authorizing ratification of the Grant Agreement concluded on 12 October 2011 between the Republic of Madagascar and the World Bank on the Additional Financing of the Support Project Third Environment Program ( PE III)
EXPLANATORY MEMORANDUM

The Government of Madagascar has set up sustainable financing mechanisms for protected areas it has created since its decision to double the surface in Durban in 2007. One of these mechanisms has been creating with its national and international technical and financial partners a Foundation for Protected Areas of Madagascar or FAPBM. In this context, following Grant Agreement dated 12 October 2011, the Global Fund for the Environment (GEF) through the World Bank which is its implementing agency granted the Republic of Madagascar of a Don 10 million US dollars as its contribution to financing the preservation and conservation of Malagasy environmental and forest heritage through a payment to the capital of the FAPBM. PROGRAM OBJECTIVE This Grant Agreement amounting to $ 10 million or about 20 billion ariary aims to strengthen the sustainable financing mechanism already in place to fund the future or all of the operating requirements or investment Madagascar National Parks. The Don is intended to provide the capital FAPBM of 10 million additional USD. The income of the capital placed on the national or international market will fund the future needs of Madagascar National Parks.

DURATION OF THE PROGRAM The project closing date is 31 December 2014. Given the scarcity, difficulty of access and insecurity international funds available to the conservation of protected areas, Don enable the Government to strengthen a sustainable funding mechanisms for our protected areas while ensuring at least the next three years their operation and management. Indeed, the first benefits of this mechanism is already available and were used to finance in part the needs of Madagascar National Parks. Under article 137, paragraph II of the Constitution "the ratification or approval of treaties involving the finances of the State must be authorized by law." Such is the object of this Act.

The Congress of the Transition and the High Council of the Transition adopted in their respective session dated 18 January 2012 and 19 January 2012, the law which reads as follows: Article premier.- allowed East, the ratification of the Agreement Don concluded on 12 October 2011 between the Republic of Madagascar and the World Bank on the Additional Financing of the Support Project to the third Environmental Programme in the amount of TEN MILLION DOLLARS ($ 10,000,000), or about TWENTY BILLION ARIARY (Ar 20 billion). Article 2: This law will be published in the Official Gazette of the Republic. It will be enforced as a law of the state.
