BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: part I preliminary short title and application 1. (1) this Act may be cited as the National Library Act 1972.
(2) this Act shall be applicable only for Peninsular Malaysia only.
Interpretation 2. In this Act, unless the context otherwise requires — "building" means any building or premises forming part of a library or used by him and any building or premises leased or rented temporarily or otherwise by the Federal Government or the Government of a State for the purpose of libraries and includes any vehicle or vessel used in any mobile library which forms part of the library;
6 laws of Malaysia ACT 80 "Director General" means the Director General of the National Library of appointed under subsection 4 (1);
"collection" means the library resources collected and maintained in the Library;
"Fund" means the Fund National Library established pursuant to subsection 7 (1);
"Board" means the Advisory Board established under section 5;
"Minister" means the Minister is tasked with the responsibility for the library;
"Chairman" means the Chairman of the Advisory Board appointed under paragraph 5 (2) (a);
"Library" means the national library established under section 3;
"library resources" means any form of matter written, printed or graphic above or in which information is written, recorded, stored, displayed or reproduced, including manuscripts, copies of type, books, newspapers, periodicals, pamphlets, maps, mikroform, paper music, photographs, cinematographic films, phonograph, recording video and audio and other recordings on paper, film or other material and the copies thereof;
"due date" means the date this Act comes into force.
PART II The ESTABLISHMENT And MANAGEMENT Of The NATIONAL LIBRARY Of The Establishment Of The National Library Of 3. A national library of Malaysia (hereinafter referred to as the "Library") was established with the intent and purpose as follows: (a) providing for the use of the current generation and the future of a collection of library resources at the national level;
National Library of 7 (b) facilitate country-wide access library resources available locally and abroad; and (c) to Institute leadership in matters pertaining to the library.
Management and supervision of the national library by the Director General and Director General 4. (1) a library shall be managed and controlled by the Director-General appointed by the Yang di-Pertuan Agong.
(2) the Director General shall have the following functions: (a) advise the Minister on National policy for all matters relating to library and all other matters relating to the library;
(b) provide advice and assist in the planning and development of the library at the national level;
(c) acquire and maintain a complete collection of library resources at the national level which reflects the intellectual heritage, literature and culture of the country and also a collection of representatif nationally that reflects human knowledge and wisdom accumulated;
(d) to establish within the library of — (i) the submission Center for storage and conservation of National resources library received;
(ii) National Bibliography Centre for network maintenance, national bibliography database of national bibliography bibliography and provision of services and national documentation;
(iii) National Centre for Malay manuscripts to acquisition, documenting and utilisation of Malay manuscripts;
(e) provide reference, information, perujukan, reprography and borrowings;
8 laws of Malaysia ACT 80 (f) provides facilities in the Library to enable them to function as — (i) the national focal point for National information systems;
(ii) National Center for secondment and exchange of library resources to promote the availability of issue at the national level and universal;
(g) to promote and co-ordinate the development and use of library resources in the country;
(h) encourage and facilitate the establishment of the system of public libraries throughout the country in accordance with national standards for stage it;
(i) encourage the establishment of a network of specialized library in accordance with the national standard for stage it;
(j) encourage and facilitate national and international cooperation and sharing of resources between libraries;
(k) undertaking and facilitating research in the article about the library;
(l) provide training to improve the professionalism of the library;
(m) encourage and facilitate the cultivation of nature are fond of reading;
(n) collaborate with the relevant government agency to encourage and promote the use and development of English;
(o) to cooperate with other professional bodies and bodies at the national and international level for the development of the library;
(p) lend, sell, or in other dispose of library resources that form part of the Library;
(q) do such other things as may be deemed necessary to implement the purposes referred to in section 3.
National Library of 9 (3) such Officer as may be necessary or appears expedient for the purposes of this Act shall be appointed from time to time.
PART III The ESTABLISHMENT Of The ADVISORY BOARD The Advisory Board 5. (1) the Minister shall establish an Advisory Board (hereinafter referred to as "the Board") for the purpose of advising the Director-General on the progress of the library.
(2) the Board shall consist of the following members: (a) a Chairman who shall be appointed by the Minister;
(b) the Director General;
(c) a representative of the Ministry for the time being responsible for the library; and (d) not less than four and not more than seven other members appointed by the Minister.
(3) the Director General may appoint someone from his staff to act as Secretary of the Board shall keep a record that should be on all minutes of meetings of the Board.
(4) the Chairman and each Member of the Board appointed under paragraph (2) (d), unless his appointment is cancelled in advance, shall hold office for a term of three years and may be reappointed.
(5) the Chairman and any member of the Board appointed under paragraph (2) (d) may resign his Office by giving notice in writing to the Minister.
(5) the Minister may, at any time, revoke the appointment of the Chairman or any member of the Board appointed under paragraph (2) (d).
(6) all members of the Board shall be deemed to be public servants within the meaning of the Penal Code [Act 574].
10 laws of Malaysia ACT 80 meetings of the Board 6. (1) the Board shall meet at least once a year at any time and in any place as shall be determined by the Chairman.
(2) the Chairman and four members of the Board shall form a quorum.
(3) the Board may make its own kaedah-kaedahnya that determines the procedures of Board meetings and other matters relating thereto.
PART IV NATIONAL LIBRARY FUND The Establishment Of The National Library Fund 7. (1) for the purposes of development library, following Fund established and included in the second schedule of the financial Procedure Act 1957 [Act 61], namely: "the National Library Fund", (hereinafter referred to as "the Fund").
(2) the Fund shall be controlled and managed by the Director General in accordance with the provisions of this section.
The money that is required to be included in the Fund

8. (1) Notwithstanding the provisions of the financial Procedure Act 1957, and the Development Fund Act 1966 [Act 406], should be included from time to time into the Fund — (a) any sum of money allocated by Parliament of the development fund or otherwise for the purpose of the advancement of the library;
National Library of 11 (b) moneys received by way of donations or granting of a will for the purpose of the library (c) interest received from investment funds in the credit of the Fund;
(d) any other money received by the Government in any circumstances deemed appropriate by the Minister of finance to be put into the Fund: provided that any balance of the money received by the Government for the purpose of the library before a specified date, which should have been put into the Fund under this subsection if the money has been received on or after a specified date , shall be included in the Fund.
(2) Money referred to in paragraph (1) (a) shall be deposited in the Fund in accordance with any amount of money and at any time as directed by the Minister of finance.
The use of money Fund 9. (1) Notwithstanding the provisions of the Development Fund Act 1966, funds in the credit of the Fund can be used by the Director General for the purposes of the following: (a) payment of the price of the construction site, the construction and extension of buildings, and equipment for the library;
(b) costs for expenditure on consultations for the development of the library;
(c) costs for resources and library services acquired for the purpose of library development;
(d) any other payments for the purpose of development library.
(2) funds in the credit of the Fund may be invested in accordance with paragraph 8 (3) (a) of the financial Procedure Act 1957.

On an annual basis in the period as determined by the Treasury, the Director General shall submit to the Treasury through the Minister a statement showing the estimates of receipts and payments the Fund in respect of the following year. To support the statement of the Director-General shall submit details of the proposed development plan to be carried out by him in the year following that.
Accounts and audit 11. (1) the Director General shall cause to be kept proper accounts and maintained in respect of the Fund.
(2) immediately after the account is audited by the Director General shall submit to the Minister and the Minister of finance the audited statement of accounts together with the any opinion about it.
(3) the Minister shall cause to be audited statement of accounts together with the views, if any, set out in both the Parliamentary Council.
Part V MISCELLANEOUS Agreements regarding library services 12. The Director General may, on the terms and conditions approved by the Minister, partners or make an agreement with the authorities or persons whether in Malaysia or elsewhere concerning the Affairs of the library.
National Library of 13 transfer of library resources 13. The Minister may direct that any library resources available in custody or any Department or agency of the Federal Government or the Government of a State is transferred from the agency or Department to the library: provided that no such resource library that can be transferred from a Department or agency of a State Government to the library without prior consent from the relevant authorities of the State.
Regulations 14. The Minister may make regulations not inconsistent with this Act in respect of the completion of the appropriate functions of the Director-General and in respect of the management and control of the library and library building and, in particular, without prejudice to the generality of the above, the regulations could provide in respect of — (a) the General management and supervision of the Library;
(b) the preservation of good order and prevention of nuisance in the library building and its premises;
(c) hold a check-in or withdraw from the library or the library building of the person found to have committed any offence under this Act or the regulations made thereunder;
(d) the amount of the fine which may be imposed by the Director-General because of the damage, loss or delay in returning borrowed library and resources with respect to waive or refund the fine; and (e) the fees to be charged by the Director General for providing information services or for making copies of any library resources and in respect of exemption from explaining in full or part of the fees.
14 laws of Malaysia ACT 80 annual report 15. (1) the Director General shall as soon as possible at the end of each year prepare or cause to be prepared and submitted to the Minister an annual report regarding the progress and activities of the library.
(2) the Minister shall cause to be a copy of each report is tabled in both Parliamentary Council.
