Cabinet of Ministers Regulations No. 846 in 2016 (20 December. No 69 49. §) rules on cultural monuments, including the State-owned antiquities, art and antique items from the introduction in Latvia of Latvian and Issued in accordance with the law "on the protection of cultural monuments" in article 4, first paragraph and article 18.1, first and second part i. Permission is required for cultural monuments and the export of cultural goods which comply with the rules referred to in annex 1 of the categories of cultural objects. 6. in paragraph 5 of these regulations, this claim is not applicable if: 6.1. accredited museum, according to Museum activities to the regulatory framework of the procedures laid down in the laws of Latvia temporarily leave the item in the collections or individual items; 6.2. in accordance with the regulatory framework for the activities of the archives law of the procedures laid down for Latvia temporarily leave the national documentary heritage included in the document. II. the procedure for the issue of licences 7. Authorisation, a natural or legal person or its authorized person (hereinafter applicant) shall fill out the application for inspection of the export of cultural objects for authorization (hereinafter application) (annex 2) and displays the export of cultural objects. In that application, the data specified in the inspection shall include permission to copy the application first, (annex 3). 8. If you plan to export a collection of cultural objects, the applicant shall submit with his application, according to this provision the inspection point 3 under Collections description, adding the entire collection of cultural objects in color photographs (not older than one year, each cultural object is clearly visible and identifiable). The number of identifiable photographs according to the number of copies of the permit (20 and 21 of these regulations). Photos of minimum size is 8 x 12 cm, maximum size: 10 x 15 cm. 9. If you plan to leave the large size of cultural objects, the Inspectorate has the right to carry out inspection of the cultural object is located. 10. each export of a cultural object shall be issued by separate authorisation (this requirement does not apply to cultural objects that are to be exported and which at the same time, the origin of the inspection as appropriate collections of cultural objects properties (this provision)). Newly discovered cultural monument in term of reimportation in Latvia may not exceed six months. 13. When you need to perform the inspection of cultural objects or clarify its ownership, the inspection has the right to detain the inspection of cultural objects for longer than 15 days, but no longer than until the date of adoption of the decision. To clarify the nationality of ownership, the applicant presented ownership documents. If the inspection, using available databases, it notes that the subject matter is presented in the search or inspection of it lost, reported to the State police. 14. the Inspectorate has the right to request, to other competent authorities (submitted in the category of cultural objects) or industry specialists provide opinion of cultural objects to be exported for additional evaluation. Findings are recommendations, except in the case where the opinion is an indication that the export of the subject and the issue of a permit is determined by the other legislative act. All expenses incurred by the institution concerned and are associated with the preparation of an opinion, shall be borne by the applicant. 15. If there is a need for additional inspection, the inspection may convene expert tips. The composition of the Expert Council and regulations approved by the head of the inspection. 16. If necessary cultural objects to be exported to a foreign country at or for any other reason (such as restoration, expertise, training), the inspection shall take a decision on the temporary export of cultural objects. The temporary export of cultural objects in the sense of these provisions is the outward and inward in Latvia in full and in good saglabātīb condition inspection time. Re-entry period may not exceed three years. 17. If the musical instruments correspond to the provisions referred to in annex A8. and B9. category, the temporary export goods and the work of the Orchestra needs certify the company's administration or the artist prepared documentation of the origin of the instrument that displays without inspection by the Customs authorities of the export documents issued by the (permits or certificates). 18. The period of validity shall be one year from the date of issue. If the permit has expired, but it is not in use, the inspection may be granted permission again. 19. the permit shall be issued once the applicant has paid the State fee for the issue of licences for the export of cultural objects or temporary removal from Latvia. 20. the export of cultural objects from the Latvian European Union inspectorate shall prepare the authorisation (annex 3) in duplicate: 20.1. first copy-application inspection for export of a cultural object-store inspection; 20.2. the second copy to keep the applicant and presented at the request of the officials responsible. 21. the export of cultural goods outside the European Union borders prepares inspection (annex 3) in triplicate: 21.1. the first copy-application inspection for export of a cultural object-store inspection; 21.2. the second copy-keep the applicant and presented to the customs authority. The Customs Office shall at the appropriate grades; 21.3. the third copy shall be handed to the applicant for submission to the Customs authorities. The customs authority shall perform the appropriate tags and sent within 15 days of the inspection. 22. the export of cultural goods outside the European Union borders includes design of the customs formalities at the Customs Office. Subject to the above, cultural objects may be removed only on the external border crossings, which have been created in the customs control point. The Customs Office examining all permissions copy, control to the information contained in the customs declaration with information specified in the permit. 23. The inspection decision to ban the export of cultural goods, the applicant is entitled to challenge the Ministry of Culture. 24. In order to facilitate the export of a cultural object that is not a cultural monument and do not meet these rules 1. categories listed in the annex, inspection of the applicant's wish may be granted the certificate presentation at the Customs Office. Certificate period of validity is one year from the date of issue. III. import of cultural objects in Latvia 25. Importation of cultural objects, which provides for temporary importation in Latvia, from countries which are not members of the European Union, its owner (possessor) is obliged to declare to the Customs authorities of Latvia. If the cultural object, which provides for temporary importation in Latvia, is given by the Customs authorities, it is considered that a person of this cultural goods are purchased in Latvia and the exportation of it applies these rules laid down in the arrangements for the export of cultural goods. 26. If a person from a Member State of the European Union imported cultural goods in Latvia, whose removal from Latvia pursuant to these rules may need to present documents proving its ownership or purchase of property outside of Latvia (for example, the acquisition of cultural objects, the purchase contract invoice, permission for the export of cultural objects from another Member State of the European Union), these rules on the export of cultural goods does not apply. 27. On the subject of culture, which provided for the temporary export goods, the owner (possessor) inspection in writing within 15 days after its introduction in Latvia. 28. the cultural monument, which provided for the temporary export goods, the owner (possessor) registered office within 15 days after its introduction in Latvia, writing that the imported culture of the monument is a monument of culture, enjoying the temporary removal. If in doubt, the Inspectorate has the right to have cultural monuments the owner (possessor) show the re-imported cultural monument. IV. Closing questions 29.
