REPOBLIKAN'I MADAGASIKARA Tanindrazana - Fahafahana - Fandrosoana law No. 2005-035 authorizing the ratification of the Rome Statute of the Criminal Court international explanatory provisions enacted by the status suppress the crime of genocide, crimes against humanity, war crimes and crimes of aggression.
The International Criminal Court has jurisdiction to try individuals who have perp being of criminal acts during the periods of trouble and war regardless of the quality of these individuals.
This statute is the result of the diplomatic Conference of Plenipotentiaries on the establishment of United Nations ' an international criminal court that s ' was held in Rome from 15 June to 17 July 1998.
Madagascar is among the countries that have signed the Statute on 18 July 1998.
This status contains 128 articles and aims to contribute to put an end to impunity.
The International Criminal Court in its fight to end the impunity of those who commit genocide, crimes against humanity and war crimes has started e of such investigative procedures in three African countries including Uganda, the Democratic Republic of the Congo and the Sudan.
The International Criminal Court is a permanent institution and aims to crack down on crimes that can disrupt world peace so that to prevent new crimes and this based on the principles established by the United Nations Charter on the preservation of world peace.
The International Criminal Court with the present Statute is complementary to national criminal jurisdictions.
The ratification by Madagascar of the Rome Statute will mark l ' advanced effective in its respect for the commitments towards the international community. For having signed, Madagascar reiterates its intention to ' be State Par and ratification as a decisive step.
The ratification of the Treaty by Madagascar as the 100th State party would lead to diplomatic and political repercussions for our country who will have the honor to participate in a special ceremony that will be held at the United Nations in commemoration of the 100th ratification of the Rome Statute, a great event that will mark a turning point in international justice.
This is the purpose of this Act.
REPOBLIKAN'I MADAGASIKARA Tanindrazana - Fahafahana - Fandrosoana law No. 2005-035 authorizing the ratification of the Rome Statute of the ICC International National Assembly and the Senate have adopted in their respective session as of the 21 December 2005 and December 22, 2005, the law whose content follows: Article first - is authorized, the ratification by Madagascar of the Statute of Rome of the International Criminal Court.
Article 2 - This Act shall be published in the Official Journal of the Republic. It will be run as State law.
