BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: short title 1. This Act may be cited as the federal roads Act (private management) 1984.
Order for collection of toll 2. (1) be valid in law for the Minister in charge of the work by order published in the Gazette to authorise any person who has agreed to construct, reconstruct, improve, repair or maintain any roads, bridges or ferries that have been declared or are declared as roads, bridges or ferries under federal roads Act 1959 [Act 376] or in any Federal District to request , collect and keep tolls for the period as specified in the order for the use of roads, bridges or the ferry by any person or any class of vehicles.
Law Malaysia6 ACT 306 (2) an order under subsection (1) shall state — (a) roads, bridges or ferries in respect of which the toll can be requested, collected and stored;
(b) the person is authorized to request, collect and keep tolls;
(c) the duration of authorisation under paragraph (b);
(d) the person or classes of vehicles in respect of which the toll can be requested, collected and stored;
(e) the amount of tolls;
(f) the place where the toll may be collected; and (g) a person or class of vehicles will be exempted from toll payment.
Installation of galang 3. Any person authorized to request, collect and keep tolls under section 2 may cause a galang installed at any place where a toll is payable, and that can be placed against galang any person or vehicle until the toll payable in respect of the person or the vehicle has been paid.
Accounts, books, records, etc., in respect of tolls 4. Any person authorized to request, collect and keep tolls under section 2 — (a) shall maintain such accounts, books and records with respect to the payment and collection of tolls as may be required by the Minister;
(b) shall provide to the Minister any information, statements and accounts with respect to the payment and collection of tolls as may be required by the Minister; and federal roads (private management) 7 (c) shall allow any person authorized by the Minister to have access to, or to inspect or review, any account, books, records, documents, machinery or tools that maintained or used for payment or collection of tolls.
Duty to maintain roads, bridges or ferry 5. Any person authorized to request, collect and keep tolls under an order made under section 2 shall maintain in good condition and in accordance with good engineering practices, over roads, bridges or ferries in respect of which the order is made.
The Malaysian Government Immunity 6. The Government of Malaysia shall not be liable for any person in respect of any type of injury, damage or loss arising from the failure of the reserves the right to request, collect and keep tolls under an order made under section 2 or by virtue of subsection 7 (3) to carry out any of its functions under section 5.
Assignment of right request, collect and store toll free 7. (1) the Minister, with the agreement of the Minister of finance, may in the case of appropriate, after taking into account the interests of the person authorized to request, collect and keep tolls under section 2 may, by notification in the Gazette allow, subject to the terms and conditions as the Minister thinks fit, assignment of rights the person authorized to request, collect and store toll free to any person who has an interest in financing the construction , reconstruction, improvement, repair or maintenance of roads, bridges or ferries may be (in this section referred to as "assigns").
(2) a notification under subsection (1) shall state the duration of the truth, which cannot be longer than the duration of authorisation set out in the relevant order under section 2.
Law Malaysia8 ACT 306 (3) during the period of permission under subsection (1) that, assigns shall be deemed to be the person authorized to request, collect and keep tolls under section 2 for the use of roads, bridges and ferries concerned and shall comply with sections 3, 4 and 5.
Error 8. (1) any person who uses or attempts to use any roads, bridges or ferries in respect of which an order has been made under section 2 without paying the toll specified in the order is guilty of an offence and shall, on conviction, be fined not less than two thousand dollars and not more than five thousand dollars.
(2) Notwithstanding subsection (1) the toll payable by virtue of an order made pursuant to section 2 may be obtained through legal action by such authorized person under the section.
(3) Section 173A criminal procedure code [Act 593] does not apply in respect of an offence under subsection (1).
(4) in every case when the offender is sentenced to pay a fine under this section, the Court shall direct that the sentence if he defaults in paying the fine the offender shall be imprisoned for a term not exceeding one year, and imprisonment is in addition to any other sentence of imprisonment passed thereon or that may be imposed on it pursuant to a sentence commutations.
