Cabinet of Ministers Regulations No. 1024 in Riga in 2008 on December 16th (Mon. 93.21 §) rules on the monthly premium to the old-age and invalidity pensions granted according to the law "on State pensions" transitional provisions 41 i. General questions 1. determine the amount of the monthly premium at the old-age and invalidity pension for insurance indemnity (hereinafter benefit), as well as premium and costs. 2. the premium depend on indemnity insurance (in full years), accrued to December 31, 1995 and on which Latvia has calculated the age or disability pension. 3. If a person according to the law "on State pensions" 42. transitional provisions or 46 insurance indemnity is reviewed for the period 1995 to December 31, with the amount of the pension review report also supplements. 8. the bonus granted by the State social insurance agency (hereinafter the Agency), on the basis of this provision of the information referred to in paragraph 2. 9. the premium shall be granted as of the date of eligibility of incurred. 10. The cost of the premium shall be renewed at the request of the Agency, but no earlier than the day on which the person come back to life in Latvia. 15. If the person of early old-age pensions are granted unemployment benefit or retirement pension, the premium to be paid to end unemployment benefits or retirement day. The cost of the premium in the day when you return the cost of old-age pensions. 16. where the premium is fixed at the early old-age pensions granted: 16.1. paying out benefits, apply the law "on State pensions" transitional rules 30 and 31;
16.2. the recipient of the premium in respect of the premium is subject to the same obligations as set out in the law "on State pensions" in article 34. 17. If this provision 15. or 16. in the case referred to in paragraph an overpayment, the premium deduction from the premium shall be made to the law "on State pensions" article 36, first paragraph, point 3. If the cost of the premium is interrupted, the overpayment is deducted from the pension. 18. In connection with the death of a beneficiary does not receive the premium paid in accordance with the law "on State pensions" article 37. 19. Be declared unenforceable in the Cabinet of Ministers of 22 November 2005 Regulation No 891 "rules on the monthly premium to the old-age pension" (Latvian journal, 2005, nr. 191; 2007, 2008, 92 no; no. 46). 21. Persons whose eligibility to the old-age pension is for the period before 1 January 2009, the premium for each insurance year 1995 seniority until December 31, is determined according to the following rules: 21.1. premium for the period from 1 January 2006 to 31 December 2006 19 per cent awarded one seniority year of insurance, personal insurance, if the total length of service of not less than 30 years and the amount of the pension awarded does not exceed 105 Lats per month (including pension, or part of the paid to other institutions of Latvia, European Union and European economic area Member States and countries with which the concluded international agreements on social security), and if the person during this time lived in Latvia;
21.2. the premium for the period from 1 January 2007 to 31 December 2008 may be granted 19 centimes per one insurance service year if the person the amount of the pension awarded does not exceed LVL 135 per month (including pension or part thereof paid to other institutions of Latvia, European Union and European economic area Member States and countries with which the concluded international agreements on social security) and the total length of service of insurance not less than 30 years but persons who are granted a pension on preferential terms for work of a particularly harmful and particularly arduous conditions or harmful and arduous conditions, the insurance indemnity is not less than 25 years and during this time lived in Latvia;
21.3. the premium for the period from 1 June 2008 to 31 December 2008 give a 40 cent per one insurance year length of service, if the amount of the pension awarded to a person of the month not exceeding 225 million lats (including pension or part thereof paid to other institutions of Latvia, European Union and European economic area Member States and countries with which the concluded international agreements on social security) and the person during this time lived in Latvia. 22. the rules shall enter into force on 1 January 2009.
