No 59 12. §) rules on "operational programme infrastructure and services" Appendix apakšaktivitāt "regional 3.5.1.2.2. waste management system development" Issued under the European Union's structural and cohesion funds act 18 paragraph 10 of article i. General questions 1. determines the order in which the activities of the programme ' infrastructure and services ' Appendix 3.5. priorities "environmental infrastructure and environmental friendly energy contributes" UR3.5.1.pas "environmental infrastructure" apakšaktivitāt "regional 3.5.1.2.2. waste management systems development" (hereinafter activity) the project submission evaluation criteria, the applicant and the project authority.
2. The purpose of the activity is to create a sustainable waste management system, providing waste disposal and treatment in human health and the environmentally sound waste management and municipal services available in urban areas and 100 percent in rural areas to 80 percent of the population.
3. activities implemented in the framework of projects co-financed by the Cohesion Fund of the European Union (hereinafter referred to as the Cohesion Fund) funds, merchant and local government funds. Activities available within the Cohesion Fund co-financing are 28 182 440 dollars, national funding – 4 973 372 lats.
4. activities at the waste management region, companies and institutions.
5. the competent authority is the Ministry of the environment. The responsible authority provides all its functions, including appropriate competency ensured that would not be exceeded in these regulations for the implementation of the activities of the Cohesion Fund funding, and monitor the available funding under the Cohesion Fund, including the Council of 11 July 2006, Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999 93. Article 1 and 2 of the principle referred to in the performance of the activities and project level, controlling the project financial plan.
6. implement a limited activity in the project application selection.
 
II. Project activities eligible, eligible and non-eligible costs of the activity within the 7 supported waste management waste management infrastructure services for improving the quality and availability of adequate regional waste management plans – in the landfill and landfill supportive infrastructure, to ensure that laws and regulations according to the waste disposal and reduce waste to landfill sites for disposal of waste production.

Subject to the conditions contained in the Council of 11 July 2006, Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, the Council of 11 July 2006, Regulation (EC) no 1084/2006 establishing a Cohesion Fund and repealing Regulation (EC) No 1164/94, the relevant costs are the following: 8.1 the costs associated with the project application and supporting the preparation of the dossier for submission to the responsible body : 8.1.1. technical feasibility, the related escalation and with the environmental impact assessment documentation related to development costs, but not more than two per cent of the project total eligible costs set out in the decision of approval of the project application and agreement for the civil implementation of the project (hereinafter referred to as the civil law contract);
8.1.2. the development of the construction and related costs of būvekspertīz, but no more than four per cent of the project total eligible costs set out in the decision on the application of the project approval and contract in civil law;
8.2. autoruzraudzīb costs, but not more than 0.5 per cent of the eligible costs of the works;
8.3. building costs but no more than three percent of the eligible costs of the works;
8.4. the cost of the works;
8.5. supply contract, including technological equipment, Assembly and tuning costs.
9. Non-eligible costs include the following: 9.1. technical feasibility, the related escalation and with the environmental impact assessment documentation, related development costs exceeding two percent of project total eligible costs laid down in the decision approving the project submission and civil agreement;
9.2. the development projects and related costs of būvekspertīz, exceeding the four percent of project total eligible costs laid down in the decision approving the project submission and civil agreement;
9.3. autoruzraudzīb costs in excess of 0.5% of the eligible costs of the works;
9.4. building costs, which exceed three percent of the eligible costs of the works.
10. the project cost does not include: 10.1 administrative or project management objectives in the inventory of durable equipment used (hardware and vehicles);
10.2. fees for accounting and audit services;
10.3. the fee for the legal, technical and financial advice provided on the project during its implementation;
10.4. the project management personnel involved in project management fees and administrative costs, as well as the beneficiary's current maintenance costs;
10.5. working capital and loan funds the cost of the acquisition, paid for the review of the design of the loan, reservation and service charges for financial transactions, interest on arrears, penalties and expenses of litigation;
10.6. real estate purchase costs;
10.7. the implementation of the project particularly the purchase or production of durable equipment (equipment, which are used in the construction process) cost of acquisition;
10.8. the purchase of second-hand equipment;
10.9. expenses, which does not provide the immediate purchase of equipment (such as leasing).
11. the total budget of the project comprises also financial reserve, which can be up to five percent of the project's total eligible costs. The financial reserve of the project uses this provision set out in point 8 of the eligible costs incurred prior to the use of financial reserves by appropriate amendments to the civil contract.
 
III. Requirements to the project the applicant 12. Project applicant is a public service provider, laws in the order is responsible for the operation of the landfill.

14. the merchant who submitted a project application, is registered in the commercial register, in order to carry out the disposal of municipal waste in landfills and provide municipal landfill operation after commissioning of the landfill.
15. the applicant shall analyze the project costs and benefits according to the provisions of annex 1.
16. On the financing of the cohesion fund cannot qualify if: the applicant's project 16.1. tax debt on the application for the first working day of the month;
16.2. the project applicant is in liquidation or insolvency proceedings.
 
IV. A call for submission of the project application Project 17 the selection advertised two project application selection rounds. 18. the responsible authority shall send the invitation to submit a project application to the 12 and 14 of the provisions referred to in paragraph merchants. Invitation sent by mail or electronically (signed with a secure electronic signature, and the preparation of appropriate legislation on electronic document design): 18.1. first project application selection round – not later than two months after the entry into force of these regulations;

18.2. the second project application selection round-up to 15 December 2010.
19. the project application to the responsible authority within two months of the invitation is sent, the 12 and 14 of the provisions referred to in paragraph merchants.

15.9. municipal waste management region authorities jurisdiction over contracts with public service provider for the public service of waste management – municipal solid waste disposal in the landfill in question – the provision of municipal waste management in the region (copies);
25.7. licence for public service (copy);
25.8. sealed copy of the credit agreement or in the copy of the document issued by the lending institution, which shows that the credit will be granted without guarantees, if credit is provided without guarantee of a municipality;
16.1. the decision of the local government: for guarantee if 25.9.1. project for the municipality of guarantee;
25.9.2. that the Government match funding recipient project submission prepared and incorporates the work and funding;
25.10. the project cash flow forecast, reflecting the project's funding movement during project implementation;
25.11. the planned indicative procurement project plan according to the law, planning documents of the European Union in the field of the structural funds and the Cohesion Fund.
26. project submissions valued at administrative, compliance, quality and funding criteria.
27. the project submission evaluation administrative criteria are as follows: 27.1. the project applicant is invited to submit a project application;
27.2. the project proposal is submitted to the responsible authorities within the specified time limits;
27.3. the application of the project according to this provision and 24.1 24.2. bottom point.;
27.4. the project application is fully completed (annex 3);
17.1. the project attached to the application, all listed in the annex under paragraph 25 of these rules.

28.4. the project submission complies with activities: objective under this 28.4.1. the provisions of paragraph 2;
28.4.2. eligible activities under paragraph 7 of these rules;
28.4.3. eligible costs under this provision, paragraph 8;
28.4.4. non-eligible costs under this provision, paragraph 9;
28.5. project project description in the application provides the information you need about action to be taken;
28.6. the time schedule of the project comply with the planned activities;
17.8. the project information provided in the submissions demonstrate that the project will provide the applicant the sustainability of project results;
17.9. the project identified in the application works and equipment supply indicators meet the project schedule and includes key jobs that characterized the proposed goals;
46.8. project cost-benefit analysis carried out in accordance with the provisions of annex 1;
28.10. project financial analysis confirms the financial stability of the project;
No 28.11. the requested funding support rate based on project cost-benefit analysis;
No 28.12. project budget includes costs are justified;
28.13. project cash flow forecast is justified;
28.14. the indicative project procurement plan is based;
28.15. project in the application reflect the implementation of the planned projects in the organisation chart and the planned human resources supports legislation in certain functions of the beneficiaries;
28.16. project planned in the publicity and information dissemination activities comply with the laws and regulations on the cohesion fund the project publicity and information measures;
28.17. the project applicant is a public service provider, laws in the order is responsible for the operation of a landfill site;

28.24. project assessment of the financial situation of the applicant certifies the applicant's project financial stability after the implementation of the project.
29. project quality criteria for the evaluation of the application are the following: 29.1. project readiness stage (the number of points-two points must be obtained at least one;)
29.2. the planned implementation of the project (number of points – from zero to three points, must obtain at least one;)
29.3. the effectiveness of the implementation of the project in relation to direct waste management infrastructure improvement (points-three points, must obtain at least one;)
29.4. the project risk assessment, including assessing the potential cost increase (number of points – from zero to three points, must obtain at least one;)
29.5. the project in the application is analyzed for possible alternatives, and perform economic analysis of the project (number of points – from zero to three points, must obtain at least one;)
18.4. the waste management system-create the infra structure, including sustainable use of each evaluation (number of points – from zero to three points, must obtain at least one;)

18.5. the cost of return indicators – infrastructure planned lifetime (years) relative to the initial project total cost (in dollars) (the number of points – from one to three points, the benchmark gives extra points). 30. submission of Project funding criteria are the following: 30.1. the project submission complies with the administrative, compliance and quality evaluation criteria, as well as quality evaluation criteria overall rating is at least eight points.

Vi. application assessment and Project decision-making procedures 31. leader authority creates a limited application of the selection of projects project application Evaluation Commission (hereinafter the Commission assessment) and confirm the rules (including the replacement of members of the Commission procedures and the absence of expertise). 35. If the application is submitted to the responsible body within the time limit set in accordance with paragraph 24 of these rules or are not prepared for the Latvian language, the head of the responsible authority shall take a decision on the rejection of the application for the project.
36. evaluation the Commission shall assess the project submissions in the following order: 36.1. scored the first application project compliance with rules 27 and 28 of the criteria referred to in paragraph. If the assessment is in one of the following criteria is "no", the application is rejected and the project evaluation do not continue. 36.4. upon submission of a project for the establishment of a list of priority project submissions valued at 30.2. these provisions referred to in the criteria.
37. If two or more project applications have received the same amount of points, they ranked the project application priority list in the following order: 37.1. a project application with the highest rating for this rule 29.1. the bottom of the criteria referred to in paragraph 1;
37.2. the project application with the highest rating on these rules 29.2. bottom of the criteria referred to in paragraph 1;
37.3. the project application with the highest rating for this rule 29.3 bottom criteria referred to in paragraph 1. ';
37.4. a project application with the highest rating for this rule 18.5. below the criteria referred to in paragraph 1;
37.5. the project application with the highest rating for this rule 29.8. bottom of the criteria referred to in paragraph 1;

38. the head of the responsible authority shall take a decision on the application for the approval of the project, if it complies with those rules 27, 28, 29 and 30 of the criteria referred to in paragraph and paragraph 29 of these rules, the criteria referred to in the overall rating of at least eight points.
39. The decision on the application of the project approval may include conditions that the project applicant must meet the deadline set in the decision, so that it could conclude civil contracts for the implementation of a project: 24.3. to clarify the details of the project the applicant (contact information and property) (annex 3);

39.3. to clarify the changes in total amount and eligible costs the eligible costs under this provision, paragraph 8;
24.5. to clarify the changes in total amount of eligible costs and not eligible under paragraph 9 of these regulations;
24.5. to clarify the project time schedule according to the activities planned under this provision of paragraph 28.6;
24.6. to clarify the project cash flow forecast according to 28.13. these provisions;
24.7. to clarify the indicative project procurement plan under this provision 28.14.;
24.7. to clarify the application of the project reflect the planned introduction of the outline of the project and planned human resources security under this provision 28.15.;
24.8. specify information about publicity measures under this provision. 28.16.
40. This provision in the decision referred to in paragraph 39 of the conditions laid down in the project the applicant authorities met the prescribed period not exceeding two months from the date of receipt of the decision. The time-limits laid down in this decision cannot be extended.

42. If the applicant for the project conditions laid down in the decision is not complied with within the time limit set or the provisions referred to in paragraph 41 of the opinion is negative, the application shall be deemed to have been rejected. In the opinion of Justice controlled just like the decision, which contains the conditions for the control of this opinion is drawn up. The project specified in the application for funding, if the decision contains the conditions are not met, the next project diverted the application selection round.
43. a decision on project approval or rejection of the application to the competent authority within five working days after the decision by post or electronically (signed with a secure electronic signature).
 
VII. Procurement procedures and contracts closing 44. Procurement procedures shall take the beneficiaries of the Cohesion Fund (hereinafter referred to as the beneficiary).
45. the responsible authority in the month following the date of entry into force of the provisions of the Ministry of the environment website on the internet (www.vidm.gov.lv) publishes guidelines for procurement and procurement documents.
46. the first tender must be issued no later than three months from the date of approval of the application.
47. If the beneficiary does not comply with the procurement regulatory requirements or the laws that rule 46 of the conditions contained in, the cost of such contracts signed, considered as non-eligible costs of the project.
 
VIII. Payment conditions

48. The beneficiary based on legally binding contracts and accounting documents all the expenses that it has carried out.
49. the responsible authority civil contract within the time limits and in order to transfer an advance payment to the recipient of the funding. Advances and interim payments, as well as all project expenditure necessary means of funding the recipient opens an account in the Treasury. Beneficiaries, implementation of the project, all payments shall be made only from that account.
50. The beneficiary after the rules referred to in paragraph 49 of the account opening according to payment order fill in the Treasury of the specimen signatures card, certifying the person with authority to act for the account of the existing financial resources and a copy shall be submitted to the competent authority before payment of the draft.
51. On the end of the project in relation to the payment to the beneficiary is considered to be the date on which all procurement contracts of the project activities have been carried out and have been adopted pursuant to a purchase agreement and regulatory requirements in the area of construction (where the construction).
 
IX. conditions for the implementation of the project 52. The beneficiary all the project activities implemented within four years of the civil contract.
53. The beneficiary provides a snapshot into the homepage on the internet (if any) for the implementation of a project not less frequently than once every three months.
54. The beneficiary shall ensure that all payments under the contract for performance of the performers according to the purchase agreement deadlines, but not later than 90 days after final payment is received.
55. in the agreement the amendments not civil law by: 55.1. If the actual eligible costs not in relation to the project originally specified not eligible costs varies by less than 20 percent, below 50 percent of the total cost of the project;
55.2. If total project activity changes during the implementation of the project shall not exceed five percent of the approved projects in terms of money;

56. The beneficiary shall prepare reports and submit them to the responsible authority in the civil contract.
 
X. monitoring activities after the project beneficiary is 57. directly responsible for project implementation and maintenance of results for at least five years after the implementation of the project. The beneficiary for five years after the implementation of the project once a year in accordance with annex 5, the responsible authority shall provide information on: 57.1. the results achieved under the project in compliance with the objectives defined in the application;
57.2. project the project achieved the outcome and result indicators;
57.3. project results compliance with the environmental quality objectives and environmental legislation requirements;
57.4. waste management the adequacy of services planned;
57.5. in implementation of the project accumulated fixed asset owners;
57.6. implement service tariff policy compliance with planned;
57.7. the revenue resulting from the implementation of the project and the compliance with the planned;
57.8. public service status and changes;
57.9. public information activities about the project results and benefits to society.
58. those rules for the first time the form set out in annex 5 shall be submitted within one year of project implementation, and every year the civil agreement for the implementation of a project.
59. the responsible authority shall ensure that the storage and analysis of information on the objectives of the activity for at least five years after the implementation of all projects, if the civil agreement for the implementation of a project is not specified in the longer period.

3. Financial analysis includes the following parts: 3.1 funding rate calculated in accordance with Council Regulation (EC) No 1083/2006, article 55 (the Cabinet of Ministers of 18 august 2008 No. 667 of the provisions of the "rules for the operational programme ' infrastructure and services ' 3.5.1.2.2. Appendix apakšaktivitāt" regional waste management system development "annex 3);
3.2. calculation of the tariff corresponding to the "polluter pays";
3.3. operating costs and benefit analysis. Analysis prepares cash flow forecasts in the form of a 30-year period. At the beginning of the reporting period is the year when all the site are taken into service;
3.4. fixed asset depreciation. The life of the asset is determined based on the analysis of the alternatives.
4. Operating expenses and benefits analysis include the following: 4.1 revenue from waste disposal services;
4.2. the costs associated with waste disposal services.
5. Operating costs and benefit analysis does not include the depreciation of fixed assets, payments for credit and credit related interest. It includes the calculation of the profit or loss and adds the operating expenses and benefits analysis for the same period.
6. Operating costs and benefit analysis shall include at least the following parts: 6.1. cost of investment and existing assets;
6.2. economic activity changes in revenue and expenditure at current prices, including the applicant's revenue from the project waste disposal services for the last three years;
6.3. financial sources;
6.4. credit and their analysis, the three-year period;
