BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: part I preliminary short title and commencement 1. This Act may be cited as the Act of destroying Insects Disease Carrier 1975, and shall come into force on such date as the Minister may, by notification in the Gazette, and different dates may be appointed for Malaysian parts different.
Interpretation 2. (1) in this Act, unless the context otherwise requires — "Inspector" means a health inspector in the service of the Government or any local authority and includes another person specified in writing by the Director General or an officer of health as an inspector for the purposes of this Act;
"Director General" means the Director General of health, Malaysia;
Laws of Malaysia ACT 1546 "Minister" means the Minister charged with the responsibility for health;
"Health officer" means any medical practitioners in Government or any local authority that is to carry out the health officer in any area, district or local authority areas, including airport and both its limits and including Deputy Director General of health (public health), Director of disease control, any Deputy Director of disease control, any Director of the State Health Service and his Deputy;
"owner" means the person who currently receive the rent of any premises, whether on his own behalf or as an agent or trustee or as a recipient, or who will receive land or house rentals if the premises is rented out to a tenant;
"population" means the person who occupies any premises or who care for, manage or control it either on behalf of yourself or as an agent of another person, but does not include a person the tenant;
"registered medical practitioner" means a medical practitioner registered under the medical Act 1971 [Act 50];
"premises" means wholly or principally, buildings, land, isemen and hereditamen from any holding and includes any place or building, or any part thereof, used or proposed to be used for human or for employment or any other purpose whatsoever;
"insect carriers of disease" means any insects that carry or cause, or which may bring or cause, of a disease in humans or livestock, and includes eggs, larvae, and pupa of the insects.
(2) Notwithstanding the definition of the phrase "insect carriers of disease" the Minister may by order published in the Gazette declare that any or all of the provisions of this Act apply to any animals determined by it in order, and then from the reference on "insects Destroying Insects Disease Carriers 7 carriers of disease" and "diseases carried by insects" in the provision shall be respectively construed as including the animal and its egg , if any, and diseases brought by him.
PART II The POWER Of The DIRECTOR GENERAL And HEALTH OFFICIALS Of Delegation 3. The Director-General and a health officer may delegate in writing any or all of the powers conferred or duties imposed upon him by this Act, except the power to authorize an officer of the public under section 25, to any person he deems fit.
Public servants 4. Director General, an officer Health, one inspector and someone else delegated powers under this Act shall, when acting in the areas of powers and duties under this Act and any regulations made thereunder be deemed to be public servants within the meaning of the Penal Code [Act 574].
The power to enter and inspect the premises, etc.
5. (1) the Director General, an officer or a Health Inspector may, for the purpose of exercising the powers under this Act, between six and ten nights, with or without assistants, enter and inspect any premises.
(2) (struck by A1086 Act.)
(3) if necessary and expedient for the exercise of the powers conferred by this act performed outside specified in subsection (1), the Director-General, a medical officer of health or a person Inspector can enter premises for that purpose after giving at least twenty-four hours prior notice to the owner or occupier of the premises.
Laws of Malaysia ACT 1548 (4) If the requirements of subsection (3) have been complied with, the owner or occupier of the premises must allow the Director-General, a Health Inspector or a person, with or without assistants, enter such premises and any part thereof for the purpose of exercising the powers under this Act and shall give all information required by the Director General, health officer or the Inspector.
(5) in the exercise of its powers to enter under subsection (3) the Director General, a medical officer of health or a person Inspector and assistants can, if necessary, use reasonable force or break any door, window or locks.
Power seize 6. (1) the Director General, a medical officer of health or a person inspector may — (a) if he has a suspicion that an offence under this Act or any regulations made thereunder is being or has been committed, seize any article that has been a matter or that have been used in the Commission of the offence; and (b) seize any article including its contents for purposes can inspect them to determine if any insect carriers of the disease or whether his condition is likely to cover or membiakkan insect carriers of disease.
(2) the Director General, a medical officer of health or a person inspector shall prepare a list of all articles seized under subsection (1) and hand over immediately a copy of the list by him to the owner or occupier of the premises from which the merchandise was seized or to agents or employees or to any other person the items had been taken from them.
(3) If no person is charged with an offence upon the goods shall, unless the goods claimed by the owner or the person from whom the goods were seized within two weeks after the seizure, disposed of according to the discretion of the Director General or a medical officer of Health but if during the period of the claim made by the owner or a person Destroying Insects Disease Carriers from whom 9 afterwards seized goods shall be returned to him.

(4) Notwithstanding subsection (3), the Director-General or a health officer may at any time at the disposal of any insect carriers of disease or any perishable things taken in such manner as it thinks fit: provided that if perishable thing is sold, revenue from the sale shall, if so demanded by the owner or the person from whom the thing is seized perishables , paid to him within two weeks after it was seized.
The requirements for providing information 7. (1) the Director General, an officer or a Health Inspector may require the owner or occupier of a premise or agent or person in his salary, or any other person who he has reason to believe is committing or has committed an offence under this Act — (a) give the name and address of the place of his/her habitual residence;
(aa) produce — (i) an identity card;
(ii) in the case of any business premises, any document in connection with registration or licensing of the business under any written law; and (iii) any other document required by the Director General, an officer or a Health Inspector for the purpose of determining the identity of the owner or occupier of the premises;
(b) to provide information relating to the breeding of insect carriers of diseases or the occurrence of a disease carried by insects or any other information required by the Director General, an officer or a Health Inspector, (c) give any statement in writing.
Laws of Malaysia ACT 15410 and owner or occupier or agent or person in his salary or any other person shall comply with the requirements.
(2) if under subsection (1) any person refused to give the name or the address of the residence or give a name or address of the shelter Director General, an officer or a Health Inspector has reason to believe is false, as the Director General, health officer or inspector may, to specify the name or the address of their homes, arrest him and within twenty-four hours to bring it forward Magistrate once unless before the period of the name and address of actual residence has be determined in the case therefore that person shall be released immediately.
(3) a person who fails to provide information or to provide information required under subsection (1) which in its knowledge is false is guilty of an offence under this Act.
General power to lead or take measures so that the insects were destroyed disease carriers, etc.
8. (1) if the Director General or an officer or a Health Inspector is of the opinion that a premise or anything in it may be membiakkan or give protection to any insect carriers of disease, he may in writing order the owner or occupier of that take such steps or make any work in respect of the premises or to treat, the destructive or remove anything in it so that the premises or conditions therein are not suitable for breeding or protection for insect carriers of disease.
(2) without prejudice to the generality of the powers specified in subsection (1) the Director General or an officer or a Health Inspector may in writing order the owner or occupier of a premises to take or carry out any measures or work the following: (a) destroy insect carriers of diseases wherever found;
Destruction of Insect carriers of Disease 11 (b) collect and remove tin, kaling, bottles or other containers in which insects can breed disease carriers;
(c) cut and remove grass, bamboo stumps, ferns or fern undergrowth which insects disease carriers may multiply or sheltering;
(d) close and always closed any tank, an improved, container or penakung else on the premises;
(e) build drainage for the premises;
(f) not cause holes that are found on the surface of the premises;
(g) use of insecticides at the pool, Princess or other reservoir, water vessel, stables, pig, cow pens, coops or other place used to protect animals; and (h) generally prevent insect carriers of disease from breeding or protection.
(3) the Director General or an officer or a Health Inspector may in the same order directing — (a) the period in which the steps or the specific work to be acquired or incurred or disudahkan;
(aa) that the premises or any part of the premises that is closed until the steps or the specific work taken or done or disudahkan and the premises can no longer be membiakkan or give shelter to insects disease carriers;
(b) the intervals in which the measures or specific work that can be taken or done; and (c) that measures or specific work shall be taken or done until the premises or anything in it can no longer be membiakkan or give protection to insect carriers of disease.
(4) an order under this section may be given to the owner or occupier of a premise and someone who was in it, including agents and people his salary.
Laws of Malaysia ACT 15412 (5) Notwithstanding subsection (1), (2) and (3), the Director General or an officer or a Health Inspector may, if in its opinion the circumstances allow, with own ordered a step or work specified in that subsection is taken or made but in every such case the Director General or an officer or a Health Inspector shall notify the owner or occupier of the type of measures or work proposed to be acquired or made it.
(6) subject to section 17, if the owner or occupier of a premises against whom an order made under subsection (1) or (2) have been served fails to comply with the conditions of the order, the Director-General or an officer or a Health Inspector can take and make against it or in it any of the steps or works required to be taken or made by the order.
(7) if the Director General or an officer or a Health Inspector in itself directs a step or taken or made under subsection (5) or (6) any costs and expenses may be recovered by him from the owner or occupier of the premises concerned.
(8) a person who removes or causes less effective any pesticide used by the Director General or an officer or a Health Inspector or refused, or not to comply with an order to be careless writing made pursuant to subsection (1) or (2) or disrupt or expel anything made by the Director General or an officer or a Health Inspector under subsection (5) or (6) is guilty of an offence under this Act.
The owner or occupier shall provide assistance 9. (1) if the Director General, an officer or a Health Inspector, in carrying out the purposes of this Act, require the help of the owner or occupier of a premises, the owner or occupier shall provide any assistance as required to enable the work or measures taken or made effectively.
Destruction of Insect carriers of Disease 13 (2) in particular and without prejudice to the generality of subsection (1), the owner or occupier shall, before pesticides began to spray it on — (a) move or close all food products, clothing and other items that may be more than 230 or damaged by the spray;
(b) delete all the fire and flames on the premises during the period of the spraying;
(c) remove all picture frame, mirror, cupboard, storage of food and all furniture from the wall and leave them in a pleasant wall and furniture is sprayed with pesticides; and (d) leaves and put all the containers that you want to use to store water or it can store water in a State that allowed him to love cars and to check its contents.
(3) a person who refuses, negligent or not doing any thing under this section is guilty of an offence under this Act.
Medical examination of the suspect infected diseases carried by insects 10. (1) the Director General or a health officer may — (a) medically examine any person suspected or may be infected diseases carried by insects for the purpose of ensuring whether the person is suffering from, or in the past has suffered from, or a carrier of a disease carried by insects, or whether that person in the past exposed to infection by the disease like that , including the inspection of blood, urine and feces;
(b) medically treating or isolating a person suffering from a disease carried by insects or both; and (c) direct that made a post-mortem examination to a body of death suspected of being caused by diseases carried by insects.
Laws of Malaysia ACT 15414 (2) a person who refuses, negligent or not comply with the inspections, treatment or separation under paragraph (1) (a) or (b) or a person who is under his care a body that refuses or prevent post-mortem on the body under paragraph (c) of that subsection is guilty of an offence under this Act and shall on conviction, be liable to a fine not exceeding two thousand ringgit.
Power to require information and check people

10A. (1) Chief Director, an officer or a Health Inspector who makes an investigation and inspection under this section has the power to require information, either orally or in writing, of any person who knows the facts and circumstances of matter that is being investigated.
(2) any person who, when required by the Director General, an officer or a Health Inspector to provide information under this section, refuse to comply with the requirements or give true information as any information which he knows or has reason to believe is false, untrue or incorrect, in whole or in part, commits an offence.
(3) if any of the information provided under subsection (2) is proved false, untrue or incorrect, in whole or in part, shall not be a Defense claim that the information or any part thereof has been given by disalahtafsirkan or accidental or culpable criminal or tipuan.
(4) the Director General, a Health Inspector or a person making an investigation under this Act may exercise any or all of the powers conferred by section 111 criminal procedure code [Act 593] and sections 112 to 114 of the Code shall apply to the statement made by the person to be examined in the course of the investigation.
Destruction of Insect carriers of Disease 15 PART III and OTHER OBLIGATIONS of the OWNER and the approval shall be obtained for work may be membiakkan or give protection to the carrier insects disease 11. (1) where in the opinion of the Director General or an officer of health that a working building, developing land, redeem land use, dredges, mining or other jobs that are being or will be implemented or diusaha, carried out by a person, which may be membiakkan or give protection to the insect carriers of disease, Director General or health officer may require the person to submit to him a plan for the work.
(2) the Director General or health officer may, after reviewing the plan, require persons operating, implement or carry out building, developing land, redeem land use, dredges, mining or other works that comply with the conditions that it considers necessary to prevent insects from disease carriers multiply or protected.
(3) any person who did not submit a plan as required under subsection (1) or refuse to, not negligent or to comply with any condition imposed under that subsection is guilty of an offence under this Act.
Prohibition against clearing undergrowth in certain circumstances, etc.
12. (1) an owner, the people or someone else proposing to make or cause or permit to be made any of the following, namely: (a) done or clear any undergrowth or other plants within twenty feet of any watercourse or water seepage or stagnant or flowing water to which shading provided by undergrowth or other vegetation;
Laws of Malaysia ACT 15416 (b) cut or clear forest, undergrowth or other plants; or (c) make a hole for the planting, replanting or develop the land, shall notify the Director-General or an officer of health in writing of its intention of not less than fourteen days before the work begins.
(2) the Director General or an officer of health upon receipt of the notice under subsection (1) may in writing order the owner, the people or someone else take such steps as he may in writing order the carrier to prevent disease from insects multiply or protected.
(3) No person is the owner or occupier of a premises, including an agricultural land may allow any hole or a recess which may be retaining water from continue to be at or on land owned or occupied by him for a period of more than seven days from the time the hole or a recess is made, whether the hole or a recess is made within clearing, planting or other agricultural work or due to tumbangnya of a tree or in any other way , and each owner or occupier shall not cause or direct that covered any holes or the recess to equal with the surrounding land within seven days from the date of the hole or a recess is made: provided that the owner or occupier can leave a hole or a recess that remain for a period longer than seven days if he would take any steps to prevent insects disease carriers in the hole or the recess of the reproduction or of the shelter.
(4) any person who contravenes the provisions of this section or any order under subsection (2) is guilty of an offence under this Act.
Destruction of Insect carriers of Disease 17 Prohibition against actions giving rise to the circumstances which may be membiakkan or give shelter to insects disease carriers 13. (1) No person shall melaku or carry out any action which may, or is likely to, give rise to a situation which can be membiakkan and provide protection to the carrier of the disease, insects or membenar or let the situation occurs or continues.
(2) any person who contravenes subsection (1) is guilty of an offence under this Act.
Prohibition against reproduction, etc., insect carriers of a disease without the permission of 14. (1) No person shall membiakkan, save, collect, distribute, sell, import or export a disease carrier insects without the written permission of the Director General.
(2) an authorization granted under subsection (1) — (a) shall be at the discretion of the Director-General once he is satisfied that the application for it is made for the purposes of scientific or educational purpose, or for research or for other reasons that he received;
(b) be subject to such conditions as he thinks fit to impose by the Director General; and (c) may be cancelled at any time by the Director General without assigning any reason therefor.
(3) any person who contravenes subsection (1) or who contravenes any condition imposed under paragraph (2) (b) is guilty of an offence under this Act.
PART IV MISCELLANEOUS Earned the costs and expenses 15. (1) if the amount of costs and expenses payable under subsection 8 (7) not paid by the parties to be laws of Malaysia ACT 15418 pay him within seven days after the request, the failure to pay could be reported to a court magistrate and notwithstanding any other written law that amount may be recovered in the same manner as if it was a penalty imposed by the Court.
(2) If a person sells or transfer possession of any property in respect of which costs and expenses have been made by the Director General or an officer of health in or on doing something work required to be made under this Act and the costs and expenses recoverable under this Act of the owner of the property, that person shall remain liable to pay all costs and expenses payable in respect of the property and carry out all other liability imposed by this Act to the owner of the property becomes payable or is required to be put in place before the transfer of the possession of it.
(3) no anything at all in this section shall affect the liability of the purchaser or recipient of transfers to pay costs and expenses in respect of the property or that of the Director-General or a health officer to obtain the costs and expenses it or to carry out any obligation under this Act.
(4) no anything at all in this section shall affect the liability of any person to prosecuted or sentenced under this Act.
(5) the Director General or a health officer may at its discretion exclude part or all of the payment of costs and expenses if he has reason to believe that the person is required to make payment is not able to pay the fee.
(6) for the purposes of this section "costs and expenses" means all costs and expenses incurred.
Delivery of orders, etc.
16. (1) every order, notice or other document required by this Act or any regulations made thereunder the destruction of Insect carriers of Diseases 19 to be communicated to any person may be served — (a) by delivering it to the person or by delivering it to a person of his adult or his salary at the shelter eventually known;
(b) by leaving it at the place of residence or business or last known in the envelope addressed to him; or (c) by send it by post in a letter which was paid in advance that are addressed to that person at the place of residence or business or last known.
(2) an order, notice or other document required by this Act or any regulations made thereunder could be communicated to a body corporate, firm, association or group of persons — (a) by delivering it to a Director, Manager, Secretary or other similar officer or partner or any person purporting to act in the position; or

(b) to deliver it by post in a letter which was paid in advance that are addressed to the registered office or place of business of the usual or last known belong to bodies corporate, firm, association or other group of persons.
(3) an order, notice or other document required by this Act or any regulations made thereunder to the owner or occupier of a premises shall be deemed to be properly addressed if addressed by using the description of "owner" or "residents" of the premises without further description or name.
(4) without prejudice to subsection (1) and (2), an order, notice or other document required by this Act or any regulations made thereunder to the owner or occupier of a premises may be served by sending it to an adult on the premises or, if no person is adult in the premises, to the laws of Malaysia Act 15420 anyone order , notice or other document that can with reasonable effort, surrender or with affixes order, notice or document in a part of the premises is conspicuous.
Appeal to the Minister 17. (1) If an owner or occupier of the premises is of the opinion that a written order made under this Act and that touched him or anything suggested to do unreasonable or unnecessary, he may, within the period specified in the order (i.e. not less than seven days from the date the order was delivered), appeal in writing to the Minister, with the execution of the order or works required to be made shall be postponed.
(2) the Minister may confirm, vary or revoke the order or direct that measures or specified it be continued, modified or omitted, as the case may be, or make an order that the Director-General or a health officer was competent to make under this Act, and the decision of the Minister thereon shall be final.
No compensation 18. No person shall be entitled to receive compensation for any expense incurred or damage caused by any orders or acts made pursuant to this Act or any regulations made thereunder unless such damage has been caused by bad faith or without reasonable cause.
Obligations of the owner and residents to keep working to prevent breeding of insect carriers of diseases 19. (1) if the Director General or a health officer or any local authority or a Department of the Federal Government or the Government of a State has made any construction work with a view to prevent the breeding of insects, disease carriers and owner of the premises to which the residents of the work shall be established to prevent the premises from being used in any manner that may be causing the decline or less efficient.
Destruction of Insect carriers of Disease 21 (2) where a premises used in a way that caused the decline or less efficient, the owner of the premises and the residents, subject to the provisions of subsection (4), is guilty of an offence under this Act and the Director-General or a health officer can enter the premises and carry out any repairs or works thereon and notwithstanding anything contained in any written law acquire the from people convicted , as the same way as if it's a fine imposed by a Magistrate, any costs and expenses with that done.
(3) before a proceeding conducted under this section, the notice shall be given by the Director General or an officer to the owner or occupier, as the case may be, specifies what is required by the Director General or health officer made or never made and give time to adhere to it as may be deemed necessary by the Director General or the health officer.
(4) If the owner of the premises by reason of a contract law (which is not a contract made with the purpose of avoiding liability under this section) be detained from entering the premises to perform the duties and liabilities referred to in subsection (1), he shall not be liable to the penalty referred to in subsection (2), unless it can be shown that he was in any way caused the population refuses to or does not perform the duties and liabilities of that.
The penalty for damaging the work carried out by the Director General or a medical officer of Health 20. A person who, without the consent of the Director-General or an officer Health, intervene in, damage, maim, destroy or render useless any work performed or any article or thing which is housed in, under or on top of a premise by or under the order of the Director General or a health officer is guilty of an offence under this Act and shall on conviction liable to a fine not exceeding ten thousand ringgit *; and the Director-General or a health officer may be notwithstanding anything contained in any written law to obtain from persons convicted, according to the same way * RECORDS — Formerly "two thousand dollars" – see A1086 Act.
Laws of Malaysia ACT 15422 as if it a fine imposed by a Magistrate, any costs and expenses incurred in the repair or replace goods or anything mixed hand, damaged, dicacatkan, were destroyed or turned into such useless.
21. Penalties for preventing A person who prevents the Director General, an officer, a Health Inspector or a person who has been in carrying out the provisions of this Act is guilty of an offence under this Act and shall on conviction liable to a fine of not more than * ten thousand ringgit or to imprisonment for a period not exceeding two years or to both.
Liability of owner, population, servants, etc.
22. (1) where an offence has been committed under this Act or any regulations made thereunder by someone other than the owner or occupier of the premises, the owner and residents shall, even if no-one charged with them, be deemed to be guilty of the offence unless he can prove that the offence was done without the knowledge, consent and pembiarannya and that he has conducted all the necessary effort to prevent the offence from occurring.
(2) where an offence under this Act or any regulations made thereunder has been committed or deemed to have been made under subsection (1) by a body corporate, firm, association or other group of persons, any person who at the time of the Commission of such offence is a Director, Manager, Secretary or other similar officer or a partner of the firm, body corporate, association or other group of persons or purporting to act in the position shall be , as well as the body corporate, firm, association or other group of people, be deemed to be guilty of such offence unless he proves that the offence was committed without the consent or pembiarannya and that he undertakes all efforts to prevent the offence from occurring as should have been done by him, considering the type of job in the post and to all the circumstances.
* NOTE — Formerly "one thousand ringgit or to imprisonment for a term not exceeding three months or to both" – see A1086 Act.
The destruction of Insects Disease Carriers and conduct an initial 23 prosecution 22A. Prosecution in respect of an offence under this Act shall not be instituted except through or with the written consent of the public prosecutor.
Penalties am 23. A person who is guilty of an offence under this Act or any regulations made thereunder for which no specific penalty provided for may on conviction — (a) in respect of an offence liable to a fine not exceeding the first * ten thousand ringgit or to imprisonment for a term not exceeding two years or to both;
(b) in respect of an offence second or later * * a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding five years or to both;
(c) in respect of an offence liable to a fine of not more than continuous further * * * five hundred dollars for each day the offence is continued.
A first class magistrate shall have full jurisdiction 23A. Notwithstanding the provisions of any written law to the contrary, a first class Magistrate Court shall have jurisdiction to try any offence under this Act and for the full sentence for any such offence.
Police assistance 24. If the Director-General, an officer or a Health Inspector to be entering a premises for the purposes of carrying out the provisions of this Act, he may, if in his opinion necessary, get help a police officer and the police officer shall give the necessary assistance for that purpose.

25. (1) Director General, an officer of health, an inspector or a person authorized public officer in writing in that behalf by the Director-General may mengkompaunkan any offence committed by any person under this Act or any regulations made under this Act and prescribed by regulations made under this act as an offence can be compounded, by making an offer in writing to the person suspected to have committed the offence to mengkompaunkan them on payment of a amount not exceeding five hundred ringgit * to the Director General, an officer of health, an inspector or a person authorized public officer such within the time stated in the offer.
(2) an offer under subsection (1) may be made at any time after the offence, but before any prosecution for him started, and if the amount specified in the offer is not paid within the time stated in the offer or in any extended period granted by the Director General, an officer of health, an inspector or a person authorized public officer such , a prosecution for the offence may be commenced at any time after that to the person to whom the offer is made.
(3) If an offence is compounded under subsection (1), no prosecution can then started in respect of the offence against a person to whom an offer to mengkompaunkan is made.
Act shall apply to all assets 26. Except as provided in section 19 of this Act shall apply to all property of every type including belonging, vest on or maintained by any statutory body.

Destruction of Insect carriers of Diseases 25 authority to make regulations 27. The Minister may make regulations for carrying out the purposes of this Act and without prejudice to the generality of the words mentioned above may — (a) determine the measures or work to be taken or made by a person or class of persons for the prevention of disease carrier insects breed and protection;
(b) require any person or class of persons to send such information specified;
(c) prescribing the conditions of importation or exportation of insect carriers of disease;
(d) prescribing offences can be compounded and the way compound;
(e) prescribing the form of any order, notice or other document required under this Act or any regulations made thereunder.
