(B) 120/2007] WHEREAS the United Nations Convention on the law of the sea was made in Montego Bay on 10 December 1982: and that Malaysia has deposited the instrument ratifikasinya on 14 October 1996 and therefore pursuant to article 308 of the Convention, the Convention have effect so far as concerned with Malaysia on 14 November 1996: SO, therefore, it enacted by the Parliament of Malaysia as follows : short title and commencement 1. (1) this Act may be cited as the base line of maritime zones Act 2006.
(2) of this Act come into force on such date as the Minister may, by notification in the Gazette.
interpretation 2. In this Act, unless the context otherwise requires — "chart" means a nautical chart that is designed specifically to meet the needs of marine navigation, shows the depth of the water, the condition of the seabed, configuration depending on elevation and coastal features, navigational hazards and assistance, in a standard format and the chart also referred to as marine or hydrographic chart chart;
6 laws of Malaysia Act 660 "line of tides" means the persilangan plane tides with the Mainland; the line along the edge of the sea or the beach during tides;
"base line" means a line of base as determined under section 5;
"Geodesy" means an arch that gives the nearest distance between two points on a surface specified;
"the height of the tides" means onshore formed naturally surrounded by water and during tides but submerged during high tide;
"marine region" means the territorial waters of Malaysia as determined in accordance with the Ordinance No. 7 (the powers necessary) Emergency 1969 [P.U. (A) 307A/1969];
"Minister" means the Minister charged with the responsibility for maritime;
"continental shelf" means Malaysia's continental shelf as defined in section 2 of the Continental Shelf Act 1966 [Act 83];
"the exclusive economic zone" means the exclusive economic zone of Malaysia as determined according to the exclusive economic Zone Act 1984 [Act 311];
"maritime zone" means the territorial sea, continental shelf and exclusive economic zone of Malaysia, or any of them, as the case may be.
The law applicable 3. (1) in the event of any conflict or inconsistency between the provisions of this Act with the provisions of any other written law, the provisions of this Act shall apply and the provisions of any other written law which is inconsistent or not in compliance shall, to the extent of that conflict or inconsistency, be deemed to be replaced.
(2) the provisions of any written law which does not conflict or in accordance with the provisions of this Act shall otherwise continue to apply.
Line the base of Maritime Zone 7 (3) of this section, the expression "law" does not include the Federal Constitution and the Constitution of the State.
Geographical coordinates of the base of the point 4. (1) the Yang di-Pertuan Agong, on the recommendation of the Minister may, by order published in the Gazette, declare the geographical coordinates of the point that the base of the base line thereof can be determined under section 5.
(2) for the purposes of subsection (1), the Yang di-Pertuan Agong may declare the geographical coordinates of the point in the base areas mentioned.
(3) an order made under subsection (1) shall be laid before each House of Parliament as soon as possible after its transmission.
Line the base of 5. (1) subject to subsection (2), the base for the purpose of determining the Malaysian maritime zone is — (a) a line of tides along the coast as marked in large scale chart;
(b) line tides seaward a reef as indicated with the appropriate symbol on the chart; or (c) a line of tides at the height of the tides, which is situated wholly or partly at a distance not to exceed the width of the territorial sea from the Mainland or an island.
(2) Notwithstanding subsection (1), in respect of any area for which geographical coordinates of the point of the base were declared under section 4, line the base of a straight line connecting the GEODESIC "defined as geographical coordinates of the point of the base sequence which has been declared as such can be used to determine the Malaysian maritime zone.
The limits of maritime zones 6. (1) the Malaysian Maritime Zone shall be measured from the base lines.
8 laws of Malaysia Act 660 (2) Notwithstanding subsection (1), the Yang di-Pertuan Agong, on the recommendation of the Minister may, by order published in the Gazette, declare the line of limitation or boundary line for the whole or any part of any Malaysian maritime zone.
(3) an order made under subsection (2) shall be laid before each House of Parliament as soon as possible after its transmission.
Map and chart 7. (1) the Yang di-Pertuan Agong may, on the recommendation of the Minister of — (a) cause prepared and issued such a map as he thinks fit showing any matter relating to the geographical coordinates of the point in the base, the base, the limitation and the Malaysian maritime zone boundaries; or (b) cause prepared and issued any large-scale chart or topographic chart appropriate for determination of the position, as he may deem fit, showing the tides along the coast line and can cause the chart shown on any other matter referred to in paragraph (a).
(2) without prejudice to the generality of paragraph (1) (a) and (b), map or chart shall be — (a) a map prepared and issued respectively by the Director-General of survey and mapping, Malaysia or charts prepared and issued by the Director General of Royal Malaysian Navy Hydrographic;
(b) dated and certified as a true copy of a map or chart that is true and correct in relation to the matters herein respectively by the Director-General of survey and mapping, Malaysia or the Director General of Royal Malaysian Navy Hydrographic; and (c) respectively are stored at the Office of the Director-General of survey and mapping, Malaysia or the Director General of Royal Malaysian Navy Hydrographic.
Line the base of Maritime Zone 9 (3) any map or chart prepared and issued under paragraph (2) (a) or (b) shall be published in the Gazette and, if necessary, in any other form as may be determined by the Yang di-Pertuan Agong, on the recommendation of the Minister.
(4) any map or chart prepared and issued under paragraph (2) (a) or (b) available to the public when the prescribed fee paid.
(5) in any proceedings before any court, any map or chart prepared and issued under subsection (1) or (2) shall be received in evidence as prima facie evidence of the contents of the map or chart.
Certificate Of Minister 8. In any legal proceedings or other proceedings, a certificate issued by or under the permission of the Minister that contains a statement that any location geograi set out in the certificate, at any material time in the proceedings, set in any Malaysian maritime zone is — (a) a final and conclusive evidence of the contents of the statement without formal proof of signature or official position of the person who is said to have issued the certificate; and (b) is admissible as evidence in the proceedings, but its production should not be a prerequisite.
Regulations 9. The Minister may make regulations as may be necessary or expedient to give effect to the provisions of this Act and the regulations may provide for any matter under this Act which are required or permitted to be prescribed or as are necessary or expedient to set.
