Cabinet of Ministers Regulations No. 750, Riga, 15 September 2008 (pr. No. 65 25. §) rules on "operational programme infrastructure and services" activity "Supplement 3.3.1.5. Urban infrastructure improvements in continuity with the TEN-T" Issued under the European Union's structural and cohesion funds act 18 paragraph 10 of article i. General questions 1. determines: 1.1. procedures for implementing the action programme ' infrastructure and services ' Appendix 3.3. priority "European transport network and the development of sustainable transport promotion" UR3.3.1.pas "contributes a large scale transport infrastructure improvement and development" activity "3.3.1.5. Urban infrastructure improvements in continuity with the TEN-T" (hereinafter referred to as the activity);
1.2 project submission evaluation criteria;
1.3. the requirements of the project applicant;
1.4. the responsible authority.
2. The purpose of the activity is comfortable and safe traffic city streets, urban infrastructure (main street) connects with the trans-European networks and Via Baltica improvements, increasing rail freight transport mitigation of negative impacts in relation to urban transport systems (places where the railroad divides the city into several parts).
3. activities to target road users.

II. Activity and one project available for funding from the Cohesion Fund, the amount of permissible aid intensity 5. total activity of the Cohesion Fund co-financing available volume is 83 701 188 lats. National co-financing for the project, the applicant may provide from their own funds, Government grants or in cooperation with private partners, chosen by the law. Government grants for co-financing of the project can get the legislation. The minimum national co-financing amount is 15 percent of the eligible costs of the project-14 770 798 dollars.
6. in the framework of the activity is not allowed to create any direct or indirect benefits of commercial companies (private partners) that could affect competition in the EU's internal market and to ensure specific companies (private partners) economic benefits.
7. minimum cohesion fund co-financing of the project total eligible costs per project is 20 448 828 lats. Maximum cohesion fund co-financing of the project total eligible costs per project is 63 252 360 dollars. Cohesion Fund funding intensity shall not exceed 85 percent of the project's total eligible costs.
 
III. The responsible authority and the applicant of the project activities implementation 8 responsible authority is the Ministry of transport. The responsible authority provides all its functions, including: 8.1. within the limits of its competence, ensure not to exceed this provision in paragraph 5 for the implementation of the activities of the Cohesion Fund financing available;
8.2. monitor the available funding under the Cohesion Fund, including the Council of 11 July 2006, Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, article 93 1 and 2 of the principle referred to in the performance of the activities and project level, controlling the project financing plan.
9. the competent authority, three years after the action programme ' infrastructure and services ' closing provides the revenue generated by the project, including the withholding of revenue recovery or that were not taken into account in calculating the available for the project under the Cohesion Fund and the State budget funding.
10. within the framework of the project the applicant activity can be the local authority in whose territory the lives of at least 100 000 inhabitants.
 
IV. Project activities eligible, eligible and non-eligible costs of the project assisted the 11 activities are a new line of street route development, which provides a separate part of the of the city effective mutual linking and association with the trans-European network elements (two level crossings with rail construction, road construction of trans-European networks, a new development road freight route).
12. the eligible costs of the project are: 12.1. parent path (Street) works;
12.2. the engineering construction of buildings;
12.3. Superintendence;
12.4. the site installation and removal;
12.5. the slip road construction, demolition and maintenance during the construction of the parent path;
12.6. the parent path of the road maintenance during construction;
12.7. the road (Street), a complex of works belonging to the inženiertīkl;
12.8. the traffic node creation and liquidation to ensure secure attachment to the parent path traffic;
12.9. bicycle and pedestrian path construction;
12.10. home improvement work (bus stops, lighting, landscaping, stormwater treatment facilities);
12.11. traffic safety equipment installation and restoration;
12.12. traffic control equipment installation and restoration;
12.13. publicity measures, in so far as it provides for the European Union structural funds and the cohesion fund management regulatory acts;
12.14. measures environmental protection requirements;
12.15. expenditure for contingencies this provision 12.1 12.2 12.7, 12.8, 12.9, 12.10., and referred to cover: not more than 10 percent of the eligible cost of the project (including the possible incidence of compensation projects) projects whose total cost is at least 35 140 200 lats, and no more than five percent, projects the total cost is less than 35 140 200 lats;
12.16. the non-recoverable value added tax payments.
13. not eligible costs of the project are: 13.1. land acquisition;
13.2. the road outside the existing communication and transfer of inženiertīkl or alteration necessary to carry out the construction of the road;
13.3. electricity connection fee;
13.4. designing and autoruzraudzīb;
13.5. road safety audits;
13.6. expertise;
8.5. other project inextricably linked costs.
14. The project can only contain this provision in paragraph 12 and 13 these costs.
 
V. Project application selection to tender, project submission, and submission of the project application form 15. the responsible authority shall invite the applicant to submit these draft regulations under the draft submission.
16. If the total cost of the project is at least 35 140 200 lats, project submissions presented pursuant to Commission Regulation (EC) no 1828/2006 laying down provisions for the implementation of Council Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund, and the European Parliament and Council Regulation (EC) No 1080/2006 on the European regional development fund Annex XXI, Latvian and English.
17. in paragraph 16 of these regulations for that project is added to the application of this provision, the information specified in annex 1 of the Latvian language.
18. If the total cost of the project is less than 35 140 200 lats, project submissions are presented according to annex 2 of these rules.
19. the project application can be submitted in paper form (by post or in person) or electronic document.
20. If the project application submitted in paper form, the submission of the project and the project cost-benefit analysis, the original and the copy of the application, add the project to the electronic version of a data medium (Insert documents in the form in MS Word, MS Excel format).

Vi. application of the procedure of evaluation of projects and project criteria for iesniegumuvērtēšan 25. Responsible authorities leader creates a project application to the Evaluation Commission.
26. the Commission's activities are governed by the head of the responsible authority's approved Charter.
27. the Evaluation Commission includes representatives of the Ministry of transport. Observers may participate in the evaluation the Commission managing body.
28. the Commission, in assessing project submissions under the Administration, eligibility and funding criteria, evaluation form, in the column "rating" refers to the application of the conformity of the project evaluation criteria ("Yes") or non-compliance with evaluation criteria ("no").

29. evaluation by the Commission, when assessing the project submissions according to the criteria of quality evaluation form column "rating" indicates the number of dots, or project submission compliance evaluation criteria ("Yes") or non-compliance with evaluation criteria ("no").
30. the project submissions are evaluated according to the following criteria: 30.1. an administrative project, the applicant is invited to submit a project application;
30.2. the project proposal is submitted to the responsible authorities within the time limit laid down;
30.3. the project is drawn up into the application;
18.9. If the total cost of the project is less than 35 140 200 lats, project submission prepared for the Latvian language, if the total cost of the project is at least 35 140 200 lats, the project application form completed in Latvian and English;
5. the project has been submitted to the original and the copy of the application (if the application is submitted in paper form);
19.0 submission of project pages are numbered (if the application is submitted in paper form);
19.1. a copy of the application the project comply with the project's original application (if the application of the draft submitted in paper form);
19.1. the project proposal is prepared according to the project application form;
19.2. the project application is fully completed and added to the set;
30.10. submission of the project financing plan and budget summary is no arithmetical errors;
30.11. the project is not specified in the application for correction, deletion, addition, deletion or aizkrāsojum;
30.12. project application is signed by the project head of the institution to the applicant or his authorised person;
30.13. Cohesion Fund co-financing percentage and the total amount is calculated correctly;
30.14. project cost specified in the application and their amount corresponds to the rules for the implementation of the activity cost and their scope.
31. the project submissions valued according to the following eligibility criteria: 19.3. the project applicant is municipality;
31.2. the project activities within the applicant has submitted only one project submission;
31.3. the applicant's project, the average population of the town according to the data of Central Statistical Bureau in 2006 is at least 100 000 inhabitants;
19.5. the project applicant is not a national tax and social security payment of the debt;
31.5. the project applicant has sufficient and stable financial resources to provide the national co-financing (the ability to provide co-financing without borrowing, or, if you have a loan obligations (loans, guarantees and long-term liabilities), which give a specific year is up to 20 percent of the general budget for the financial year revenue);
19.6. the project applicant is committed to providing funding of their own funds in the event of increased project costs;
19.7. the project application describes the project management, implementation and monitoring of the scheme;
19.8. the project application describes the implementation of the project required resources (in the number of staff involved, qualifications and responsibilities, the available material and technical base and the like);
19.8. the project management team have the appropriate experience and project management capacity, professional and technical knowledge. The project management team will be employed: 31.9.1. certified civil engineer with at least three years of experience in the field of road construction;
31.9.2. Project Manager with at least three years of experience in the management of transport infrastructure projects;
31.9.3. accountant-financiers with at least three years experience in financial accounting;
31.10. project implementation requires the land is the property of the applicant or of the project the project the applicant declares that he will be able to provide the necessary land acquisition to construction its beginning;
31.11. the project has been cost-benefit analysis;
31.12. project cost-benefit analysis is used in the social discount rate – 5.5 percent;
31.13. project current economic net present value (ENPV) is greater than zero;
31.14. economic rate of return of the project norm (ERR) is more than 5.5 percent;
31.15. the project has been the sensitivity and risk analysis;
31.16. the project will be completed by august 31, 2015.
31.17. project connects urban parts, separated by a natural or artificially created barriers and connects the city with the trans-European networks;
31.18. project implementation is immediate – existing transport system ensures comfortable and safe traffic, congestion is growing rapidly, increasing road traffic accidents, increasing freight transport stream has a negative impact on the city's transport system and increases emissions;
31.19. as a result of the implementation of the project will be optimized for urban passenger transport routes, passengers will decrease travel time;
31.20. required for the project under the Cohesion Fund co-financing does not exceed LVL 63 252 360;
31.21. project budget includes expenditure corresponds to the average projected market prices of construction project of the year and are required to achieve the project's results and the implementation of the planned activities;
31.22. application of planned projects monitoring indicators are clearly defined and measurable;
31.23. the project is not funded or not and co-financed by the European Union from other financial sources, as well as State and local budgets, as well as project planned activities do not overlap with the activities financed by other activities in European Union funds and other financial instruments;
31.24. project planned in the publicity and information dissemination activities to comply with European Union fund management-related laws;
31.25. ensuring the sustainability of the project results – ensure object maintenance after completion of the project.
32. project submissions are evaluated according to the following quality criteria: 32.1. project economic rate or return (ERR). Points are awarded according to the project's economic profitability margins size;
32.2. the project implementation period: 32.2.1. one year-3 points;
32.2.2. from one year (inclusive) up to two years – 2 points;
32.2.3. more than 2 years (including)-1 point;
32.3. in the implementation of the project will be taken into account in the construction of the Republic of Latvia laws and regulatory requirements and good practices with regard to accessibility for people with functional disabilities;
32.4. the project will prevent or reduce negative impacts on the quality of the environment;
32.5. the project linking national and regional development centers with the trans-European networks, thus creating the preconditions for a polycentric development.
33. This rule 32.1. the criteria referred to in point is 80 percent, 32.2. criteria referred to in the rate is 20 percent.
34. in order to determine the total score for this rule 32.1 and 32.2.. criteria referred to in subparagraph, the number of points earned are multiplied by the percentage of the proportion of the corresponding criteria.
35. project submissions are evaluated according to the following criteria: financing the project application met 21.8. this rule 30.1, 30.2, 30.3.., 18.9., 5., 19.1 19.2 19.1.,.,.,., 30.11 30.12. and in paragraph 31, 30.14. point and 32.3 32.4 32.5,. and. criteria referred to in paragraph 32.1 and 32.2. as well. in the criteria referred to in point total that at least 460 points;

VII. adoption of the Draft Decision 36. submissions judged in these terms, within the evaluation criteria specified in the order. If the application does not meet any of the criteria for the evaluation, except that rule 30.10., and 19.0 30.13. criteria referred to in the application for the project's compliance with the following evaluation criteria not assessed and project submissions rejected.
37. If the project needs clarification in the application according to this provision, and 30.10 19.0 30.13. subparagraph, the competent authority shall take a decision on the approval of the application, the project on condition.
38. the responsible authority shall within five working days after the decision on the application of the project approval, approval or rejection provided the relevant draft decisions forwarded to the applicant.
39. the decision on the application for the approval of the project provided the conditions contained in the project, the applicant provided within 15 working days after the decision.
40. Within five working days after the fulfilment of the conditions for the receipt of supporting documents evaluation the Commission shall assess the fulfilment of the conditions contained in the decision, and the responsible authority shall prepare an opinion. In the opinion of Justice control is done just like the decision, which contains the conditions to control this opinion is drawn up.
41. Where the applicant has complied with the decision on the application for the approval of the project provided the conditions laid down by the responsible authority within five working days after this provision 40. the expiry of the period referred to in paragraph 1 shall send to the applicant, project a positive opinion on the conditions contained in the decision.

42. If the decision contains the conditions are not met or are not met this provision, paragraph 39, within the time limit set in paragraph 40 of these provisions the competent authorities referred to in the opinion is negative and the project application is considered to have been rejected.
43. If the total cost of the project is at least 35 140 000 lats, the responsible authority within five working days after the decision on the application for the approval of the project or after the decision on the application for the approval of the project, provided the conditions of application of the draft sent to the managing authority.
44. The agreed conditions for project implementation, concluded between the authority and the beneficiary, the responsible authority shall specify the period of initiation of the procurement procedure.
