General questions 1. determines: 1.1. procedures for implementing the action programme ' infrastructure and services ' Appendix 3.3. priority "European transport network and the development of sustainable transport promotion" UR3.3.1.pas "contributes a large scale transport infrastructure improvement and development" 3.3.1.3. activity "big port infrastructure development" motorways of the sea "within" (hereinafter referred to as the activity);
1.2 project submission evaluation criteria;
1.3. the requirements of the project the applicant (hereinafter referred to as project applicant);
1.4. the responsible authority.
2. The purpose of the activity is to increase port capacity and security, as well as to promote the development of the port and to ensure their functionality.
3. activities to target shippers and recipients, as well as passengers.

II. Activity and one project available for funding from the Cohesion Fund and the amount of the allowable aid intensity 5. total activity of the Cohesion Fund co-financing available is 125 024 695 lats. National co-financing provides the project applicant or from the national budget (eligible costs), if it has accepted the decision of the Cabinet of Ministers. The minimum national co-financing amount is 15 percent of the eligible costs of the project-22 063 181 lats.
6. minimum cohesion fund co-financing of the project total eligible costs per project is 7 028 040 dollars. Maximum cohesion fund co-financing of the project total eligible costs per project is $65 220 211. Cohesion Fund funding intensity shall not exceed 85 percent of the project's total eligible costs.
III. The responsible authority and the applicant of the project activities implementation 7. the responsible authority is the Ministry of transport. The responsible authority provides all its functions, including: 7.1 ensure within the limits of its competence, not to be exceeded this in paragraph 5 of the rules laid down for the implementation of the activities of the Cohesion Fund financing available;

V. Project application selection to tender, project submission, and submission of the project application form 14. the responsible authority shall invite the applicant to submit these draft regulations under the draft submission.
15. If the total cost of the project is at least 35 140 200 lats and project application ready for submission to the European Commission, presented pursuant to Commission Regulation (EC) no 1828/2006 laying down provisions for the implementation of Council Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund, and the European Parliament and Council Regulation (EC) No 1080/2006 on the European regional development fund Annex XXI, Latvian and English.

17. 28. project submissions are evaluated according to the following criteria: 28.1. administrative project applicant is invited to submit a project application;
28.2. the project proposal is submitted to the responsible authorities within the time limit laid down;
28.3. the project is drawn up into the application;
28.4. the total cost of the project is at least 35 140 200 lats and project application ready for submission to the European Commission, the project application form completed in Latvian and English. If the total cost of the project is less than 35 140 200 lats, project submission prepared for the Latvian language;
28.5. project application has been filed and a copy of the original (where the application is submitted in paper form);
28.6. the project application pages are numbered (if the application is submitted in paper form);
28.7. copies of the applications of the project comply with the project's original application (if the application of the draft submitted in paper form);
17.9. the project proposal is prepared according to the Pro Ject application form;
46.8. project application is fully completed and added to the set;
28.10. project financing plan and budget summary is no arithmetical errors;
No 28.11. the project is not specified in the application for correction, deletion, addition, deletion or aizkrāsojum;
No 28.12. the project application is signed by the project head of the institution to the applicant or his authorised person;
28.13. Cohesion Fund co-financing percentage and the total amount is calculated correctly;

29. project submissions are evaluated according to the following eligibility criteria: 29.1. the applicant is a big project, port authority;
29.2. the project applicant is not a national tax and social security payment of the debt;
29.3. the project applicant has sufficient and stable financial resources to provide the national co-financing;
29.4. the project applicant is committed to providing funding of their own funds in the event of increased project costs;
29.5. the project application describes the project management, implementation and monitoring of the scheme;
18.4. the project application describes the implementation of the project required resources (for example, the number of personnel involved, qualifications and responsibilities, the available material and technical base);
18.5. the project management team have the appropriate experience and project management capacity, professional and technical knowledge. The project management team will be employed: 29.7.1. certified civil engineer with at least three years of experience in the construction of port infrastructure;
29.7.2. Project Manager with at least three years of experience in the management of transport infrastructure projects;
29.7.3. accountant-financiers with at least three years experience in financial accounting;
29.8. the project infrastructure, which will be carried out in project investment, the property of the applicant or in accordance with the law "on port" put it in his possession;
29.9. the project has been cost-benefit analysis;
29.10. project cost-benefit analysis is used in real financial discount rate of five percent and the social discount rate – 5.5 percent;
29.11. project current economic net present value (ENPV) is greater than zero;
29.12. project economic rate of return (ERR) rate is more than 5.5 percent;
29.13. investment project financial net present value (FNPV/C) is less than zero;
29.14. project financial investment yield rate (FRR/C) is less than 5 percent;
the project has made no 29.15. sensitivity and risk analysis;
29.16. the project will be completed by august 31, 2015.
29.17. port infrastructure does not provide adequate and safe access to the port from the sea and the land side, thus reducing the capacity of the trans-European networks and freight efficiency;
29.18. project implementation infrastructure created is for use of the port sharing;
29.19. the project is financially sustainable, cumulative project (undiscounted) net cash flow is positive 20 years after project implementation;
29.20. required for the project under the Cohesion Fund co-financing does not exceed 65 220 211 lat;

29.21. project activities meet the objective to increase port capacity and security, as well as to promote the development of the port and provide the functionality;
29.22. project budget includes expenditure corresponds to the average projected market prices of construction project of the year and are required to achieve the project's results and the implementation of the planned activities;
23. the project planned in the application monitoring indicators are clearly defined and measurable;
24. the project is not and has not been financed or co-financed from other Union financial sources as well as State and local budgets, as well as project planned activities do not overlap with the activities financed by other activities in European Union funds and other financial instruments;
29.25. project planned publicity and information dissemination activities to comply with European Union fund management-related laws;
8.43. ensuring the sustainability of the project results – ensure object maintenance after completion of the project;
29.27. project will ensure the consistency of the port environment;
29.28. projects under the Finance Ministry's original assessment of opinion not qualifying as a commercial support or, if a business qualifies as an aid project application has added to the evidence that the applicant of the project laws in accordance with the procedure laid down in the European Commission presented individual aid project announcement and do not start the implementation of the project before receipt of the decision of the European Commission on the project's compatibility with the Treaty establishing the European Community.
30. project submissions are evaluated according to the following quality criteria: 30.1. the project economic rate or return (ERR). Points are awarded according to the project's economic rate of return (ERR);
30.2. the project will contribute to the improvement of maritime safety: 30.2.1. direct – 2 points;
30.2.2. indirectly – 1 point;
30.2.3. not least – 0 points;
30.3. the project contributes to environmental pollution risk reduction: 30.3.1. direct – 2 points;
30.3.2. indirectly – 1 point;
30.3.3. not least – 0 points;
18.9. project implementation time: 30.4.1. up to one year (inclusive) – 2 points;
30.4.2. from one year to two years (including)-1 point;
30.4.3. more than two years – 0 points;
5. implementation of the project will be taken into account in the construction of the Republic of Latvia laws and regulatory requirements and good practices with regard to accessibility for people with functional disabilities (applied projects covered).
31. This rule 30.1. the criteria referred to in point 85 percent, the rate is 30.2 30.3 30.4., and the criteria referred to in the rate is five percent.
32. in order to determine the total score for this rule 30.1, 30.2, 30.3.. and 18.9. criteria referred to in paragraph below, the resulting score is multiplied by the percentage of the proportion of the corresponding criteria.
33. project submissions valued according to the following criteria: financing the project application 33.1. meet this rule 28.1, 28.2, 28.3..,.,., 28.7 28.4 28.5., 17.9, 18.0, No 28.11., No 28.12. and in paragraph 28.14.29 and 30 below the criteria referred to in points, as well as, 30.2, 30.3 18.7 and 18.9. in the criteria referred to in point total that at least 467.5 points;

VII. adoption of Decision 34. project submissions valued pursuant to these rules determine the order of the evaluation criteria. If the application does not meet any of the criteria for the evaluation, except that rule 28.6., 28.10. and 28.13. criteria referred to in the application for the project's compliance with the following evaluation criteria not assessed and project submissions rejected.
35. If the project needs clarification in the application according to this provision, 28.10.28.6 and 28.13. subparagraph, the competent authority shall take a decision on the approval of the application, the project on condition (a project the applicant within the time limit laid down in that decision provides the project submission complies with the relevant criterion).
36. the responsible authority shall within five working days after the decision on the application of the project approval, approval or rejection provided the relevant draft decisions forwarded to the applicant.
37. the decision on the application for the approval of the project provided the conditions contained in the project, the applicant provided within 15 working days after the decision.
38. Within five working days after the fulfilment of the conditions for the receipt of supporting documents evaluation the Commission shall assess the fulfilment of the conditions contained in the decision, and the responsible authority shall prepare an opinion. In the opinion of Justice control is done just like the decision, which contains the conditions to control this opinion is drawn up.
39. Where the applicant has complied with the decision on the application for the approval of the project provided the conditions laid down by the responsible authority within five working days after 38 of these rules. the expiry of the period referred to in paragraph 1 shall send to the applicant, project a positive opinion on the conditions contained in the decision.
40. If the decision contains the conditions are not met or are not met this provision, paragraph 37, the time limit set in paragraph 38 of these provisions the competent authorities referred to in the opinion is negative and the project application is considered to have been rejected.
41. If the total cost of the project is at least 35 140 200 lats, but the application is prepared for the project for submission to the European Commission, the decision on the application of the project approval or approval provided the determining authority indicates the project application preparation for submission to the European Commission.
42. If the total cost of the project is at least 35 140 000 lats, the responsible authority within five working days after the decision on the application for the approval of the project or after the decision on the application for the approval of the project, provided the conditions of application of the draft sent to the managing authority.
43. the Treaty for the implementation of a project between the authority and the beneficiary, the responsible authority shall specify the period of initiation of the procurement procedure.
