, registration or registration referred to in the preceding Article, once they have satisfied themselves with the relevant requirements and shall concentrate the information in accordance with the provisions laid down by the Secretary of Education; Public.
ARTICLE 47.-The entries concerning the boards and boards of the state associations and the Federal District, as well as the of the National Association of Parents, will be done, as well as those of the associations of the schools of the Federal District, in the dependency that the secretary of Public Education designates.
ARTICLE 48.-The inscriptions referred to in Part I and III of Article 45, in the National Register of Associations of Parents of Family, to which the organisations referred to in Article 5o are obliged. of this Regulation, shall be requested within a period of ten working days from the date following that in which the event or act to be registered takes place.
To apply for the registration of the statutes according to section II of Article 45 itself, a period of six months shall be granted from the date of constitution of the appropriate family parents ' association.
ARTICLE 49.-For the Secretariat of Public Education to carry out the inscriptions referred to in Article 45 (I) and (III) of this Article rules, it will be necessary for the minutes and documents to be presented for registration to be recorded with the constancy issued by the representatives of the Secretariat of Public Education, accredited to the effect.
ARTICLE 50.-the records will be processed by the representatives of the boards, through the school and educational authorities competent in the locality concerned.
ARTICLE 51.-The Secretariat of Public Education may deny or cancel the registration, as the case may be, for any of the following reasons:
I. For non-compliance with the provisions of the Constitution, the Federal Education Act, and this regulation;
II.-For lack of documentation requirements that are present;
III.-For falsehood in documents that are offered for registration;
IV.-For not complying with the provisions of the Secretariat of Public Education issued under this order, and
V.-By closing or dropping the school establishment.
ARTICLE 52.-For the purposes of this Regulation, associations formed in accordance with this Regulation may exercise their rights and obligations to from their registration in the National Register of Family Parents Associations.
The legal representation of the boards referred to in Article 34 of this regulation shall be accredited by record the effect is issued.
Community Education Promotional Associations
ARTICLE 53.-In the communities of the country with poor population or difficult access, even if they do not work in them, they will be able to integration of parents ' associations which will aim to promote the delivery of the different levels of basic education and cultural dissemination, as well as to collaborate and contribute, to the best of their ability, in the establishment and development of educational services.
ARTICLE 54.-The associations referred to in the preceding article shall have in addition the privileges set out in Article 6o. of this order, the following:
I.-To bring the representation of the communities to the competent authorities for the defense of their common interests in educational matters;
II.-Promoting the provision and development of basic education services;
III.-To monitor the correct use of textbooks, didactic and cultural materials and other resources to support education, provide communities;
IV.-Conduct the acts and, where appropriate, grant the conventions and contracts that are required to support and stimulate community education.
ARTICLE 55.-The associations referred to in this chapter shall be made up of parents, guardians and those who exercise the parental authority, as well as people in the community who could receive adult education services.
In so far as they do not object to the provisions of the legislation (sic) and to this Regulation, the organisation and operation of such associations shall be will be governed by the agreements of its members, which must be registered in the National Register of Family Parents Associations that the Secretariat of Public Education carries.
ARTICLE 56.-The Secretary of Public Education will dictate the agreements and issue the instructions to promote the integration of the associations and regulate its operation and organisation as foreseen by this regulation.
ARTICLE 57.-Associations of parents must be limited to carrying out their tasks within the legal framework that points to their object; refrain from intervening in the technical and administrative aspects of educational establishments, shall not engage in gainful activities for the benefit of their partners and shall adjust their activity to the provisions of Article 3. of the Political Constitution of the United Mexican States, of the Federal Law of Education and of this regulation.
ARTICLE 58.-In case of doubt regarding the interpretation and application of this Regulation, the Secretary of Public Education will determine the criteria to prevail.
FIRST.-This regulation will enter into force the day after its publication in the "Official Journal" of the Federation.
SECOND.-The Rules of Procedure for the Constitution and the Functioning of the Associations of Parents of the Family, in the schools dependent on the Secretary of Public Education, issued on January 13, 1949, published in the "Official Journal" of the Federation on the 22nd of the same month and year.
THIRD.-To make the annual renewal of the members of the boards of the associations, with the exclusion of those of the Pre-school education schools, as referred to in Article 30 of this Regulation, the calls to be issued by the competent authorities shall indicate the following charges which, initially, shall have a single annual period:
I.-In the associations of primary and secondary schools, as referred to in Article 1. of this Regulation, the first election shall be chosen for one year by the Vice-President, the Secretary of the Association and the first 3 vowels and, for two years, the President, the Treasurer and the Vowels. 5o. and 6o.;
II.-In the state associations, the vice-president, the secretary-general, the first two and the last two vowels will be elected for one year and, the President, Treasurer and Vocals 3., 4., 5. and 6o, for two years; and,
III.-In the case of the board of directors of the National Association of Parents, the vice president, the secretary, will be elected for one year. general and the vowels 1o., 3o., 5o., 7o. and 9o. and, for two years, the president, the treasurer and the vowels., 4., 6o., 8o. and 10o.
FOURTH.-The directors of the schools shall make the calls referred to in Article 11, within 30 working days of the entry into This order is effective.
The first choice of the boards of directors referred to in this regulation, will be done for a period that will conclude with the choice of the tables directives for the 1981-1982 cycle, for which they are elected for one year in accordance with the preceding transitional article.
QUINTO.-The other provisions which are contrary to this Regulation shall be repealed.
