EXPLANATORY MEMORANDUM The Conference FAO at its thirty-first session in November 2001 adopted resolution 3/2001 of the International Treaty on Plant Genetic resources for Food and agriculture and prescribe interim arrangements for the implementation of the Treaty.
The first session of the Commission g énétiques Resources for Food and Agriculture, held in Rome from 09 to 11 October 2002. Madagascar was represented by the Secretary General of the Ministry of Agriculture and Livestock, attended FAO's assistant representative. In addition, Madagascar signed the Treaty 30 October 2002 through the efforts of its Charge d'Affaires in Rome.
The Treaty defines the Plant Genetic Resources for Food and Agriculture as the genetic material of actual or potential value for food and agriculture.
The Treaty aims at the conservation and sustainable use of plant genetic resources for food and agriculture and and equitable sharing of benefits from their use, in harmony with the Convention on Biological Diversity for sustainable agriculture and for food security.
As part of Trait é, countries agree to establish a multilateral system that is efficient, effective and transparent to facilitate access to plant genetic resources for food and agriculture share the monetary benefits derived if this product can be used without restriction by other beneficiaries for purposes of search and selection. If others can use it, payment is voluntary.
A variety regard, we are all beneficiaries in actions where:
farmers and consumers, through rights - farmers; consumers due to greater security - food; the scientific community, through access to resources - essential for plant genetic research and selection; the public and private sector that are certain to have access to - much of the genetic diversity for agricultural development; and the environment and future generations, because the Treaty will help - conserve the genetic diversity necessary to face unpredictable environmental changes and future human needs.
The Treaty takes effect 90 days after 40 countries have ratified it. Governments that have ratified constitute its governing body.
Each country that ratifies the treaty will then develop the legislation and regulations needed to implement it.
This is the purpose of this Act.

L national Assembly and the Senate have adopted in their respective session dated 16 November 2005 and 15 December 2005, the Act which reads as follows: Article
premier.- is authorized ratification of the International Treaty on Plant Genetic Resources Food and Agriculture.
Article 2: This Law shall be published in the Official Journal of the Republic. It shall be enforced as State law.
