WHEREAS the Convention on international trade of endangered species of Wild Flora and Fauna Threatened was signed in Washington D.C. on 3 March 1973: and that Malaysia has deposited the instrument kesertaannya on October 20, 1977 and is therefore in accordance with Article XXII of the Convention, the Convention have effect so far as concerned with Malaysia on 18 January 1978: THEN, therefore, enacted by the Parliament of Malaysia as follows : part I preliminary short title and commencement 1. (1) this Act may be cited as the Act of international trade in endangered species, 2008.

(2) Akta ini mula berkuat kuasa pada tarikh yang ditetapkan oleh Menteri melalui pemberitahuan dalam Warta.
8 Undang-Undang Malaysia AKTA 686 Akta hendaklah dibaca bersama-sama dengan undang-undang Lain 2. (1) Akta ini hendaklah dibaca bersama-sama dengan mana-mana undang-undang bertulis lain yang berhubungan dengan import dan eksport, pemuliharaan tumbuhan, hutan dan haiwan dan perdagangan mengenai spesies terjadual, dan peruntukan Akta ini hendaklah menjadi tambahan kepada, dan tidak mengurangkan, peruntukan undang-undang bertulis lain itu.

(2) Sekiranya terdapat apa-apa ketidakselarasan antara peruntukan Akta ini dengan mana-mana undang-undang bertulis lain yang disebut dalam subseksyen (1), peruntukan Akta ini hendaklah terpakai.


Tafsiran 3. In this Act, unless the context otherwise requires — "this Act" includes any subsidiary legislation made under this Act;

"a simple part or derivative of an animal known" means any large section complete or part or derivative of an animal, which is in the form of natural, stuffed, didinginkan, diawetkan, dried, processed or otherwise treated or prepared that can or cannot be is contained in preparations, and includes — (a) the meat, bones, skin, belulang, canine, deer horns, horns, glands, hairs fronds, wool, teeth, claws, shells , sisik and eggs;

(b) tissue, blood, fat, oil, milk, can, saliva, urine and feces;

(c) any chemical compounds arising from any referred to in paragraph (a) or (b); and international trade on Endangered Species 9 (d) any substance that is claimed by any person, or obtained from an accompanying document, the packaging, a label or mark or of any other circumstances, as containing a part or derivative of an animal;

"a part or derivative of a simple known plant" means any large section complete or parts, tissue or derivative of a plant, in the form of a natural, diawetkan,

dried, processed or otherwise treated or prepared that can or cannot be is contained in preparations, and includes — (a) seeds, stems, leaves, wood, bark, roots, flowers, fruits, timber or lenggai;

(b) any chemical compounds arising from parts, tissue or extract thereof; and (c) any substance that is claimed by any person, or obtained from an accompanying document, the packaging, a label or mark or of any other circumstances, as containing a part or derivative of a plant;

"in transit" have the same meaning as given to him by the Customs Act 1967 [Act 235];

"dibiakbakakan in brackets" refer only to children, including eggs, born or otherwise produced in a controlled environment from the parent that is installed or otherwise transferred in a controlled environment gametnya;

"dibiakkan secara buatan" merujuk kepada apa-apa — (a) tumbuhan, ertinya tumbuhan yang tumbuh di bawah keadaan terkawal daripada biji benih, keratan, bahagian, tisu kalus atau tisu lain, spora atau propagul lain yang sama ada dikecualikan atau telah dihasilkan daripada stok induk yang ditanam; 10 laws of Malaysia ACT 686 (b) animals means animals that are bred under controlled environment by way of deduction and distribution;

"prescribed" means prescribed by regulations made under this Act;

"export" means bring or cause to be taken out from Malaysia through land, sea, inland waters or air any scheduled species, but excluding re-exports;

"re-export" means export of any scheduled species previously imported;

"animal" means any animal in the Animal Kingdom, and includes — (a) any mammal (other than humans), birds, reptiles, amphibians, fish, mollusks, arthropod, or vertebrata or other invertebrata, whether living or dead, and eggs, which his youth or not maturity; and (b) any part of an easily recognizable or derivative of an animal;

"import" means to bring or cause to be brought into Malaysia through land, sea, inland waters or air any scheduled species apart from any scheduled species in a stopover in Malaysia;

"controlled" means a non-natural environment that is intensively manipulated through human mediation for the purpose of plant production and may include but not limited to, application, control pembajakan weeds and pests, irrigation, or nursery operating as pemasuan, restriction or protection from the weather;

International trade of 11 endangered species "quota" means a specified quantity or number of any scheduled species which can be exported or otherwise used during a certain period of time;

"bring in from the sea" means transportation into Malaysia any scheduled species taken from the marine environment not under the jurisdiction of any country, including the airspace above the sea, seabed and soil ground under the sea;

"advertise" in respect of scheduled species, means describes, makes reference or refer in any way, by any method or in any form, to the scheduled species — (a) either directly or indirectly;

(b) either orally, in writing, the schematic, a valid photo ID, through the use of symbols or photographs, or in any combination of them; or (c) either through common name or scientific name of the scheduled species or otherwise;

"Minister" means the Minister charged with the responsibility for natural resources and environment;

"enforcement officers" means — (a) an enforcement officers specified in the first column of the second schedule;

(b) any police officer of Inspector not meteoric, including Inspector who is in the trial period; or (c) any Customs Officer as defined in section 2 of the Customs Act 1967;

"registration" means the registration of approved by the management authority under subsection 16 (2);

"carrier" means any vehicle, vessel, ship, aircraft or any other means of transportation, whether by air, sea or land;

"certificate" means a certificate issued by the management authority under subsection 16 (2);

"permit" means a permit issued by the management authority under subsection 16 (2);

"controlled environment" including an environment that is manipulated for the purpose of producing specimens of an animal species which has boundaries designed to prevent animals, eggs or gamet the animal from entering or leaving that particular environment, and which characteristics generally that may include but not limited to home-made, waste removal, health care, protection from predators, and food supplied imitation;

"Management authority" means management authority as specified in the first schedule;

"Scientific Authority" means a person or a body appointed by the Principal Scientific Authority under subsection 8 (2);

"premises" includes any huts, sheds, structures, platforms, houses, buildings, transport and land is either enclosed or built on it or not;

"scheduled species" means any animal or plant, including any part that is easily known or derivative of an animal or plant that may be specified in the third schedule;


"the master stock planted" means a group of plants grown under controlled conditions used for reproduction, in such manner as not to affect the survival of the plant species in the forest or natural habitat and maintained in sufficient quantities for reproduction so that minimize or eliminate the need to pengimbuhan from forest or natural habitat, with the pengimbuhan occur only as an exception and is limited to the amount necessary to maintain fitness and productivity the master material;

"plant" means any plant in the vegetation, whether living or dead, and any part or derivative of a simple known plants.


PART II of the AUTHORITY the principal management authority 4. The Ministry is responsible for natural resources and the environment shall be the management authority for the purposes of this Act.



14 laws of Malaysia ACT 686 key management authority functions 5. Key management authority functions are — (a) to coordinate the implementation and enforcement of this Act by the Management Authorities and Scientific Authorities;

(b) to communicate with all other countries and the Secretariat of the Convention on all matters under this Act;

(c) to cause the nation's obligations under the Convention are met;

(d) to create awareness and provide training, education and information relating to the Convention;

(e) to perform such other matters as may absolutely deem fit to enable it to perform its functions effectively or incidental to the performance of its functions.


Management Authority 6. (1) management authority as specified in the first column of the first schedule shall have jurisdiction with respect to plants, animals or any combination of plants and animals including sections known or the issuance of plant or animal is in the area of the respective second and third space appearing.
(2) the Minister may by order published in the Gazette amend the first schedule.
(3) Notwithstanding subsection (2), the Minister shall obtain the consent of the State authority of Sabah or Sarawak before making any amendment to Schedule first, if management authority is located in the State of Sabah or Sarawak.
International trade of 15 endangered species the functions and powers of the management authority 7. (1) the functions of the management authority are — (a) to maintain the records international trade of scheduled species and reports on annual and biennial in respect of the trades, and submit the report to the principal management authority on or before such date as may be determined by the Primary Management Authorities;

(b) to form the Rescue Centre;
(c) to inform the principal management authority within reasonable period of offence committed under this Act; and (d) to perform such other matters as may absolutely deem fit to enable it to perform its functions effectively or incidental to the performance of its functions.
(2) Pihak Berkuasa Pengurusan hendaklah mempunyai kuasa untuk mengeluarkan permit atau perakuan, atau membenarkan pendaftaran di bawah Akta ini.

(3) Pihak Berkuasa Pengurusan boleh berunding dengan dan mendapatkan nasihat Pihak Berkuasa Saintifik dalam melaksanakan kuasa dan fungsinya di bawah Akta ini.


Pihak Berkuasa Saintifik Utama dan Pihak Berkuasa Saintifik 8. (1) Pihak Berkuasa Pengurusan Utama hendaklah menjadi Pihak Berkuasa Saintifik Utama.

(2) Pihak Berkuasa Saintifik Utama boleh melantik apa-apa bilangan Pihak Berkuasa Saintifik sebagaimana yang perlu untuk 16 Undang-Undang Malaysia AKTA 686 memberikan nasihat tentang perdagangan antarabangsa mengenai spesies terjadual.


Fungsi Pihak Berkuasa Saintifik 9. The scientific authority shall advise the Principal management authority and management authority on international trade regarding the scheduled species of — (a) the trade effects of scheduled species survival;

(b) the quota for the export of scheduled species;
(c) proper care of any scheduled species live for imported or stored in Malaysia;

(d) the measures to be taken when the harvest scheduled species threatening kemandiriannya;

(e) the appropriate treatment of any scheduled species seized or confiscated;

(f) the method of disposal of any scheduled species seized or confiscated; and (g) such other matters as may absolutely deem fit to enable it to perform its functions effectively or incidental to the performance of its functions.








International trade of Endangered Species 17 PART III SCHEDULED SPECIES TRADE Import and export 10. Any person who import or export any scheduled species without a permit commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding one hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed one million dollars on agregatnya, or to imprisonment for a term not exceeding seven years or to both;

(b) if that person is a body corporate, a fine not exceeding two hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed two million dollars at agregatnya.


Re-exports and brought in from the sea 11. Any person who exports or brought in from the sea of any scheduled species without certificate commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding one hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed one million dollars on 18 laws of Malaysia ACT 686 agregatnya , or to imprisonment for a term not exceeding seven years or to both;


(b) if that person is a body corporate, a fine not exceeding two hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed two million dollars at agregatnya.


Possession of scheduled species 12. Any person who — (a) have in his possession or under his control;
(b) sell, offer or expose or advertise for sale; or (c) exhibit to the public, any scheduled species that have been imported or brought in from the sea in contravention of section 10 or 11 commits an offence and shall, on conviction — (aa) if that person is an individual, to a fine not exceeding one hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed one million dollars at agregatnya , or to imprisonment for a term not exceeding seven years or to both;
(bb) if that person is a body corporate, a fine not exceeding two hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed two million dollars at agregatnya.
Perdagangan Antarabangsa mengenai 19 Spesies Terancam Spesies terjadual dalam persinggahan 13. (1) every species scheduled in a stopover in Malaysia should be accompanied by — (a) an export permit or re-export, licence, certificate or authorization that is valid, as the Convention, issued by the competent authorities of the exporting country or exporting the scheduled species, as the case may be; and (b) if required by the importing country or destination on the scheduled species, an import permit, licence, certificate or authorization that is valid, as the Convention, issued by the competent authorities of the country or destination.

(2) any owner, importer, exporter or the exporter who contravenes subsection (1) commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding one hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed one million dollars at agregatnya , or to imprisonment for a term not exceeding seven years or to both;

(b) if that person is a body corporate, a fine not exceeding two hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed two million dollars at agregatnya.




20 laws of Malaysia ACT 686 Breeding or breeding species scheduled 14. (1) any person producing animal dibiakbakakan in brackets or plants or animals that are bred artificially from any scheduled species for the purpose of commercial trade without registered with management authority commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding one hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant the scheduled species, but the fine shall not exceed one million dollars on agregatnya, or to imprisonment for a term not exceeding seven years or to both;

(b) jika orang itu ialah suatu pertubuhan perbadanan, didenda tidak melebihi dua ratus ribu ringgit bagi setiap haiwan, tumbuhan, atau bahagian yang mudah dikenali atau terbitan haiwan atau tumbuhan, spesies terjadual itu tetapi denda itu tidak boleh melebihi dua juta ringgit pada agregatnya.

(2) any person who — (a) have in his possession or control;
(b) sell, offer or expose or advertise for sale; or (c) exhibit to the public, any scheduled species were produced in contravention of subsection (1) commits an offence and shall, on conviction — (aa) if that person is an individual, to a fine not exceeding one hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species about 21 international trade endangered species but the fine shall not exceed one million dollars at agregatnya , or to imprisonment for a term not exceeding seven years or to both;

(bb) if that person is a body corporate, a fine not exceeding two hundred thousand dollars for each animal, plant, or a part or derivative simple known animal or plant, the scheduled species but the fine shall not exceed two million dollars at agregatnya.


The power to require that scheduled species to mark, etc.

15. (1) the management authority may require any owner, importer, exporter or exporters of the scheduled species to brand, to label or otherwise indicate any scheduled species to the satisfaction of the management authority.

(2) Notwithstanding subsection (1), the management authority may brand, label or mark any of the scheduled species.

(3) any person who contravenes any of the requirements of the management authority under subsection (1) commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both;

(b) jika orang itu ialah suatu pertubuhan perbadanan, didenda tidak melebihi satu ratus ribu ringgit.

(4) any person who alters, defaces, falsify, destroy, erase, remove or in any way interfere with any brand, label or mark of 22 laws of Malaysia ACT 686 referred to in subsection (1) or (2) without the approval of the management authority in advance commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both;


(b) if that person is a body corporate, a fine not exceeding two hundred thousand dollars.

(5) in this section, a reference to label or mark the scheduled species including a reference to the following: (a) in the case of a plant — (i) the labelling or marking of the container in which it is stored or grow plants; or (ii) placement of the labels or tags on the plant; and (b) in the case of an animal — (i) pengimplanan device can scan in the animal;

(ii) placement of the loop at any part of the animal;

(iii) resignation (whether by puncturing or otherwise) tags, tattoos or ring at any part of the animal; or (iv) the labelling or marking of containers in which the animal is kept.




International trade of Endangered Species 23 PART IV permits, CERTIFICATION and REGISTRATION permits, certification and registration 16. (1) Suatu permohonan bagi — (a) permit untuk mengimport atau mengeksport mana-mana spesies terjadual;
(b) the certificate to export again or bring in from the sea of any scheduled species; and (c) registration to produce animal dibiakbakakan in brackets or plant or animal bred artificially from any scheduled species for the purpose of commercial trade, shall be made to the management authority, in accordance with any form specified by the Management Authorities and together with the prescribed fee.

(2) management authority may, after considering an application under subsection (1) — (a) issue or refuse to issue a permit to import or export any scheduled species;

(b) issue or refuse to issue a certificate for re-export or brought in from the sea of any scheduled species; and (c) permit or refuse to allow the registration to produce animal dibiakbakakan in brackets or plant or animal bred artificially from any scheduled species for the purpose of commercial trade.
24 laws of Malaysia ACT 686 (3) where the management authority decides to issue the permit or certificate, registration or permit under subsection (2), the management authority may impose such conditions as it thinks fit.

(4) any person who fails to comply with or contravenes any condition imposed under subsection (3) commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding two hundred thousand ringgit or to imprisonment for a term not exceeding ten years or to both;

(b) if that person is a body corporate, a fine not exceeding four hundred thousand dollars.


Pembatalan permit, perakuan atau pendaftaran 17. (1) the management authority may at any time revoke any permit, certificate or registration if the management authority is satisfied that — (a) the holder of a permit, certificate or registration that does not comply with any provisions of this Act;

(b) the holder of a permit, certificate or the registration has violated any condition of the permit, certificate or registration;

(c) permit or certificate has been issued, or the registration has been granted as a result of information that is false, misleading or inaccurate;

(d) permit, certificate or the registration obtained in improper or unlawful; or (e) the holder of a permit, certificate or registration has been convicted of an offence under this Act.

International trade of 25 endangered species (2) if the management authority cancel the permit, certificate or registration under subsection (1), the management authority shall forthwith notify the holder of the permit, certificate or registration of it.

(3) where the management authority has informed the holder of a permit, certificate or of the registration of the cancellation of the permit, certificate or registration, permit, certificate or registration it shall forthwith surrender the permit, certificate or documents pertaining to the registration to the management authority;

(4) any holder of a permit, certificate or registration, without reasonable excuse, contravenes subsection (3) commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both;

(b) if that person is a body corporate, to a fine not exceeding one hundred thousand ringgit.


Pembiakbakaan dalam kurungan atau pembiakan buatan 18. (1) any person who is registered with Management Authorities to produce animal dibiakbakakan in brackets or plant or animal bred artificially from any scheduled species shall keep and maintain records of stock and their transactions.

(2) management authority can examine, at any time, the premises and records of any person registered with the management authority.

(3) any person who contravenes subsection (1) commits an offence and shall, on conviction — 26 laws of Malaysia ACT 686 (a) if the person is an individual, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both;

(b) if that person is a body corporate, a fine not exceeding two hundred thousand dollars part V POWERS RELATING to enforcement, SEIZURE, ARREST, etc.


Enforcement officers 19. The officer noted in the first column of the Second Schedule shall be enforcement officers for the purposes of this Act and with respect to the management authority in the second space appearing.


Power of investigation 20. (1) an enforcement officers shall have all the powers necessary to carry out an investigation under this Act.

(2) in any matter relating to the Commission of an offence under this Act, any enforcement officers conducting investigations can perform all or any of the special powers in relation to police investigation in the case can capture provided by the criminal procedure code [Act 593].

(3) this section shall not be deemed to limit or prejudice any of the same powers granted to the

any person under any other written law.

International trade of Endangered species of 27 power Card 21. (1) there shall be issued to each enforcement officers under section 19 a authorisation cards which must be signed by the Minister.

(2) whenever the enforcement officer exercising any power under this Act, he shall, when requested, submit to the person against whom that power is being exercised authority card issued to him under subsection (1).


Power to arrest 22. (1) an enforcement officers may arrest without warrant any person — (a) who is found committing or attempting to commit, or aiding and abetting in the Commission of an offence under this Act; or (b) reasonably suspected by enforcement officers as involved in committing or attempting to commit, or aiding and abetting in the Commission of an offence under this Act.

(2) Seseorang pegawai penguat kuasa yang membuat penangkapan di bawah subseksyen (1) hendaklah, tanpa kelengahan yang tidak perlu, membawa orang yang ditangkap itu ke balai polis yang paling hampir, dan sesudah itu orang itu hendaklah diperlakukan mengikut undang-undang yang berhubungan dengan tatacara jenayah yang sedang berkuat kuasa.


Search and seizure with warrant 23. (1) where it appears in the magistrate's Court, based on the written information made on oath and after such inquiry as 28 laws of Malaysia ACT 686 may deem necessary, that there is reasonable cause to believe that — (a) any premises have been used or will be used for; or (b) in any premises evidence necessary for the conduct of the survey on the trip, an offence under this Act, the Magistrate may issue a warrant empowering any enforcement officers named in the warrant, at any reasonable time either during the day or night and with or without assistance, to enter the premises and if necessary using force.

(2) a warrant issued under subsection (1) may authorize enforcement officers to — (a) the premises for a search and seize or moving from the premises any scheduled species, transport, machinery, tools, equipment, books, records, documents or other things reasonably believed to give evidence of the Commission of the offence;

(b) take samples of any scheduled species or anything found in the premises for the purpose of ascertaining, by testing or otherwise, whether it was committed; and (c) make copies of or take extracts from any books, records, documents or other things found in the premises.

(3) an enforcement officers entering any premises under this section may bring with him any other person and equipment as it deems necessary.

About 29 international trade endangered species (4) an enforcement officers may, in exercise of its powers under this section, if the need to do so — (a) break open any door or in the premises or any fences, blockades, gates or other barriers to the premises, to enter into the premises;

(b) remove by force any barriers to entry, search, seizure and removal which he is empowered to effect under this section; dan (c) menahan mana-mana orang yang dijumpai di dalam premis itu sehingga penggeledahan itu selesai.

(5) where, by reason of the type, size or its recoverable amount, it is not practical to move any scheduled species, transport, machinery, tools, equipment, books, records, documents or other thing seized under this section, the enforcement officer shall, in any way, prevent the scheduled species, transport, machinery, tools, equipment, books, records, documents or other things that in the premises or in the container in which it was found.

(6) any person who, without lawful authority, break, interrupt or impair lak referred to in subsection (5) or transfer of scheduled species, transport, machinery, tools, equipment, books, records, documents or other things dilak or attempting to do so commits an offence and shall, on conviction, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding three years or to both.


Search and seizure without a warrant 24. (b) verify the accuracy of the records or statements or any information provided to an enforcement officers; or (c) take samples of any scheduled species.



International trade of 31 endangered species access to computerised data 26. Any enforcement officers carrying out the search under this Act shall be given access to computerised data either stored in a computer or otherwise, and for such purpose, shall be given according to

password, code encryption, encrypting code, software or hardware required and any other means necessary to allow computerised data understandable.


Seizure of objects, etc.

27. Without prejudice to subsection 23 (2) and section 24, any scheduled species, transport, machinery, tools, equipment, books, records, documents or other things reasonably suspected by an officer power amplifier has been used or will be used in the Commission of any offence under this Act may be seized and detained by the enforcement officers.

32 laws of Malaysia ACT 686 (2) those who control or keep the carrier shall, if required to do so by enforcement officers — (a) discontinue the carrier and allow the enforcement officers can inspect them; and (b) open all parts of the carrier for inspection and take all necessary measures to enable or facilitate the conduct of the examination as may be deemed necessary by the enforcement officers.

(3) any person who contravenes subsection (2) commits an offence and shall, on conviction, to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both.

Notice of seizure 29. (1) where any seizure made under this Act, enforcement officers making the seizure shall give a notice in writing of the seizure and grounds of the seizure to the owner of the scheduled species, transport, machinery, tools, equipment, books, records, documents or other things seized by submitting a copy of the notice to the owner, if the owner or place he is known.

(2) the notice under subsection (1) need not be given if the seizure is made in the presence of — (a) the owner or his agent;
(b) the occupier of the premises; atau (c) orang yang mengawal atau menjaga pengangkut itu jika penyitaan itu dibuat di bawah seksyen 28.


International trade of Endangered Species while Return 33 carrier, etc.

30. 34 the laws of Malaysia ACT 686 (2) if any carrier, machinery, apparatus or equipment seized temporarily returned under subsection (1), a person who — (a) not surrender the carrier, machinery, apparatus or equipment to enforcement officers when requested to do so; or (b) contravenes any term or condition imposed under subsection (1), commits an offence and shall, on conviction, to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both.


The power to require the attendance of the person who knew the case 31. (1) an enforcement officers making an investigation under this Act may, by order in writing, require any person who in the opinion of the enforcement officer to know the facts and circumstances of the case so as to appear before it, and such person shall attend as required.

(2) Jika mana-mana orang enggan hadir sebagaimana yang dikehendaki oleh suatu perintah yang dibuat di bawah subseksyen (1), pegawai penguat kuasa itu boleh melaporkan keengganannya itu kepada Majistret yang hendaklah mengeluarkan suatu waran untuk memastikan kehadiran orang itu sebagaimana yang dikehendaki oleh perintah itu.


Examination of person who knew the case 32. (1) an enforcement officers making an investigation under this Act may examine orally any person who expected to find out the facts and circumstances of the case.

International trade of 35 endangered species (2) such person shall be bound to answer all questions relating to the case submitted to it by the enforcement officers, but he can refuse to answer any question that the answer may disclose it to a criminal charge or penalty or forfeiture.


(3) a person who makes a statement under this section shall be legally bound to state the truth, whether or not the statement was made in whole or in part to answer questions.

(4) an enforcement officers examining a person under subsection (1) shall first inform that person of the provisions of subsection (2) and (3).

(5) a statement made by any person under this section shall, whenever possible, reduced to writing and signed by the person making it or affixed with cap head jarinya, as the case may be, after — (a) the statement was read out to him in the language in which the statement was made by him; and (b) he is given the opportunity to any rectification would like made by him.


Admissibility in evidence of a statement 33. (1) Kecuali sebagaimana yang diperuntukkan dalam seksyen ini, tiada pernyataan yang dibuat oleh mana-mana orang kepada seseorang pegawai penguat kuasa semasa penyiasatan yang dibuat di bawah Akta ini boleh digunakan sebagai keterangan.

(2) when any witness called for prosecution or for the defence, other than the accused, the Court shall, at the request of the accused or the Prosecutor, referring to any statement made by the witness to an officer 36 laws of Malaysia ACT 686 power amplifier during an investigation under this Act and may then, if the Court thinks fit in the interest of Justice, direct that the accused be given a copy of the statement and the statement can be used to challenge the credibility of the witness in the manner provided by the Act Description 1950 [Act 56].

(5) upon any person charged with such offences in respect of — (a) manufacturing; or (b) the content of, any statement made by him to an enforcement officers during an investigation made under this Act, the statement can be used as evidence in the prosecution case.


Forfeiture of the scheduled species, etc. seized 34. (1) any scheduled species, transport, machinery, tools, equipment, books, records, documents or other things seized in exercise of any power conferred under this Act shall be dilucuthakkan.

(2) an order for forfeiture of the scheduled species, transport, machinery, tools, equipment, books, records, documents or other things shall be made if it is proved to the international trade of Endangered species of 37 to the satisfaction of the Court that an offence under this Act has been committed and that scheduled species, transport, machinery, tools, equipment, books, records, documents or other things that matter for or used in the Commission of the offence , walaupun tiada orang telah disabitkan atas kesalahan itu.

(3) Jika tidak ada pendakwaan berkenaan dengan mana-mana spesies terjadual, pengangkut, jentera, peralatan, kelengkapan, buku, rekod, dokumen atau benda lain yang disita di bawah Akta ini, spesies terjadual, pengangkut, jentera, peralatan, kelengkapan, buku, rekod, dokumen atau benda lain itu hendaklah diambil dan disifatkan terlucut hak apabila tamat tempoh satu bulan kalendar dari tarikh penyampaian notis ke alamat yang terakhir diketahui orang yang daripadanya spesies terjadual carrier, machinery, tools, equipment, books, records, documents or other things is seized stating that no prosecution in respect of scheduled species, transport, machinery, tools, equipment, books, records, documents or other things that unless before the expiry of such a claim had been made in the manner specified in subsection (4), (5), (6) and (7).

(4) any person who asserts that he is the owner of scheduled species, transport, machinery, tools, equipment, books, records, documents or other things referred to in subsection (3) and that scheduled species, transport, machinery, tools, equipment, books, records, documents or other things that can not be dilucuthakkan may, by himself or by his agent authorized in writing, give notice in writing to the enforcement officers in his possession of scheduled species carrier, machinery, tools, equipment, books, records, documents or things held that he was demanding the scheduled species, transport, machinery, tools, equipment, books, records, documents or other things that.

(5) when the notice referred to in subsection (4) is received, the enforcement officer shall refer the claim to a Magistrate of the first Class to get the decision.

38 the laws of Malaysia ACT 686 (6) a magistrate to whom a matter referred to it under subsection (5) shall issue a summons requiring the person who pointed out that he is the owner of scheduled species, transport, machinery, tools, equipment, books, records, documents or other things the person from whom it was seized to appear before him, and when they are present or when they are not present, having proved that the summons has been duly served , A magistrate shall proceed with examination of the matter.

(7) if it is proved that an offence under this Act has been committed and that scheduled species, transport, machinery, tools, equipment, books, records, documents or other things referred to in subsection (6) is a matter for or was used in the Commission of the offence, then the Magistrate shall order that scheduled species, transport, machinery, tools, equipment, books, records, documents or other things that dilucuthakkan , and shall, in the absence of such proof, ordered its divestment.

(8) any scheduled species, transport, machinery, tools, equipment, books, records, documents or other things dilucuthakkan or be deemed to be forfeited shall be dihantarserahkan to the management authority and shall be disposed of in such manner as he may deem fit, including repatriation under subsection (9)

event management authority decides so.

(9) when a judgment for repatriation made under this Act in respect of any scheduled species that have been imported or brought in by the sea into Malaysia in contravention of this Act, and the scheduled species is brought into Malaysia in a carrier, the owner or importer of the scheduled species or his agent shall, if required in writing by the management authority, provide or be responsible for — (a) travel free of charge for the return of the scheduled species to the place where the scheduled species transported to the international trade of Endangered Species of Malaysia 39, or to any port or another place designated by the management authority; and (b) the maintenance and provision of shelter to the scheduled species during the cruise line, airline or travel.

(10) No person shall be liable under subsection (9) unless the repatriation decision has been made by the management authority within — (a) If no proceedings are instituted, twelve months from the date of the scheduled species imported or brought in by the sea into Malaysia; or (b) six months from the date of proceedings for offences related to the importation or carriage in from the sea into Malaysia is completed.

(11) any person who contravenes subsection (9) commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both;

(b) if that person is a body corporate liable to a fine not exceeding two hundred thousand dollars.


Property rights of scheduled species, etc. a dilucuthakkan 35. Any scheduled species, transport, machinery, tools, equipment, books, records, documents or other things dilucuthakkan or be deemed to be dilucuthakkan under this Act shall be the property of the management authority.



40 laws of Malaysia ACT 686 Release scheduled species, etc. seized 36. Notwithstanding section 34, the management authority may, if he thinks fit, at any time, direct that any scheduled species, transport, machinery, tools, equipment, books, records, documents or other thing seized under this Act to the person who released from the possession, custody or control it seized.


The cost of holding the scheduled species, etc. seized 37. If any scheduled species, transport, machinery, tools, equipment, books, records, documents or other thing seized under this Act held in the custody of management authority pending the settlement of any proceedings in respect of an offence under this Act, the costs of holding it in custody shall, if any person is found guilty of the offence, be a debt due to the management authority or Government , as the case may be, by such person and may be obtained accordingly.


There are no costs or damages arising from seizure can be obtained 38. Tiada seorang pun boleh, dalam apa-apa prosiding di hadapan mana-mana mahkamah berkenaan dengan penyitaan mana-mana spesies terjadual, pengangkut, jentera, peralatan, kelengkapan, buku, rekod, dokumen atau benda lain yang disita pada menjalankan mana-mana kuasa yang diberikan di bawah Akta ini atau pada penjalanan yang berupa penjalanan mana-mana kuasa yang diberikan di bawah Akta ini, berhak mendapat kos prosiding itu atau apa-apa ganti rugi atau relief lain melainkan jika penyitaan itu dibuat tanpa sebab yang munasabah.




Perdagangan Antarabangsa mengenai 41 Spesies Terancam Kuasa tambahan 39. (1) an enforcement officers shall, for the purposes of implementing this Act, have power to do all or any of the following acts: (a) require the production of records, accounts and documents and examine, inspect, and copy any of them;

(b) require the production of any document identification of any person in respect of any matters or of an offence under this Act;

(c) make such investigations as are necessary to determine whether the provisions of this Act have been complied with.

(2) any person who fails to comply with a request made under subsection (1) commits an offence and shall, on conviction, to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both.


Error mengamang or prevent enforcement officers 40. A person who — (a) mengamang, prevent, restrict or interfere with any enforcement officers in the execution of its functions under this Act;

(b) withdraw or seek to take back any scheduled species, transport, machinery, tools, equipment, books, records, documents or other thing seized under this Act; or (c) before or after any seizure resulted in loss of, or damage or destroy the 42 laws of Malaysia ACT 686 any scheduled species, transport, machinery, tools, equipment, books, records, documents or other things to prevent its seizure or storage of safely scheduled species, carrier, machinery, tools, equipment, books, records, documents or other things, commits an offence and shall, on conviction, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both.


PART VI GENERAL Payment into Fund 41. All money received under this Act by the management authority shall be paid into and form part of — (a) if the authority is under the Management jurisdiction of the Federal Government, the Consolidated Fund;

(b) if management authority was under the jurisdiction of the State Government, the State consolidated fund; or (c) if management authority is a statutory body, the statutory fund.


Compounding of offence 42. (1) the management authority may, with the consent of the public prosecutor, make a written offer to compound any offence committed by any person under this Act and which are designated as offences can compound by regulations made under this Act

International trade on Endangered Species with 43 making an offer in writing to that person to compound the offence when paid to the management authority of an amount not exceeding fifty per cent of the maximum amount of the fine for the offence within the time specified in the offer.

(2) an offer under subsection (1) may be made at any time after the offence, but before any prosecution for him started.

(3) if the amount specified in the offer under subsection (1) is not paid within the time specified in the offer or in any extended period granted by the management authority, prosecution for that offence may be commenced at any time after that to the person to whom the offer is made.

(4) where an offence has been compounded under subsection (1), no prosecution shall be instituted subsequently in respect of the offence against the person to whom the offer to compound has been made and any scheduled species, transport, machinery, tools, equipment, books, records, documents or other thing seized in connection with the offence be released or dilucuthakkan by the management authority, subject to such terms and conditions as he thinks fit to impose in accordance with the conditions of the compound by the management authority.


Pemulaan pendakwaan 43. No prosecution for or in connection with any offence under this Act shall be instituted except by or with the written consent of the public prosecutor.


False declaration of 44. (1) any person who makes, orally or in writing, sign or giving any declaration, statement, 44 laws of Malaysia ACT 686 certificate or other document or information required under this Act that is untrue, inaccurate or misleading about any item commits an offence and shall, on conviction — (a) if the person is an individual, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both;

(b) if that person is a body corporate, a fine not exceeding two hundred thousand dollars.

(2) any person who — (a) without lawful authority alter, falsify, disfigure or damage any permit, certificate or registration; or (b) use any permit, certificate or registration that he knows has been altered, falsified, dicacatkan or defaced so, commits an offence and shall, on conviction — (aa) if that person is an individual, to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding seven years or to both;

(bb) if that person is a body corporate, a fine not exceeding two hundred thousand dollars.


Offences by body corporate 45. Jika sesuatu pertubuhan perbadanan melakukan suatu kesalahan di bawah Akta ini, maka mana-mana orang yang pada masa pelakuan kesalahan itu ialah pengarah, pengurus, setiausaha atau pegawai lain yang seumpamanya bagi pertubuhan perbadanan itu atau yang berupa bertindak atas apa-apa sifat sedemikian atau yang dalam apa-apa cara atau sehingga apa-apa takat bertanggungjawab bagi pengurusan Perdagangan Antarabangsa mengenai 45 Spesies Terancam apa-apa hal ehwal pertubuhan perbadanan itu atau yang membantu dalam pengurusan sedemikian— (a) boleh didakwa secara berasingan atau bersesama dalam prosiding the same together with the body corporate; and (b) if the body corporate is found to have committed the offence, shall be deemed to have committed the offence unless, having regard to the type of functions on the properties and all the circumstances, he proves — (i) that the offence was committed without the knowledge, consent or pembiarannya; and (ii) that he took all steps reasonable awake-awake and have carried out due diligence to prevent the Commission of the offence.


Offences by partner, agent or servants 46. Any person who shall be liable to any penalty under this Act for any act, omission, neglect or default if an Act, omission, neglect or default is done by himself may be subject to the same penalty if the Act, omission, neglect or default committed by the partner, agent or pekhidmatnya unless he is proved — (a) that the Act, omission, neglect or default is done without knowledge , permissions or pembiarannya; and (b) that he took all reasonable precautions and due diligence conducted 46 laws of Malaysia ACT 686 to prevent the Act, omission, neglect or default of that.


Pensubahatan and experimental 47. (1) any person aiding and abetting or attempting to commit any offence punishable under this Act is punishable with the punishment provided for the offence.

(2) Seseorang yang melakukan apa-apa perbuatan sebagai persediaan bagi atau bagi membantu pelakuan mana-mana kesalahan di bawah Akta ini boleh dihukum dengan hukuman yang diperuntukkan bagi kesalahan itu.


48 public servants. Every Member, officers, servants or agents of the current Management Authorities meet their obligations as a member, officer, or agent of such servants shall be deemed to be public servants within the meaning of the Penal Code [Act 574].


Protection from legal action and legal proceedings 49. No action can be taken or prosecution can be brought, instituted or made in any court against — (a) any Member, officer or enforcement officers management authority; and (b) any other person or due to or in respect of any act done or purporting to be done under an order, direction or instruction of Management Authorities, enforcement officers or international trade on Endangered Species 47 any other officer duly appointed by the management authority, if an act is done in good faith and reasonably believing that it is necessary for the purposes that are intended to be achieved through it and for carrying out the provisions of this Act.



The whistleblower protection 50. (1) except as provided in subsection (2) and (3), no witness in any civil or criminal proceedings may be required or permitted to disclose the name or address of the whistleblower or fill in the information received from it or declare any matter that may cause the whistleblower known.

(2) where any books, records, accounts, documents or computerised data or evidence that may be inspected in any civil or criminal proceedings contain any entry in which any informer is named or described or which might cause the whistleblower known, the Court shall cause to such closed all the parts of the vision or deleted only to the extent necessary to protect the informer of the unknown.

(3) if in proceedings for any offence under this Act the Court after a full investigation of the case believe that the informer wilfully made in aduannya a statement of material which he knows or believes is false or does not believe to be true, or if in any other proceedings the Court is of the opinion that justice cannot be achieved solely between the parties in the proceedings without knowing the whistleblower , mahkamah boleh menghendaki pengemukaan aduan asal, jika bertulis, dan membenarkan siasatan dan menghendaki penzahiran sepenuhnya, berkenaan dengan pemberi maklumat itu.
48 laws of Malaysia ACT 686 51 Rewards. Management Authority may direct that paid such remuneration as he thinks fit to any person for services rendered in connection with the detection of any offence under this Act, or in connection with any seizure made under this Act.


Power to exclude 52. (1) the Minister may, on the recommendation of management authority, by order published in the Gazette exempt, subject to such terms and conditions as he thinks fit to impose, any person or class of persons or any scheduled species from all or any provisions of this Act.

(2) the Minister may, at any time, by order published in the Gazette, revoke any order made under subsection (1) if he is satisfied that the exemption is no longer needed.


The power to amend the schedule of 53. The Minister may, after consultation with the management authority, amend the second schedule and the third schedule by order published in the Gazette.


The power to make regulations 54. (1) Menteri boleh membuat apa-apa peraturan-peraturan yang suai manfaat atau perlu bagi melaksanakan peruntukan Akta ini dengan lebih baik.

(2) without prejudice to the generality of subsection (1), regulations may be made for the following purposes: international trade on Endangered species, 49 (a) prescribing the form, timing, terms, conditions and restrictions for any permit, certificate or registration, and provide for the revocation and suspension of permits, certification or registration;

(b) prescribing all matters relating to the Rescue Centre;

(c) prescribing all matters relating to animal dibiakbakakan in brackets and plants or animals bred artificially;

(d) to specify all matters relating to branding, packaging, marking, whether permanently or temporarily and labeling scheduled species for the purpose of identification;

(e) prescribing offences that can be is compounded;
(f) prescribing the records and documents that shall be kept;

(g) prescribing forms for the purposes of this Act;
