Cabinet of Ministers Regulations No. 321 in Riga 2009 April (7. No 23 42) the procedures for granting state aid in the European Union fisheries development water environmental measures Issued under the agricultural and rural development Act article 5, fourth paragraph i. General questions 1. determines the order in which the State and the European Union support for the development of fisheries in the European Fisheries Fund for the implementation of measures to support the "environmental measures" (hereinafter measure) in accordance with Council of 27 July 2006, Regulation (EC) no 1198/2006 on the European Fisheries Fund (hereinafter Regulation No 1198/2006) and the Commission of 26 March 2007 Regulation ( EC) No 498/2007 laying down detailed rules for the implementation of Council Regulation (EC) no 1198/2006 on the European Fisheries Fund.
2. the support shall be granted in the event of fish pond area (hereinafter referred to as the aid applied for the pool area), if the total aid applied for the pool area that is less than three hectares and each pond area that is less than 0.1 ha, and: 2.1. registered real estate national cadastre information system as the ground beneath the fish pond or fish pond;
2.2. support the applicant has registered agricultural data centre as the aquaculture animal housing;
2.3. it is used for the production of aquaculture animal production of the sale according to the requirements of this regulation. 
II. conditions for receiving the aid of the applicant 3. support for log pond area to support the commitments set out in these rules for five years, starting with the first payment of the aid approval (hereinafter undertakings). Obligations shall enter into force on the date on which the applicant submits to the rural support service of regional agricultural administration this rule referred to in paragraph 11.
4. the applicant shall satisfy the following conditions: support 4.1 is a food and veterinary service recognises the aquaculture production business in accordance with the legislation on veterinary requirements of the aquaculture animals, their products and their movement, and it complies with the laws and requirements of the animal health, veterinary and environmental fields;
4.2. the income from aquaculture production sales last year concluded there are at least 120 lats from the pond to support each area per hectare;
4.3. is registered as a taxable person in the State revenue service, and has no tax arrears;
4.4. has received permission to use water resources in accordance with the laws and regulations on the use of water resources;
4.5. has received a category B or category C permit of polluting activities certification in accordance with the laws and regulations on the procedures of piesakām A, B, and C categories of polluting activities;
4.6. in accordance with the legislation on statistical reporting to the Central Statistical administration submits a report on the operation of the aquaculture in the last calendar year.
5. the applicant receives support, if a five year commitment period following receipt of the aid conditions: 5.1. producing and selling on aquaculture production at least 120 lats a year from each of the aid per hectare of area of the pond;
5.2. each year, in accordance with the provisions of paragraph 11 of the application for aid shall be submitted to the piesakām pond the area;
5.3. aid log pond area is not replaced by the other pool areas and does not reduce support for log pond area;
5.4. use of aquaculture animal production methods that ensure that: 5.4.1. the average breeding density of aquaculture animals in the pond applied for support in the area of not less than 120 kilo grams per hectare (catch data), except for juvenile rearing ponds, which under the rural support service of the pond location map does not exceed 20 percent of the total support of the pond;
5.4.2. the maximum density of aquaculture animals in each support log pond does not exceed 600 kilograms in per hectare (catch data). This limitation does not apply to hibernation, quarantine, breeding and rearing ponds of pirmstirg, in accordance with the rural support service of the pond location map does not exceed 20 percent of the total support of the pond;
5.5. use fertilizer only ponds solid manure, applying the maximum of 400 kilos per hectare of the area of the pond and fertilizer making up the current year 30 April. This time limit does not apply to juvenile rearing ponds;
5.6. ponds uzplūdin to 31 May of the current year, excluding pups growing, quarantine and wintering ponds;
5.7. the ponds with water vasarošan drop out at no more than 20 percent support in the area of the pond or log on at the same time of not more than one summer the pond area which does not exceed 40 percent of the total support of the pond area. Each summer the pond more frequently than once every five years;
5.8. ensure that the requirements necessary for the performance of activities in the aquaculture business accounts registration journal (annex 1). Aquaculture activity log records data on activities in each of the company's aquaculture pond, including data on the treatment of uzplūdināšan pond and the drop time, the movement of the fish, the quantity, in kilograms, and the pond fertilization. Records in the aquaculture business registration journal shall be made not later than one day after the relevant transaction;
5.9. inform the rural support service during the year in support of the commitment log pond and leaving no later than five working days before they start.
6. On the basis of vasarotaj of the pond to support areas support the applicant support during the year.
7. The amount of aid applied for the support of the pond area which all mentioned in these rules the conditions for receiving the aid, is 241 Lats per hectare per year according to the support log pond location map, prepared in these terms in that order.
8. If a five year commitment period the beneficiary of the aid partially or fully suspended those rules, established it in accordance with the laws and regulations relating to procedures to manage and monitor national and European Union support for agriculture, rural development and fisheries, as well as the order in which publishes information on beneficiaries, repaid the support on the support part of the area of the pond applied for which are not fulfilled.
9. If the aid applied for the pool area completely or partially transferred to other person, which is the rural support service customer, that person can take over the obligations of the beneficiary to take over the commitment period. If the commitment is not taken over, the beneficiary of the aid in accordance with the laws and regulations relating to procedures to manage and monitor national and European Union support for agriculture, rural development and fisheries, as well as the order in which the publish information on the beneficiaries shall repay the entire commitment period the amount of aid received. 
III. Support to request and assign 10. Field Support Department after coordination with the Ministry of agriculture in the newspaper "journal" in the current year not later than one month before the rule 11. expiry of the period referred to in paragraph 1 shall issue a project submission and acceptance of a five-year commitment period for public funding.
11. To apply for aid for the current year, the support of the commitment by the applicant to the May 15 Field support regional agricultural administration, within the territory of which the largest pond in the area applied for, personally or in the form of electronic documents in accordance with the laws and regulations on the circulation of electronic documents shall submit the following documents: 11.1. application completed (annex 2) in two copies;
11.2. the real property cadastre of the State information system established within the land boundary plan or a copy of the plan of the situation with the pool location and explication in the specified area of land and pond-in the first year of the application, taking a five-year commitment;
11.3. the rural support service in support of the position of the pond applied for the card, which marked the pond in any manner (for example, FRY-rearing pond, wintering the pond, pond quarantine, breeding pond, pond pirmstirg or vasarojam), except for the first year of the application, taking a five-year commitment when the pond location map prepares the rules 20, 21, 22 and 23 above.
12. supports the applicant for all support of areas claimed by the pond in paragraph 11 of these provisions in that order with a single application.
13. the rural support service of the State revenue service receives the support of the applicant's annual accounts (full set) for the last year concluded, if the applicant that a certified copy of the annual report with the State revenue service check or proof of receipt are not submitted together with the present rule 11.1. bottom of this submission. Support the applicant shall prepare annual accounts in accordance with the annual accounts Act.

14. If the tenderer 11.1 these rules referred to in the application is submitted after May 15, but not later than 25 calendar days after this deadline, the amount of aid the applicant could receive reduced by one percent for each working day of delay, unless the application could not be submitted within the prescribed period in exceptional circumstances. If the delay lasts more than 25 calendar days, the application shall not be accepted.
15. If the applicant is applying for aid in accordance with the laws of the State of the European Union and the granting of aid for the direct support schemes for agriculture in the context of this provision in paragraph 11 above, the applicant shall submit the supporting documents in the same Field support regional agricultural administration, which submitted for support to agriculture direct aid under the scheme.
16. Amendment of this rule 11.1. bottom support application referred to in paragraph the tenderer may submit the field support regional agricultural administration till 15 June of the current year, if the service is not informed the applicant of the aid for errors or the documents submitted, the previously announced an on-the-spot check, the aquaculture companies have found irregularities in connection with the support of the applicant, the aid sought for pond areas.
17. If the rural support service support make a request in writing to the applicant for additional information to support the applicant within two weeks after receipt of the request, submit the requested information in the rural support service.
18. If the tenderer that rule 17 the deadline referred to in paragraph has not submitted the requested information about a specific pool, the rural support service to the amount of the aid shall be reduced by the payment of a specific unit-pond. In other cases, the application is rejected.
19. If this provision, paragraph 10 calls for public funding is not sufficient for approval of all submissions that you submit to support applicants launched a five year commitment period, the rural support service: 19.1. ranked submissions according to the number of points earned: 19.1.1 each aquaculture company logged per hectare of the area, which is located in Natura 2000 sites in the two criteria points;
19.1.2. for each sign up for aquaculture business areas acres outside Natura 2000 sites, assign criteria;
19.2. the priority given to public funding submissions, which are given a higher score. If compliance with the selection criteria receive the same number of points, priority to get public funding is supporting the applicant who applied for support of body of water located in Natura 2000 sites;
19.3. the project submissions, of which the number of points awarded is not a sufficient public funding, in the current year.
20. supports the applicant whose application conforms to the requirements of these provisions and that a five year commitment period is sufficient for this provision the funding referred to in paragraph 10, in the first year of the application, taking a five-year commitment, Field support services, prepare the pond applied for a position in support of a card that also uses it in the first year of the commitment (e.g., juvenile rearing pond, wintering the pond, pond quarantine, breeding pond, pirmstirg or vasarošan in the pond).

22. 24. If the service finds a breach of obligations for the first time during the year to support the aid shall be paid to the applicant. If the rural support service repeatedly finds any condition is not satisfied, the undertaking is considered terminated and the beneficiary shall repay the entire amount of aid received.
25. the rural support service will not be withheld from payments made by the beneficiary, in accordance with the laws and regulations on the procedures for administering and monitoring State and European Union support for agriculture, rural development and fisheries, as well as the order in which publishes information on beneficiaries.
26. the rural support service this provision in paragraph 24 and 25 that repayment is not required in exceptional circumstances, if the obligations have not been met: 26.1. large aquaculture enterprise part of the corresponding land expropriation if it could not anticipate the day when the beneficiary undertook obligations;
26.2. natural disaster that significantly affect the company's activities in the field of aquaculture;
26.3. State supervision of infectious diseases of aquaculture animals, affecting all of the beneficiaries of aquaculture animals or parts of them.
27. If this provision was a paragraph 26 referred to emergency cases, the beneficiary of those 10 working days (starting from the date when such an opportunity arises) in writing to the rural support service of regional agricultural administration, which filed the application, as well as submit: 27.1. detailed description of the emergency conditions;
27.2. exceptional circumstances supporting documents.
28. the rural support service after these rules a condition worthy of inspection and selection of support submitted by the applicant to the submissions, as well as adopt and communicate the decision in accordance with the laws of the State of the Union support for rural and fishery development.
29. the rural support service support shall be paid annually during the period from December 1 for the year to next June 30 of the calendar year.
30. the rural support service of the decision on the granting of aid to support the applicant can challenge and appeal to the rural support service in accordance with the procedure prescribed by law.
31. The food and veterinary service and the State Department of the environment to the current year's September 1 submit Field support services for the period from 16 august of the previous year to the current year's 15 august inspections identified inconsistencies or irregularities in the rural support service in aquaculture enterprises.
32. the State land Department, the land registry of the country-wide computer holder, State revenue service, the Central Statistical Bureau, the State Environmental Department, the food and veterinary service and agricultural data centre provides field support service after the Administration request the required information on the aid applicants. 
IV. final question 33. To aid in 2009 may be eligible up to 31 December 2008 the food and veterinary service of the aquaculture company established if it up to 1 October 2009. the company's aquaculture industry make the recognition procedure, which represents the food and veterinary service issued the company's aquaculture industry recognition certificate. If, within that period, the applicant has not received the support of aquaculture industry recognition certificate, the application of the Field support service.
