Cabinet of Ministers Regulations No. 477 Riga, 26 May 2009 (pr. No 33 36) amendments to the Cabinet of Ministers of 20 April 2004, regulations No 354 "provisions on essential requirements for cosmetic products and their supervisory order" Issued in accordance with the law "on conformity assessment" article 7, first subparagraph, and the consumer protection law is article 21, first paragraph 1. make the Cabinet of 20 April 2004, regulations No 354 "provisions on essential requirements for cosmetic products and their supervisory arrangements" (Latvian journal , 2004, 68, no. 185; 2005, 8, 63, 157, no. 201; 2006, 90, no 149; in 2007, 33, 108, 160. no; in 2008, 29., 122 no; 2009, no. 29) 1.1. the following amendments: to replace in paragraph 2, the word "product" with the word "mixture";
1.2. make 6.9. subparagraph by the following: "6.9. substances which in accordance with the European Parliament and of the Council of 16 December 2008, Regulation (EC) no 1272/2008 on classification, labelling and packaging of substances and mixtures, and amending and repealing directives 67/548/EEC and 1999/45/EC and Regulation (EC) No 1907/2006 (hereinafter Regulation No 1272/2008), annex VI, part 3 is classified as 1a. 1. (B) category 2 carcinogenic, mutagenic or toxic for reproduction substances. Substances classified as category 2 carcinogens, mutagens, or toxic to reproduction substances may be used in cosmetics if the European Commission's Scientific Committee on consumer safety (SCCS-Scientific Committee on Consumer Safety) they have assessed and found to be acceptable for use in cosmetic products. ';
1.3. make 18.1. subparagraph by the following: "where the final composition 18.1. the conformity check was carried out by testing the animals by a method other than an alternative method after the alternative method has been validated and adopted at European Community level, taking into account the development of the validation of the Organisation for economic cooperation and development (OECD-Organisation for Economic Co-operation and development) (hereinafter referred to as alternative test methods);";
1.4. to express a point 19 by the following: "19. prohibited the use in animals: 19.1 finished cosmetic testing to determine their compliance with the requirements of this regulation;
19.2. the ingredients of cosmetic products or ingredients combination testing to ensure compliance with the requirements of this regulation not later than the day on which the following tests should be replaced by one or more validated methods listed in Commission of 30 may in Regulation No 440/2008/EC on the testing methods of determining in accordance with European Parliament and Council Regulation No 1907/2006/EC, concerning the registration, evaluation, authorisation and restriction of chemicals (REACH) whether this provision in annex 14. ';
1.5. to replace the words "paragraph 25.7 preparation" with the word "mixture";
1.6. make 68 as follows: "68. 68.2. the hazard classes 3.1 (acute toxicity), the hazard class 3.2 (skin corrosion/irritation), 3.3 hazard class (serious eye damage/eye irritation), 3.4. hazard class (sensitisation by inhalation or contact with skin), hazard class 3.5 (stem cell mutagenicity), 3.6. hazard class (carcinogenicity), 3.7 hazardous class (toxic effects on reproductive function) for adverse effects on fertility or dzimumfunkcij and on development, 3.8 hazard class (toxic effects on non-single exposure) as concerns the impact on the that is not a narcotic effects, 3.9 hazard class (toxic effects on non-repeated exposure), 3.10. hazard class (breathing hazard);
68.3. hazard class 4.1 (water substances dangerous for the environment);

1.7. to supplement the information in reference to European Union directives, paragraph 1 with 65, 66 and 67. subparagraph by the following: ' 65) European Parliament and Council Directive 2008/112/EC of 16 December 2008 amending Council Directive 76/768/EEC, 88/378/EEC, 1999/13/EC of the European Parliament and Council Directive 2000/53/EC, 2002/96/EC and 2004/42/EC in order to adapt it to Regulation (EC) no 1272/2008 on classification, labelling and packaging of substances and mixtures;
66) Commission Directive 2008/122/EC of 18 December 2008 amending Council Directive 76/768/EEC, concerning cosmetic products, for the annexes II and VII to technical progress;
67) Commission directive 2009/6/EC of 4 February 2009 amending Council Directive 76/768/EEC, concerning cosmetic products, for the purpose of adapting Annexes II and III thereto to technical progress. ";
1.8. make 2. paragraph 16 of the annex by the following: "4.

2. This rule 1.13. Sub-paragraph shall enter into force on 8 July 2009.
3. These rules and 1.12. subparagraph 1.8 shall enter into force on 8 October 2009.
4. This rule 1.9. subparagraph as well as 1.10. subparagraph for 190.189, 191 points and shall enter into force on 5 November 2009.
5. This rule 1.10. subparagraph relating to 188 above shall enter into force on 5 February 2010.
6. This provision 1.1., 1.3, 1.4, 1.5, 1.14 and 1.15. subparagraph shall enter into force on 1 June 2010.
7. This provision 1.2. and 1.6. subparagraph shall enter into force on 1 December 2010.
