[Throughout Malaysia — 30 April 1971]
BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: part I preliminary short title 1. This Act may be cited as the Malaysian National Sports Council Act 1971.
Interpretation 2. In this Act, unless the context otherwise requires — "Board" means the Board of management established under section 6;
"Council" means the National Sports Council established under section 3;
"Majlis Sukan Wilayah Persekutuan" and "Majlis Sukan Negeri" respectively means the Federal Territories Sports Council and a Council of State to have been duly established under section 7;
"Minister" means the Minister responsible for sports.

A body to be called "the National Sports Council of Malaysia" was established with the power to acquire and hold property movable or immovable property, and to dispose of it or otherwise make any arrangement in respect.
The Functions Of The Council 4. (1) the functions of the Council — (a) to advise the Minister on matters relating to sport in General and the implementation of the provisions of this act properly and more effectively;
(b) to coordinate the activities in respect of sports undertaken by government departments or Government agencies or non-governmental;
(c) to make recommendations to the Government about means, measures and policies that should be taken to facilitate the advancement of sports, and if approved by the Government, to carry out and assist in implementing the recommendations; and (d) generally to promote both local and international, and participate in, sports development in Malaysia.
(2) the Council has the power to do all things expedient or reasonably necessary or incidental in the exercise of its functions, and in particular, but without prejudice to the generality of the above — (a) to carry out surveys and investigations in respect of sports;
(b) to carry out feasibility studies for the development of sport;

(d) to participate or assist in the advancement of sports, and in convening or improve sports facilities in and outside Malaysia, where international cooperation can mempergiat progress of sports in Malaysia;
(e) with the approval of the Minister after consultation with the Minister of finance, to make equity participation in the advancement of sports industry, and holds the city's main sports facilities and attractions;
(f) subject to the provisions of any regulations made under section 15, to control standards will be maintained by sport;
(g) to acquire, purchase, lease, lease, hold and enjoy any kind of movable and immovable property and memindahhakkan, assign, return, and return, mortgage, charge, pledge, assign the mendemis, transferred or other disposal of, or make any arrangement or develop any property, movable or immovable property owned by the Council in accordance with the conditions as the Board may think fit;
(h) to make any contract;
(i) to receive, in return for services rendered by him, Commission or fee as agreed;
(j) to do all such functions and powers and perform all the duties vested on or delegated to it under or by virtue of any written law; and (k) generally to do such acts as may be thought fit by it for the purpose of achieving any of the aforesaid purposes.
029B. FM Page 7 Monday, March 27, 2006 5:35 PM 8 laws of Malaysia ACT 29 Council members 5. (1) the Council shall consist of members set out in subsection (2) and (3).
(2) the Minister shall be the Chairman of the Council.
(3) other Council members shall be appointed by the Minister and shall consist of the following: (a) one representative nominated by the Federal Territories Sports Council and by each State Sports Council;
(b) three representatives nominated by the Olympic Council of Malaysia;
(c) a representative nominated by schools Sports Council Malaysia;
(d) not less than five but not more than ten members appointed from amongst persons who in the opinion of the Minister may contributed to the growth and development of sport; and (e) not less than three but not more than five members, appointed from among the Ministry deemed by the Minister should be represented.
(4) part I of the first schedule shall apply to Council members.
PART III The BOARD Of MANAGEMENT The Board Of Management 6. (1) the management of the Affairs of the Council shall be vested in the Board of management consists of the Chairman of the Council who shall also be the Chairman of the Board and no less than six but not more than ten members, appointed by the Minister in the manner specified in subsection (2).
029B. FM Page 8 Monday, March 27, 2006 5:35 PM the National Sports Council of Malaysia 9 (2) Board members shall be appointed as follows: (a) four members from the person who became a member of the Council appointed under section 5;
(b) a representative of the Ministry of youth and sports and a representative of the Ministry of finance; and (c) any other person deemed fit and proper to be a member of the Board.
(3) in any meeting of the Board of one-third of the number of members of the Board shall constitute a quorum.
(4) part II of the first schedule shall apply to members of the Board.
PART IV of the FEDERAL TERRITORIES SPORTS COUNCIL and the establishment of Regional Sports Council Federal and State 7. (1) a Federal Territories Sports Council shall be established in the Federal District and in every State a State Sports Council in respect of which the provisions of the Second Schedule shall be in force.
(2) all provisions of this Act which mentions or apply to a State Sports Council shall, with such modifications as may be required by the circumstances, be deemed to be mentioned or used for Federal territory Sports Council.
Minister's power to make modifications to the provisions of Act 7A. (1) the Minister may by order make such modifications may deem necessary to the provisions of this Act, when applicable to the Federal District Sports Council and the Majlis Sukan Negeri Sabah and Sarawak focusing in General to circumstances in the Federal District and in the States of Sabah and Sarawak and in particular to availability 029B. FM Page 9 Monday, March 27, 2006 5:35 PM 10 laws of Malaysia ACT 29 spaces, by whatever name called, in the Federal District and the States of Sabah and Sarawak.
(2) the Minister may by order amend the first and second schedules.
Part V ADMINISTRATION appointment of Director General and other servants of the Board 8. (1) the Board may appoint a Director General who are responsible for the Administration and management of the daily affairs of the Council and for carrying out the duties and exercise the powers as entrusted or delegated by the Board or the Chairman of the Board when acting on behalf of the Board: provided that the Director-General first immediately after the commencement of this Act shall be a person appointed by the Minister.

(2) the Board may appoint such other officers and servants as he may deem necessary to carry out the Council's Affairs efficiently.
(3) the Director General, officials and other servants of the Board is responsible to the Board.
(4) the Director-General, Council officers and servants shall hold office for a term, receive salaries and allowances and subject to the conditions of service as may be prescribed by the Board.
PART VI FINANCIAL Fund Council 9. For the purposes of this Act, it is hereby established a national sports Fund (hereinafter called "the Fund") to be administered and controlled by the Board — 029B. FM Page 10 Monday, March 27, 2006 5:35 PM the National Sports Council of Malaysia 11 (a) that it will be — (i) monies allocated from time to time by Parliament;
(ii) money borrowed from time to time by the Board on terms and conditions approved by the Minister after consultation with the Minister of finance for the purpose of discharge of any liabilities or exercising any of his duties;
(iii) all monies earned from carrying out any projects, plans or enterprises financed out of the Fund;
(iv) all monies earned or arising from any property, investments, mortgages, charges or debentures acquired by or vested in the Board;
(iva) all grants, donations and bekues from individuals, companies, foundations and other sources; and (v) all monies or other property that may in any way due to, or vested in, the Board in respect of any matter incidental to the powers and obligations;
(b) which of them will be paid — (i) all expenses (including capital expenditure) conducted by the Board in carrying out its functions; and (ii) the money to repay any loan that has been given to the Board in accordance with its powers to borrow.
Power to borrow 10. The Board may, in accordance with conditions approved by the Minister after consultation with the Minister of finance, borrow money as much as is needed by him to carry out any of its functions under this Act.

The assets of the Board shall, to the extent the assets are not required to be expended by the Board under this Act, be invested in such manner as approved by the Minister: provided that the Board shall not make any investment in securities issued or registered or in other property situated outside Malaysia except with the agreement of the Minister of finance.
Estimated expenses 12. (1) the Expenses of the Board in so far as the amount that is allowed by the Minister for any one year shall be paid out of the Fund.
(2) before the beginning of the month of September each year, the Board shall submit to the Minister an estimate of expenses (including expenses for development projects) for the year re ikutnya in such form and containing such particulars as may be required by the Minister; and the Minister shall before the beginning of November of that year, told the Board the amount of money authorized for expenditure generally or the amount of money allowed for each type of expenditure.
(3) the Board may, at any time, transmit to the Minister a supplementary estimate for any one year and the Minister may allow the whole or any part of the additional expenditure is included in the supplementary estimates.
Accounts and audit 13. (1) the Board shall keep proper with all accounts and other records in respect of commissioning and shall prepare a statement of accounts for each financial year.
(2) the accounts of the Board shall be audited every year by National Auditors or other auditors appointed by the Board with the consent of the Minister.

FM Page 12 Monday, March 27, 2006 5:35 PM the National Sports Council of Malaysia 13 (3) the accounts of the Board shall be audited within six months from the end of each financial year and during that period, the Board shall cause a copy of the statement of accounts required by the Minister sent to the Minister, together with a copy of any observations made by the Auditors of the other country or by auditors appointed under subsection (2) of any statement or on the accounts of the Board.
PART VII GENERAL Annual Report 14. The Council shall, not later than the 30th day of June of each year, cause to be made and sent to the Minister, a report with respect to the activities of the Council in the past year and containing any information relating to the conduct and Policy Council.
Regulations 15. The Minister may make regulations as may be expedient or necessary for fixing something that is required by this Act and to carry out the provisions of this act better.
Confidentiality and penalties 16. (1) except for the purposes of this Act or for the purposes of a criminal proceedings under this Act, no person shall members, officers or servants of the Council may disclose any information relating to any one business which has been found by him while performing his duties and who is not published in accordance with this Act.
(2) any Member who knowingly violates subsection (1) commits an offence and apabi la conviction, be liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding one year.
029B. FM Page 13 Monday, March 27, 2006 5:35 PM 14 laws of Malaysia ACT 29 of the Penal Code 17. The Director-General and any other officials or servants of the Council appointed under section 8 shall be deemed to be public servants within the meaning of the Penal Code [Act 574].
Protection against legal proceedings 18. (1) no action, suit, prosecution or other proceedings can be brought or instituted on the nature of yourself a member of the Council or the Board or the Director-General, Council staff or Board or against a person's directors, officers or servants who are appointed by the Board in respect of an act done or a bona fide statement made pursuant to or in furtherance of or for the purpose of implementing this Act.
(2) If a person is exempted from liability alone-points by virtue of the provisions of this section, the Council be liable to the extent that the Council be liable if that person a servants or agents of the Council.
Delegation by the Board 19. The Board may, by an instrument in writing, delegate to any person or any body any of its duties to be carried out inside or outside Malaysia: provided that a person or any body that does not have any power to organize the Fund and shall perform his duties in a self-contained item according to the instructions of the Board.
Directions by Minister 20. (1) the Minister may give the Council or the Board something instructions as he may deem fit, which is not inconsistent with the provisions of this Act regarding the conduct and the implementation by the Council or the Board will powers, duties and functions under this Act, and the Council or the Board shall perform all such directions.
029B. FM Page 14 Monday, March 27, 2006 5:35 PM the National Sports Council of Malaysia 15 (2) the Board shall give the Minister such information as may be required from time to time in respect of the property and its activities.
Disqualified to be employed as an officer of the Council 21. (1) No person who has, directly or indirectly, by itself or through its, a share or interest in a contract with, for or on behalf of the Council can be employed as an officer or servant of the Council.
(2) an officer or servants who are appointed by the Board and who has or acquires a share or interest that may, in the discretion of the Board, dismissed without notice.
The FIRST SCHEDULE part I [Subsection 5 (4)] of the COUNCIL 1. The terms of Office for Council members except the Chairman is for a term of two years. Members can be reappointed.
2. the term of Office of a member appointed to fill a vacancy is for the remainder of the term of Office of the members clear the posts.
3. All the expenses of the Tribunal shall be paid out of the Fund.
4. The Office of a member of the Council other than a member appointed as positions shall be emptied — (a) if he dies;
(b) if he no longer qualified;
(c) if he becomes bankrupt, crazy or not of unsound mind;
(d) if he fails to attend three consecutive meetings without the permission of the Council; or (e) if his resignation is accepted by the Minister.
5. subject to the provisions of this Act, the Council may regulate its own procedure.
029B. FM Page 15 Monday, March 27, 2006 5:35 PM 16 laws of Malaysia ACT 29 SECTION II [Subsection 6 (4)] MANAGEMENT BOARD 1. Member of the Board, except the Chairman shall hold office for a period of two years and may be reappointed.
2. The Office of a member of the Board shall be emptied — (a) if he dies;
(b) if he no longer qualified;
(c) if he becomes bankrupt, crazy or not of unsound mind;
(d) if he fails to attend three consecutive meetings without the permission of the Board; or (e) if his resignation is accepted by the Minister.
3. the term of Office of a member appointed to replace a member of the other vacated his post is for the remainder of the term of Office of the members then the originally appointed.
4. Chairman of the Board has the power to call a meeting of the Board when it considers necessary.
5. Subject to the provisions of this Act the Board may regulate its own procedure.
SECOND SCHEDULE [Subsection 7 (1)]

Rules For The ESTABLISHMENT Of The NATIONAL SPORTS COUNCIL Of MALAYSIA States Interpretation 1. In the interpretation of these rules and any by-laws made thereunder, unless the context otherwise requires — "Committee" means the Management Committee appointed under rule 9;
"Council" means the Council of State;

FM Page 16 Monday, March 27, 2006 5:35 PM the National Sports Council of Malaysia 17 "Sports Council District" means a District Sports Council was established in the State by the State Sports Council or for the Federal territory, the States of Sabah and Sarawak, each Sports Council administrative region;
"Director" means the Director of the State Sports Council appointed under subrule 10 (1);
"The State Sports Association" means any associations, clubs, foundations or other body that carries out specific controls over any branch of sports in the State of the entire State.
Name 2. This Council shall be named "MAJLIS SUKAN NEGERI".
The Purpose Of The Council 3. The purpose of the Council — (a) to advance the importance of sport in General in the State and in particular hold enough facilities for the advancement of all branches of sports at the State and district levels;
(b) to effect a coordination of all State sports associations and other sports agencies in the State; and (c) to obtain and administer funds to achieve the purpose of the Council in relation to the National Sports Council of Malaysia.
The Functions Of The Council 4. The functions of the Council — (a) to carry out the purposes of the Council;
(b) to set up District Sports Council for holding enough facilities for the promotion of sports at district level;
(c) to make recommendations to the State Government about how, measures and policies that should be taken to facilitate the advancement of sports, and if approved by the Government, to carry out and assist in implementing the recommendations; and (d) to take all steps it deems necessary to achieve the purpose of the Council properly.
The Power Of The Council 5. The Council shall have power to do all things expedient or reasonably necessary or related but without prejudice to the generality of the method mentioned earlier — 029B. (b) to require government departments and agencies and non-governmental governing sports so that send reports in respect of its activities;
(c) to participate or assist in the development of sports and provide or improve sports facilities;
(d) to acquire, purchase, lease, lease, hold and enjoy any kind of movable and immovable property and memindahhakkan, assign, return and return, mortgage, charge, pledge, assign the mendemis, transferred or other disposal of, or make any arrangement or develop any property, movable or immovable property owned by the Council in accordance with the terms and conditions as may be deemed necessary by the Council;
(e) to make a contract;
(f) to receive, in return for services rendered by him, Commission or fee as agreed; and (g) generally to do such acts as may be thought fit by it for the purpose of achieving any of the purposes mentioned earlier.
Membership Of The Council 6. Membership is open to any State or sports associations Sports Council District in the State.
Members Of The Council 7. (1) the Council shall consist of the following: * (a) the Chairman who shall be appointed by the Minister to consult with the Menteri Besar or Chief Minister of the State;
* * (b) two Deputy Chairman appointed by the Menteri Besar or the Chief Minister of the State, one of whom was State Secretary;
* NOTE — In its application to the Federal Territories Sports Council has been modified and replace it with "the Chairman who shall be appointed by the Minister;" – see order of the National Sports Council of Malaysia (Modification) Order 1988 [P.U. (A) 367/1988]. * * NOTE — In its application to the Federal Territories Sports Council has been modified and replace it with "two Deputy Chairman appointed by the Minister, one of whom is the Chief Secretary or his/her representative;" – see [P.U. (A) 367/1988].

(d) the Chairman of each District Sports Council;
* (e) State Education Department Director, or his/her representative;
* * (f) State Finance Director or his/her representative;
* (g) the Director of the State youth and sports department or his/her representative; and (h) not less than three and not more than six persons who in the opinion of the Chairman may contributed to the growth and development of the sport.
(2) Council members, except the Chairman, shall be appointed by the Minister, the Menteri Besar or Chief Minister for a term of two years and may be reappointed.
(3) in the event of an unexpected vacancy in the Council under subparagraph (c) and (d), the appropriate authority shall appoint a person to fill the vacancy.
(4) in the event of an unexpected vacancy in the Council under subparagraph (h), the Chairman shall appoint any person to fulfill the vacancy.
Meetings Of The Council 8. (1) the Council shall meet at least once every 3 months or more frequently as deemed necessary.
(2) at least fourteen days notice shall be given to members.
(3) one-third of the members of the Council who were present and entitled to vote at the meeting shall constitute a quorum.
(4) every Member of the Council present shall be entitled to one vote.
(5) if the same number of votes, the Chairman shall be entitled to deliver many votes a second or casting vote.
(6) the Chairman shall preside at all meetings of Council and Committee meetings. If the Chairman is one of the Deputy Chairman is required to be Chairman of the meeting. If the Deputy Chairman is present, the members present shall elect one of them to be Chairman of the meeting.

029B. FM Page 19 Monday, March 27, 2006 5:35 PM 20 laws of Malaysia ACT 29 Management Committee 9. (1) the management of the Council's Affairs vested in the Management Committee which consists of — (a) the Chairman;
(b) two Deputy Chairman in accordance with paragraph 7 (1) (b);
(c) four members appointed under paragraph 7 (1) (c);
(d) two members appointed under paragraph 7 (1) (d);
* (e) State Education Department Director, or his/her representative;
* * (f) State Finance Director or his/her representative;
* (g) Director of youth and sports; and (h) no more than three other persons who in the opinion of the Chairman may contributed to the growth and development of the sport.
(2) the Committee shall meet at least once in 3 months and seven days written notice thereof shall be given to all members.
(3) the Committee shall be responsible for carrying out the functions and administration of the Affairs and business of the Council.
(4) in any Committee meeting one-third of the number of members of the Committee shall constitute a quorum.
(5) a member of the Committee who do not attend meetings three times in a row, either without cause the satisfaction or ipso facto unauthorised Committee cease to be a member of the Committee.
(6) in the event of a vacancy in the Committee, the Committee shall appoint a person to fill the vacancy.
The Council Administration 10. (1) the Committee may appoint a Director to be responsible for the Administration and management of the daily affairs of the Council and for carrying out as entrusted or delegated by the Committee or the Chairman of the Committee when acting on behalf of the Committee.

029B. FM Page 20 Monday, March 27, 2006 5:35 PM the National Sports Council of Malaysia 21 (2) the Committee may appoint such other officers and servants as he may deem necessary to carry out the Council's Affairs efficiently.
(3) directors, officers and other servants Council is responsible to the Committee.
(4) directors, officers and servants of the Council shall hold office for a term, receive salaries and allowances and subject to the conditions of service as may be prescribed by the Committee.
Financial Fund 11. For the purposes of this schedule, are hereby established a State Fund that will be administered and controlled by the Committee — (a) that it will be added — * (i) monies allocated from time to time by the State authority;
* * (ii) all monies earned from carrying out any projects, plans or enterprises financed by the Fund;

(iii) moneys borrowed from time to time by the Council on the terms and conditions approved by the Minister after consultation with the Minister of finance and the State authority for the purposes of discharge of any liabilities or exercising any of his duties;
(iv) all monies earned or arising from any property investments, mortgages, charges or debentures acquired by or vested in the Council; and (v) all grants, donations and bekues from individuals, companies, foundations and other sources;
(b) which of them will be paid — (i) all expenses incurred by the Council to carry out its functions; and * RECORDS — In its application to the Federal Territories Sports Council has been modified and replace it with "money allocated from time to time by the Federal Government;" – see [P.U. (A) 367/1988]. * * NOTE — In its application to the Federal Territories Sports Council has been modified and replace it with "money borrowed from time to time by the Council on terms and conditions approved by the Minister of finance and the Federal Government for the discharge of any of its obligations or exercising any of his duties;" – see [P.U. (A) 367/1988].

Power to borrow * 12. The Committee may, in accordance with conditions approved by the Minister, after consultation with the Minister of finance and the State authority to borrow money as much as is needed by him to carry out any of its functions under this Act.
Estimated expenses 13. (1) the Council shall prepare estimates for each financial year and this expense shall be paid from the funds of the State. Estimates of the expenditure shall be approved by the Minister, the Menteri Besar or Chief Minister of the State.
(2) the Director is responsible for keeping all money of the Council that should be deposited in a bank approved by the Chairman.
(3) all cheques issued on account of the Council shall be signed by the Director and approved by the Committee.
(4) the financial year is 1st January to 31st December.
Accounts and audit 14. (1) the Council shall keep properly all accounts and other records in respect of commissioning and shall prepare a statement of accounts for each financial year.
(2) the accounts of the Council shall be audited annually by the Auditor General or his/her representative, State Auditor or auditors appointed by the Council with the consent of the Minister, the Menteri Besar or Chief Minister of the State.
(3) the accounts of the Council shall be audited within 6 months from the end of each financial year and during that period the Committee shall direct that a copy of the statement of accounts required by the Minister, the Menteri Besar or Chief of State is sent to him along with a copy of any observations made by the State Auditor or Auditors appointed by the Committee.
* NOTE — In its application to the Federal Territories Sports Council has been modified and replace it with "the Committee may, in accordance with conditions approved by the Minister, after consultation with the Minister of finance and the Federal Government borrow money as much as is needed by him to carry out any of its functions under this Act." – see [P.U. The Council shall, not later than the 30th day of June of each year, cause to be made and sent to the Minister, the Menteri Besar or Chief Minister of a report in respect of the activities of the Council in the past year and containing any information relating to the conduct and Policy Council.
Confidentiality and Penalties 16. (1) except for the purposes of this Act or the purpose of a criminal proceedings under this Act, no person shall members, officers or servants of the Council may disclose any information relating to any one business which has been found by him while performing his duties and who is not published in accordance with this Act.
(2) any Member who knowingly violates the provisions of paragraph (1) commits an offence and shall on conviction be liable to a fine not exceeding five thousand ringgit or to imprisonment for a term not exceeding one year.
17 Of The Penal Code. All members and any officers or servants of the Council shall be deemed to be public servants within the meaning of the Penal Code.
Am 18. Subject to the provisions of this Act, the Council may regulate its own procedure.
