No 60 32 §) to the European economic area financial instrument programme co-financed by the "environmental policy integration in Latvia" subproject application open competition "interdisciplinary research and capacity building for environmental policy integration" Regulations Issued under the European economic area financial instrument and the Norwegian Government, the bilateral management of the financial instrument of the law article 18 (4) i. General questions 1. the European economic area financial instrument and the Norwegian Government priorities in the bilateral financial instrument of "environmental protection" and "sustainable development" programmes "environmental policy integration in Latvia" (hereinafter referred to as the programme) submission of subproject the contest "interdisciplinary research and capacity building for environmental policy integration" (hereinafter referred to as the competition) regulations, which also included a subproject application evaluation criteria. 2. the operator has the Ministry of des Vi (hereinafter referred to as the establishment a nie kotāj). 3. The objective of the programme is the integration of environment policy development capacity, using interdisciplinary research and policy analysis, and the target group of the go rolling policy making and implementation. The program's main focus-the development of cooperation between policy makers, scientists and merchants. 4. co-financing available for tender (hereinafter referred to as the fi nancing of the programme), the European economic area financial instrument and the financing of the budget of the Republic of Latvia. 5. the Subproject is the subpriority: 5.1. networking of experts, based on national and international scientific collaboration, the partners jointly developing and adapting knowledge base for a successful integration of environment policy;
5.2. evaluation methodology the integrated suite that includes a wide range of different approaches, including modeling tools, systems analysis approach, systemic thinking methodology, guidelines for the involvement of target groups in environmental policy for the vertical (sectoral) and horizontal (cross-sectoral) integration;
5.3. capacity-building training programmes for Government policy makers and scientists developed the methodology of practical use;
5.4. the interdisciplinary research programme a priority in the European Union new policy analysis, based on the methodology developed by the kit full of practical, policy analysis cycle impact assessment and the preparation of the recommendation;
5.5. the target groups involved in the preparation of the annual Conference and information systems to facilitate the creation of partnerships for environmental policy integration for communication with the public. II. the applicant and the subproject partner 6. Subproject applicant (hereinafter referred to as the submission by submitting a stuffy nose) can develop an application and implement a subproject subproject independently or with partners or partners. The applicant and the partner is direct or in direct authority, other State authority derived public person as well as in the Republic of Latvia registered legal person. Partner can also be in another European economic area country registered legal person or State or local government authority, or an international organization that works in another European economic area country. 7. the cooperation partner in the subproject can be both direct partner directly involved in the implementation of the sub-projects and a financial partner that participates in the financing of sub-projects. 8. The applicant and partner relations establish a written agreement on the responsibility of the parties in the implementation of the sub-projects, contribution and during the implementation of the subproject used and the intellectual and material benefits of ownership. 9. the applicant shall have the right to submit an unlimited number of submissions of subprojects when it argues that can fulfill this provision set out in annex 1 and to ensure that one of the activities referred to in the subproject will not be included in other sub-projects. 10. If it is established that the applicant or partner, if the bottom project partnership, knowingly or recklessly made false statements, the applicant is denied the opportunity to receive co-financing of the programme and the operator can apply to the law enforcement institutions. 11. the programme for the implementation of the sub-projects co-financed not eligible if the applicant: 11.1 has been declared bankrupt or is being wound up, its economic activity is suspended or interrupted or have been instituted for its winding up, or there is a similar situation, as provided for by national laws or regulations;
11.2. no paid taxes law in the order and within the time limits;
11.3. the State has not carried out the compulsory social insurance contributions prescribed by the laws and limits;
11.4. a judgment which has the force of res judicata considered to blame the industry for regulatory violations of laws, as well as environmental protection, competition and labour rights violations. 12. The applicant is not eligible for co-financing of the programme for the implementation of the sub-projects, if its partner: 12.1 is a legal person, which has been declared bankrupt, its economic activity is suspended or interrupted or have been instituted for its bankruptcy;
12.2. is not fulfilled obligations relating to the payment of taxes arising from the cooperation partners of the national tax system regulatory laws;
12.3. a judgment which has the force of res judicata considered guilty of the sector concerned violations of regulatory legislation, environmental protection, competition and labour law violations, as well as professional misconduct under the cooperation partner's national laws and regulations. 13. If the applicant is a local authority which, in accordance with the laws and regulations on financial stabilization process, it shall present to the Ministry of Finance issued assurances for the implementation of the sub-projects. III. activities and Sub-projects financed 14. within the framework of the competition are eligible in the following activities: 14.1. structure and support partnerships between public administration, education and scientific institutions;
14.2. networks, expert groups, advisory and service provision if it contributes to the objectives of the programme, information systems design and development;
14.3. the training courses, conferences and seminars and dissemination of information, exchange of experience, standardized project and procedure development;
14.4. research, documentation, strengthening the institutional system of measures, methodologies and guidelines for the preparation of the environmental policy integration;
14.5. the publication, printing and distribution of information, preparation, participation in conferences, seminars and training courses. 15. the Subproject is financed from the resources of the applicant, the financial means of partner (if the subproject is involved in financial partner), as well as the co-financing of the programme features. 16. the co-financing of EUR 1 200 000 is equivalent to the competition in the following Bank of Latvia exchange rate. 17. within the Sub-projects: 17.1. minimum amount of the co-financing of the programme is EUR 50 000 equivalent in dollars after the Bank of Latvia exchange rate;
17.2. the maximum amount of co-financing of the programme is EUR 300 000 equivalent in dollars after the Bank of Latvia exchange rate. 18. the subproject co-financing of the programme requested does not exceed 90% of the children's total eligible costs. 19. The applicant and the financial partner (if the subproject is involved in financial partner) total funding of not less than 10% of the total eligible cost of the subproject. 20. The applicant and partner (if the sub-projects involved partner) total contributions in kind does not exceed 5% of the total eligible cost of the subproject. 21. If the implementation of subprojects subproject total cost exceeds the maximum co-financing of the programme assigned to the subprojects, this difference borne by the applicant. 22. the partner can claim no more than 50% of the children in the program assigned to the co-funding. 23. activities supported within the programme is not allowed the use of co-financing, to promote commercial activities, that is, any direct or indirect assistance to selected companies that affect competition in the EU's internal market and provide economic benefits for specific companies or specific for the production of the goods or services. 24. Children's financial calculations are carried out for the European Union single currency. 25. The applicant is responsible for the application of the specified subproject financial calculation arithmetic correctness. IV. advances a subproject subproject 26 may be granted advance payment of 20% of the co-financing of the programme granted to the sub-projects. The advance shall be paid following the signature of the Treaty for the implementation of the subproject of project beneficiaries of co-financing between the bottom and the operator. 27. V. costs 29 subproject. co-financing the subproject is calculated, taking into account the eligible costs. 30. the cost of the Sub-projects are eligible if they are encountered in the implementation of subprojects for the duration of the contract and are made to the principal applicant and listed in the accounting records, with whom the operator has entered into an agreement for the implementation of the sub-projects, and if those costs are identifiable, separate from the rest of the cost, and verifiable, and they are certified with the expenditure supporting documents. 31. the eligible costs shall be the subproject: 31.1. direct eligible costs, consisting of: labour costs – 31.1.1. the children involved in the implementation of the compensation of employees, including State social security contributions and other statutory payments. Compensation of employees and costs should not exceed the employee's service profile in market prices;
31.1.2. the travel and subsistence expenses for missions of the applicant and partner employees who participate in the implementation of the sub-projects, in accordance with the laws and regulations on travel and with the travel-related expenses;
31.1.3. material and stationery costs;
31.1.4. Office machinery and equipment costs, provided that they comply with the average market prices;
31.1.5. external costs;
31.1.6. administrative costs;
31.1.7. other costs associated with the implementation of the sub-projects and the requirements of the Treaty and related services, including the dissemination of information, specific evaluation of the project, the audit, written and oral translation, reproduction of materials, insurance, staff involved in project implementation and training costs of financial services;
31.1.8. contribution in kind, consisting of the grant of equipment or materials, research or professional activities or unpaid voluntary work, the value of which can be independently assessed and audited;
31.2. indirect eligible costs which constitute particularly justified 31.2.1.: costs and does not include costs assigned to another specific budget line in the contract;
31.2.2. the beneficiary the overhead rate that does not exceed 15% of the total eligible cost of the subproject. 32. Children not eligible are: 32.1. the securities future losses or costs cover the debt;
32.2. the loan principal and interest payment or other obligations incurred costs;
32.3. the value added tax payments if the beneficiary of the financing of sub-projects are entitled to get back;
32.4. the costs to be met from other sources of finance;
32.5. debit interest charges for financial transactions, foreign exchange commissions and losses associated with it;
32.6. fines, financial penalties and court costs;
32.7. acquisition of immovable property;
20.4. the costs incurred on the basis of the principal applicant and third party contract, concluded before the bottom of the implementation of the project after the conclusion of the contract or the implementation of the subproject subproject implementation of the contractual deadline;
32.9. other subprojects that are not eligible costs, including the costs associated with the preparation of the application to the subproject. Vi. implementation of the Sub-projects and sub-project implementation 33. place term shall not be shorter than six months and not longer than 24 months from the conclusion of the agreement for the implementation of the sub-projects. All sub-project activities implemented and all payments shall be made up to 30 April 2011. 34. Sub-project implemented in the territory of the Republic of Latvia. VII. Invitation to tender procedure 35. Tender opening until 1 October 2008. 36. The operator shall be advertised by placing an advert in the newspaper "Gazette" and one after the subscription amount is the largest daily newspaper in Latvia, as well as the operator's homepage on the internet (www.vidm.gov.lv) and the financial instrument for the Latvian homepage on the internet (URwww.eeagrants.lv). 37. the deadline for submission of Subproject is two months from the date of the invitation to tender. Subproject application shall be submitted not earlier than 30 days after the date of the invitation to tender and until the last day of the competition. The announcement indicates the name of the Contest submission deadline and address of the operator. VIII. preparation of subproject application and submission of 38. Operator provides the preparation of subproject application the necessary regulations and guidelines published managers home page on the internet (URwww.vidm.gov.lv). 39. To apply for co-financing of the programme, the applicant shall prepare and submit an application for the establishment of the niekotāj subproject subproject, which consists of the application form (annex 2), which is available in the operator's home page on the internet (www.vidm.gov.lv) and fill out the electronic version in MS Excel format, and this provision set out in paragraph 40. 40. in addition to the following documents shall be submitted: 24.9. with respect to the principal applicant: 40.1.1. Declaration by the applicant (annex 1);
40.1.2. applicant's Charter or Charter, a copy of the registration certificate of the Organization's legal status and tax payer registration certificate copy (if applicable);
40.1.3. the applicant a copy of the annual accounts (profit and loss statement and report (balance sheet) for the previous financial year);
40.1.4. institution, which, after the approval of the subprojects subproject provides the necessary for the implementation of the credit or other financial assets, if such is intended to attract, a statement on the bottom of the funding required for the project, indicating the amount of funding to be granted;
40.1.5. applicant's decision on participation in the subprojects subproject total costs and pre-financing sources (including the investment in sub-projects);
40.1.6. not earlier than one month before the date of submission of the application to the subproject of the State revenue service issued a certificate stating that the applicant has no tax arrears;
40.1.7. management of sub-projects involved description of the resume (curriculum vitae);
40.1.8. the logical framework matrix;
40.2. as regards partners if the subproject provides partnership: cooperation partner 40.2.1. registration certificate or legal status of a copy of the identity document. If you have a foreign partner, the partners shall be submitted in accordance with the procedure laid down in the country cooperation partners issued a copy of the registration certificate or legal status of a copy of the identity document;
40.2.2. partner Declaration of partnership signed by the subproject (annex 3). If the partner is direct or in direct authority, other State authority derived public person established in the Republic of Latvia or a legal person, the partnership provides proof of the Latvian language. If the partner is a European economic area country registered legal person or State or local government authority, or an international organization that works in another European economic area country, proof of the partnership provided in English;
40.2.3. applicant and partners agreed in writing between the parties on the implementation of the sub-projects of the responsibility, contribution and during the implementation of the subproject used and the intellectual and material benefits of ownership;
40.2.4. not earlier than one month before the date of submission of the application to the subproject of the State revenue service issued a certificate attesting that the partner is not insolvent and has no tax liability. If you have a foreign partner, the partners shall be submitted in accordance with the procedure laid down in the country issued a document showing that the partner is not insolvent and has no tax liability. If national legislation following the issuance of the certificate does not provide the partners submitted a statement that it has not been declared insolvent (including not in the process of reorganisation and winding-up). 41. If, in addition to the submitted document is not issued in the Latvian language, then in accordance with the laws and regulations that determine the order in which the documents of which a translation in the language of the country, accompanied by a certified translation into Latvian language in the document. 42. The applicant filled out an application form for a subproject and the rules referred to in paragraph 40 of document shall be submitted in five copies, original and four copies to the subproject submission form indicating the "original" and "copy". Subproject application form shall also be submitted in electronic form on the CD (CD) or by sending to the operator's e-mail address that is specified in the invitation to tender. 43. the Subproject is the original and the copy of the application shall be drawn up in accordance with the laws governing record keeping requirements. The applicant in the application submitted to the operator a subproject in person or sent electronically to the operator's e-mail address that is specified in the invitation to tender, or sent by mail, on the envelope: 44.1. distribution of the Republic of Latvia Ministry of the environment, Flying 25-102 Street, Riga, LV-1050, Latvia;
44.2. contest name-"an interdisciplinary research and capacity building for environmental policy integration";
44.3. the applicant's name and address;
27.6. "not to be opened before the start of the assessment". 45. If the applicant shall submit the application electronically, subproject subproject application form and the required additional documents signed with a secure electronic signature and is certified by the stamp of the time before the subproject application closing date under the electronic document requirements set out in law. 46. the subproject in the application may not be governed by the corrections – deletions, aizkrāsojum, deletions and additions. The applicant is solely responsible for the information provided in the application a subproject for accuracy and precision. 48. If it is established that the applicant knowingly or recklessly made false statements, program managers may consider to suspend application of a subproject. 49. The children's submissions may be sent by post, electronically or submit in person. 50. The operator shall consider the submissions, which sub-projects have been filed operatorwith or put a post office (postal stamp) to the appropriate competition in the period referred to in the advertisement. 51. the subproject application received after the submission of the application sub-project end without opening, and the operator shall inform the applicant as to the place and time of application pending a subproject can get back. 52. By fax sent to the subproject submissions will not be accepted. IX. application assessment subproject 53. The operator registers the received applications and grants them a subproject identification numbers. 54. the subproject application for examination and evaluation operator creates a subproject application Evaluation Commission. The Evaluation Commission led by the Environment Ministry's Deputy State Secretary. The members of the Commission are the Ministry of environment strategies and Coordination Department, climate and renewable energy Department, environmental protection Department, Department of nature protection, investment Department Director or their deputies and one representative of the Ministry of the economy, regional development and local government Ministry, the Ministry of education and science, Ministry of agriculture, Ministry of transport and State Chancellery. 56. The Evaluation Commission is approved by order of the Ministry of the environment. 57. the subproject on submissions are evaluated according to administrative evaluation criteria (annex 4) and quality assessment criteria (annex 5). 58. application assessment Subproject, the Commission shall examine the conformity of the application sub-project administrative evaluation criteria for determining whether the subproject application meets the requirements and is directional quality evaluation criteria. 59. If the application does not meet the subproject administrative evaluation criteria, operator of the sub-projects the applicant requests in writing within a specified period to provide additional information or to clarify the application of the subproject. Deadline for additional information or clarification of the application of sub-projects cannot be longer than three working days. 60. If the specified subproject's application does not meet the administrative evaluation criteria or the provisions referred to in paragraph 59 of the subproject information principal applicant submitted within the time limit set by the operator, the operator shall take a decision on the rejection of the application of the sub-projects, except if made clarifications allows operator to decide on approval of the application of the subprojects provided pursuant to this provision, paragraph 66. 61. The operator shall, within 10 days after the decision on rejection of the application of the subprojects by post to the applicant justified the refusal of the application, stating the reasons for the rejection. 62. the Commission for the evaluation of the application of a subproject, the subproject when assessing each application according to the criteria for the evaluation of the quality, the amount of points earned. The maximum number of points is 76 points. If a subproject's application receives less than 4 points in any of the specified criteria, except "the international impact of the criteria" and "creation of employment and small and medium-sized merchant engagement", it is rejected. 63. the Commission for the evaluation of the application of the Sub-projects shall compare the submissions according to the sub-projects the resulting points. If two or more children have received the application of the same number of points, priority shall be given to the application of the subproject that is less than the total eligible costs. If two or more children have received the application of the same number of points and the children have the same total eligible costs, priority shall be given to the application in which the subproject is for partnership with the European economic area State Register of legal persons or public or local authority, or an international organization that works in another European economic area country. 64. The operator shall adopt a decision on the application for the approval of sub-projects, which are available in the competition as part of co-financing, comparing the subproject submissions according to the resulting points, has got the largest number of points. 65. If you create a subproject, listing submissions according to the number of points obtained in the application of the competition, the children in the framework of co-financing available as a result of insufficient funding has not acquired enough points to qualify for co-financing of the programme, it is rejected. The operator shall, within 14 days after the decision on rejection of the application of the subprojects by mail send a letter to the applicant of the project with the justification for rejecting the application of the subproject as a result of insufficient funding. 66. in order to ensure the timely and appropriate implementation of the sub-projects, the operator may take a decision on the application for the approval of sub-projects, which may include the following conditions that must be fulfilled before the applicant may enter into a contract for the implementation of the subproject: subproject 66.1. clarified the timetable for implementation;
66.2. the subproject should be clarified in the application budget and finances, if any arithmetic errors;
66.3. the subproject eligible costs exclude costs that this rule laid down in paragraph 32 as ineligible;
66.4. additional information should be provided, if the application is not included in the subproject complete information or the information included is not clear. 67. following these rules the conditions referred to in paragraph 66 of the total clarification of the application of subproject rating point scale does not change, as well as programme co-financing subproject is not increased. 68. The operator shall publish the results of the contest homepage on the internet (URwww.vidm.gov.lv). The implementation of the subproject agreement x. conclusion 69. The operator shall, within 10 working days after the decision on the application for the approval of sub-projects of program acceptance the applicant sent a letter to subprojects for the approval of the application and invite the applicant to conclude with the project managers for the implementation of the subproject agreement on the implementation of the sub-projects and financing conditions. 70. The applicant following the letter of approval and submission of subproject to subproject implementation submitted to the operator for the conclusion of the contract the institutions concerned the decision on debt or other financial instruments, if any, are intended to attract, children with the specified subproject in the amount of funding to be awarded. 71. The applicant following the letter of the project approval and submission to the conclusion of the agreement for the implementation of the sub-projects to submit to this provision the operator referred to in point 66. clarifications on the application of the subproject is a decision on the approval of sub-projects. 72. The operator shall conclude with the principal applicant for the implementation of the subproject agreement on the implementation of the sub-projects of program and funding conditions are met within available funding. 73. The applicant within 30 days after the decision on the application for approval of a subproject, the subproject managers for the implementation of the agreement. If the applicant does not conclude the contract for the implementation of the sub-projects with the operator within 30 days, or until the bottom of the contract for the implementation of the project shall be submitted to the rule referred to in paragraph 70 of the document, the applicant loses the right to enter into this agreement. 74. If this paragraph 73 for these reasons implementation of subproject contract with the principal applicant is not closed, the operator shall conclude contracts for the implementation of the sub-projects with the applicant that the application has the next highest number of points for quality assessment criteria of evaluation. Subproject application the applicant is familiar with all programs, co-financing of the conditions established in the European economic area financial instrument programme co-financed by the "environmental policy integration in Latvia" subproject application open competition "interdisciplinary research and capacity building for environmental policy integration" Charter and implementation of sub-projects undertakes to follow them. 2. the purpose of the Sub-projects and sub-project activities provided for under the comply with legislation and policy planning documents, if they lay down additional requirements related to the subproject within the activities to be implemented. 3. the Subproject is within the proposed activities meet the European economic area financial instrument control documents laid horizontal priorities: sustainable development, gender equality and good governance. 4. Children of the principal applicant has not violated the provisions of the Treaty in the framework of other agreements, which are locked with the operator, or another project that was co-financed in the framework of the Norwegian Government in bilateral financial instrument or the European economic area by means of financial instruments. 8. the activities provided for in the implementation of the Subproject will not be launched before the conclusion of the agreement on the implementation of the sub-projects with the operator. 9. the applicant a subproject and its partner will have access to stable and adequate financial and other resources, to determine the extent of its subprojects provided part of the funding, as well as the implementation of continuity of the subproject. Also, the applicant a subproject and its partner will be able to ensure the implementation of the sub-projects the required number of people who have the appropriate skills, knowledge, experience or understanding of the scope of the subproject. 10. the subproject the applicant prior to the submission of proposals for major changes in sub-projects (e.g. changes related to activities and cooperation partners) undertake to reach an agreement with the partner. If such agreement cannot be achieved, the sub-projects the applicant shall inform the program manager and submit the appropriate proposals for necessary changes. 11. If the implementation of the sub-projects are engaged in cooperation with partners, the children of the applicant commits partners to send a copy of the report of the project. 12. the Subproject on the applicant does not submit the same application for funding sub-projects from different financial sources, that is, it does not qualify to receive a double co-financing the same subproject. 13. the subproject has been carried out by the applicant State social security payments, paid taxes and other State and local minimum payments laid down in full in the laws of the Republic of Latvia within. 14. Subproject of the applicant is directly responsible for the preparation of subproject implementation and management, as well as on the results of the subprojects. The applicant is a subproject of the intermediary. 15. the Subproject on the applicant after the operator's request, submit the necessary additional information and documentation. 16. Estimated programme financing (cash and percentage) is calculated from the total eligible cost of the subproject. 17. the operator submitted the application copies subprojects are fully in line with the original subproject application submitted in accordance with the laws and regulations on the development and design of a document.
