Cabinet of Ministers Regulations No 1059 in Riga in 2008 on December 16th (Mon. 93 83. §) rules for the assessment of conformity assessment bodies, accreditation and supervision Issued in accordance with the law "on conformity assessment" in article 13, first paragraph, and the environmental protection law, article 39 of the fourth part i. General questions 1. determines: 1.1. national accreditation system, which includes testing and calibration laboratories, management systems, personnel and product tificēšan body, Sir inspection and environmental verifiers bodies (hereinafter referred to as the conformity assessment body) assessment , accreditation and monitoring;
1.2. the procedures for establishing and maintaining accredited conformity assessment bodies. 2. Metrology and accreditation agency (hereinafter Agency) Department-the National Accreditation Bureau of Latvia (hereinafter the Office) European Union law the meaning of national level acts as the national accreditation body. 3. the Office shall be published in the Agency's homepage on the internet at European and international accreditation organisations, the list of documents for the implementation of those rules (hereinafter referred to as the applicable documents). II. National system of accreditation 4. Office assessed shall accredit and monitor the conformity assessment bodies in accordance with the standard LVS EN ISO/IEC 17011:2004 "conformity assessment. General requirements for accreditation bodies accredit conformity assessment bodies "and the applicable documents toš sais.
5. The Office does not regulate sphere evaluate, accredit and monitor: 5.1. inspection bodies according to the standard LVS EN ISO/IEC 17020:2005 "the main criteria for different types of bodies performing inspection" and the applicable documents;
5.2. management system certification bodies according to the standard LVS EN ISO/IEC 17021: conformity assessment 2007 ". Requirements for bodies providing audit and management systems certification "and the applicable documents;
5.3. the personnel certification bodies according to the standard LVS EN ISO/IEC 17024, conformity assessment: 2005 ". General requirements for the certification of persons and institutions ' documents;
5.4. test and calibration laboratories according to the standard LVS EN ISO/IEC 17025:2005 "the competence of testing and calibration laboratories-General requirements" and the applicable documents;
5.5. testing laboratories that work in the medical field, the standard LVS EN ISO 15189:2008 "medical laboratory. Particular requirements for quality and competence "or standard LVS EN ISO/IEC 17025:2005" the competence of testing and calibration laboratories-General requirements "and the applicable documents;
5.6. the product certification bodies according to the standard LVS EN 45011:2004 "General requirements for bodies dealing with product certification systems" and applicable documents;
5.7. the environmental verifier of the European Parliament and of the Council of 19 March 2001, Regulation (EC) no 761/2001 allowing voluntary participation by organisations in a Community eco-management and audit scheme, and the applicable documents. 6. the Bureau conformity assessment bodies regulated sphere assessed, accredited and monitored according to the rules referred to in paragraph 5 of the criteria and the regulations on conformity assessment, as well as the criteria set out in accordance with the applicable documents. III. Accreditation arrangements 7. the Agency shall, on the basis of the application of the conformity assessment body on its accreditation, conformity assessment bodies with contract. The contract determines the assessment procedures and the obligations of the parties under this provision the requirements of chapter II. 8. the Office will evaluate separately each type of conformity assessment bodies in accordance with the provisions of paragraph 5 or 6 of these requirements in the following sequence: 8.1 the accreditation of conformity assessment bodies shall provide it to the Office requested the information required for the evaluation;
8.2. Office: 8.2.1. designate the assessors and experts who are competent in the field of evaluation;
8.2.2. analyzes documents in applied for accreditation and conformity assessment bodies evaluated, including skills tests in different business areas;
8.2.3 after evaluation visits provide conformity assessment body evaluation report;
8.3. the conformity assessment body evaluation report within the time referred to take steps to eliminate the incompatibilities established. 9. on the basis of the results of the evaluation, the Office shall take one of the following decisions: to grant accreditation 9.1 if the conformity assessment body has met these terms or 6.5 above regulatory requirements. Accreditation granted initially for four years, following an accreditation procedure accreditation period is five years;
9.2. not to grant accreditation, where the conformity assessment body has not complied with these rules or 5 point 6 of that legislation;
9.3. the save if the accreditation accredited conformity assessment bodies performed the 5 or 6 the provisions referred to in point of law;
9.4. suspend accreditation for a period of up to six months if the accredited conformity assessment bodies found during the evaluation of the discrepancy is not very relevant, to cancel the entire sphere of accreditation the accreditation or in a part thereof;
9.5. to cancel the accreditation if an accredited conformity assessment body has not complied with these rules or 5 point 6 of that legislation or the provisions referred to in subparagraph 8.2.3. within the time limit set in the report not looking during the assessment of non-compliance found;
9.6. to extend the scope of accreditation, if an accredited conformity assessment body has met these terms or 6.5 above regulatory requirements apply for accreditation in addition to the field;
9.7. narrow the sphere of accreditation, if an accredited conformity assessment body has not complied with these rules or 6.5 referred to legislation in the field of accreditation. 10. the decision on accreditation, suspension or cancellation of a sphere in a citation shall also adopt narrow down if received accredited conformity assessment bodies in the application. 11. the decision on the suspension or withdrawal of accreditation agency accepted also if an accredited conformity assessment body does not comply with the provisions referred to in paragraph 7 of the conditions of the contract. 12. In the month following this rule 9.1, 9.6 and 9.7. referred to in decision making, the Office draws up the accredited conformity assessment body accreditation certificate and its annexes. 13. Office: 13.1. develop conformity assessment body evaluation plan for repeat visits, evaluation and other evaluation-related activities necessary to constantly monitor the, as accredited conformity assessment bodies fulfil the accreditation requirements;
13.2. determines the time intervals between the evaluation visits, not exceeding two years;
13.3. the monitoring plan evaluation visits, taking into account the other monitor in the bass;
13.4. can perform extraordinary assessment, if the received complaints about the activities of conformity assessment bodies, or information about the changes in its activities, as well as considering other supervisory action;
13.5. keep conformity assessment body evaluation reports, and ensure privacy. 14. test and calibration laboratories participating in skills testing or other comparison programs. 15. An accredited conformity assessment body for conformity assessment bodies the results of the evaluation using accreditation (annex). 16. The accreditation mark may not be used to mislead. Its use must not be contrary to paragraph 12 of this rule. 17. the Office once a month in writing inform the national Office of environment monitoring on the relevant review month accredited environmental verifiers and indicate that the information referred to in paragraph 18. IV. the conformity assessment body Accredited for the establishment and maintenance of a list of 18. the Office will establish and maintain accredited conformity assessment bodies. The list shall contain the following information: 18.1. the conformity assessment body accreditation number;
18.2. the conformity assessment body name, legal address and the actual site address;
18.3. the conformity assessment body in the field of accreditation;
18.4. the period of validity of the certificate of accreditation;

18.5. the period of suspension of the accreditation of these rules in the case referred to in paragraph 9.4. 19. the Bureau updates the accredited conformity assessment bodies the information contained in the list of accredited conformity assessment bodies. List available in the Agency's home page on the internet. V. concluding questions 20. Be declared unenforceable in the Cabinet of Ministers of 11 February 2008, Regulation No 96 "rules on accreditation of conformity assessment bodies and the monitoring of" (Latvian journal, 2008, no. 26). 21. the rules shall enter into force on 1 January 2009.
