2. The purpose of the activity is to reduce the risk of flooding in areas that meet the flood risk assessment and management of the national program of the first flood risk or emergency scenario 1 c criterion.
3. activities implemented in the framework of projects co-financed by the European regional development fund. Activity within the available public funds are 4134140 dollars, including the European regional development fund co-financing-3514020 lat and the State budget and local government funding – 620120.
4. activities in the implementation of the responsible authority is the Ministry of the environment (hereinafter referred to as the responsible authority). The responsible authority has the following functions: 4.1 provide the European Regional Development Fund (hereinafter the project), in assessing the application, project submissions by the European Regional Development Fund for funding;
4.2. to provide information on the project applicant project application preparation;
4.3. during the two months following the entry into force of these regulations to publish the Ministry of environment Web site shopping guideline and procurement documents;
4.4. to participate in the development of the arrangement for the implementation of a project (hereinafter referred to as the agreement);
4.5. information activities for planning activities and public information, Ministry of the environment Web site, including activities within the projects approved;
4.6. to ensure that these regulations are not exceeded in certain activities available for the implementation of the European regional development fund co-financing and monitoring available in the European regional development fund co-financing, including the Council of 11 July 2006, Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, article 93 1 and 2 of the principle referred to in the performance of the activities and project level by controlling the project financial plan.
5. the cooperation body is the Central Finance and contracting agency. The cooperation body is the functional authority. The cooperation body has the following functions: 5.1 develop and enter into an agreement with the European regional development fund co-financing beneficiary (beneficiaries);
5.2. to examine the funding requested procurement plan and submit it to the procurement monitoring Bureau;
5.3. European regional development fund and the State budget of co-financing funding planning and use of funds in accordance with the terms of the agreement concluded with the beneficiary;
5.4. to consider and approve the financing requested progress reports submitted and verified payment requests, approve the payment requests included attributable expenditure amounts, prepare payment orders and submit them to the paying authority;
5.5. to prepare the statement of expenditure and to present its leading body;
5.6. to prepare the European regional development fund and the payment forecasts to submit its payment authority and the managing body;
5.7. to provide information on the authority responsible for the implementation of the activities available in the European regional development fund co-financing;
5.8. ensure accumulation of information about projects and its transfer to the European Union's structural funds and the cohesion fund management information system;
5.9. to plan and implement information and publicity measures on the project level, including to provide funding to the recipient of the opinion on the agreement conditions and project locations to monitor the provision of publicity measures, laid down in the Commission of 8 December 2006, Regulation (EC) no 1828/2006 laying down provisions for the implementation of Council Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund , The European Social Fund and the Cohesion Fund, and the European Parliament and Council Regulation (EC) No 1080/2006 on the European regional development fund;
5.10. the conclusion of the agreement to publish on its website information on the projects;
5.11. to provide the supervision and control of the activity, including the Council of 11 July 2006, Regulation No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, article 93 1 and 2 of the principle referred to in the implementation of the project, as well as to assess the risks and prepare a draft annual plan of inspections in the project locations in cooperation with the responsible authority to carry out inspections project locations;
5.12. to consider amendments to the agreement, to take a decision on the approval or rejection of amendments and match them with the responsible authority, if the amendment includes changes: project monitoring indicators 5.12.1.;
5.12.2. the project activities, providing for the inclusion of new activities or the activities of the project changes in financial terms exceeded 20 percent of the total cost of the project;
5.12.3. the project will cost more than 20 percent of the total cost of the project.
6. Activity implemented an open project selection application form.
II. Project activities eligible, eligible and non-eligible costs of the activity within the 7 support structures of existing waterworks reconstruction of flood-threatened areas.

8.2. autoruzraudzīb and building costs, but not more than four percent of the eligible costs of the works;
8.3. the cost of the works;
8.4. the contract of supply costs, including costs of technological equipment, Assembly and adjustment.
9. the total budget of the project comprises also financial contingency reserve, which can be up to five percent of the project's total eligible costs. The financial reserve of the project uses this rule 8, paragraph direct eligible costs incurred prior to the use of financial reserves by appropriate amendments to the arrangement.
10. costs may not be considered eligible, if the project at the date of application of the shipbuilding is accepted and the goods have been signed and acceptance.
11. Non-eligible costs are as follows: 11.1. project preparation costs-project feasibility, its escalation and the environmental impact assessment documentation related to development costs, technical design, development of construction and related costs of būvekspertīz, exceeding six percent of the total estimated eligible project costs;
11.2. autoruzraudzīb and building costs, which exceed four percent of the eligible costs of the works.
12. non-eligible costs of the project can not be greater than 10 percent of the project's total eligible costs. State budget institution not eligible costs of the project does not plan from the State budget.
13. the project submission does not include the following costs: 13.1 administrative or project management objectives of durable equipment used (hardware and vehicles);
13.2. fees for accounting and audit services;
13.3. the fee for the legal, technical and financial advice provided on the project during its implementation;
13.4. project management the remuneration of the staff and administrative expenditure of the project, the beneficiary's current maintenance costs, as well as publicity costs if they exceed the minimum requirements set by the laws and regulations of the European Union fund co-financed project publicity and visual identity requirements;
13.5. working capital and loan funds the cost of the acquisition, paid for the review of the design of the loan, reservation and service charges for financial transactions, interest on arrears, penalties and expenses of litigation;
8.5. real estate purchase costs;
8.5. the implementation of the project particularly the purchase or production of durable equipment (equipment, which are used in the construction process) cost of acquisition;
13.8. the purchase of second-hand equipment;
13.9. expenses, which does not provide the immediate purchase of equipment, such as leasing.
III. Requirements to the project the applicant 14. applicant of the project can be local authorities and governmental institutions in accordance with the laws and regulations in the field of civil protection provides a flood measures.
15. the project for the implementation of the project, the applicant does not constitute a partnership.
IV. Project application selection 16. Project application selection issued two selection rounds according to the respective selection round available for the European regional development fund co-financing funds: 16.1. the first application round project for the European regional development fund co-financing are 1 757 010 lats;
16.2. the second project application selection round for the European regional development fund co-financing are 1 757 010 lats;
16.3. If the first application round of projects available for the European regional development fund co-financing is not granted or used, it directs the second project application selection round of financing.
17. the responsible authority for the project submission application (hereinafter referred to as the notice) issued: 17.1. first project application selection round – not later than two months after the entry into force of these regulations;
17.2. the second project application selection round-up for March 1, 2011.
18. The notification shall specify the project application selection round of the funding available, the start date and end date. The responsible authority shall issue notice: 18.1. newspaper "Gazette";

19. Vi. Project application evaluation and decision-making 25. the responsible authority shall create an open project application selection by the European regional development fund project submission Evaluation Commission (hereinafter the Commission assessment) and approved its Statute. The Evaluation Commission is made up of responsible authorities, Ministry of the environment, municipal Union of Latvia, as well as representatives of associations and foundations whose operational objective related to environmental issues. Evaluation of the managing authority and the Commission, the cooperation body is the observer.
26. the responsible authority: 26.1. in the month following the entry into force of these regulations are developed and approved a project application selection project application assessment methodology and application form filling project methodology;

30. evaluation the Commission shall assess the project submissions in the following order: 30.1. first project submissions valued in conformity with this provision of the Annex 33.2, 35 and 36 referred to administrative criteria. If the assessment is in one of the following criteria is "no", the application is rejected and the project evaluation do not continue;
30.2. If the application of these rules 30.1. in the criteria referred to in (a) evaluates to "Yes", the application is assessed according to annex 2 of these rules 13, 14, 17, 19, 20, 21, 22, 23, 24, 25, 29, 30, 31, 32, 34, 37, 40, 41, 42, 43 and 44. criteria referred to in paragraph 1. If the assessment is in one of the following criteria is "no", the application is rejected and the project evaluation do not continue;
30.3. 31. If two or more project applications have received the same amount of points, they ranked the project application priority list in the following order: 31.1. application of the project that received the highest rating this provision of the annex 2 criteria referred to in paragraph 1;
31.2. the submission of the project that received the highest rating this provision of the annex 2 criteria referred to in paragraph 2;
31.3. the application of the project that received the highest rating this provision 2. criteria referred to in paragraph 8;
19.5. the submission of the project that received the highest rating this provision 2. criteria referred to in paragraph 6;
31.5. the application of the project that received the highest rating this provision 2. criteria referred to in paragraph 9.
32. the head of the responsible authority shall take a decision on the application for approval of a project if: 32.1 it meets these provisions. 2. listed in the annex to the administrative, compliance and quality criteria;

33. the decision on the application of the project approval may include conditions that the project applicant must meet the deadline set in the decision, so that it could conclude an agreement: 33.1. to clarify the details of the project the applicant (contact information and properties) (annex 1);
33.2. to clarify the documents submitted pursuant to annex 2 of these provisions in paragraph 45 of this criterion;
33.3. specify all the documents presented under this provision 2.38 and 39 of the annex, the criteria referred to in paragraph;
20.8. to clarify changes in the total amount of eligible costs and eligible costs under this provision in paragraph 10 and 11;

34. paragraph 33 of these rules in the conditions laid down in the draft decision, the applicant shall make the responsible authorities within the time limits of no more than two months after receipt of the relevant decision. Decision deadlines cannot be extended.

35. The Evaluation Commission 20 working days after the decision on approval of the application, the project on condition the expiry of valued, as done in the said decision, and to the responsible authority shall draw up an opinion on the conditions contained in the decision.
36. If the applicant in the decision of approval of the application, the project provided the conditions laid down are not met or are not met within the time limit laid down in that decision, the responsible authority opinion is negative and the project application is considered to have been rejected.
37. the decision on the application of the project approval, approval with conditions or disapproval of a responsible authority within five working days after the decision has been forwarded to the project the applicant by post or in electronic form of a document (signed with a secure electronic signature).
VII. the implementation of the project 38. Beneficiary: 38.1. ensure all project for the procurement procedure. The first procurement procedure shall, within three months of the conclusion of the agreement;
38.2. all project activities implemented within three years after the conclusion of the agreement;
23.8. at least once every three months to ensure current information into your Web site (if any) for the project implementation process;
23.9. ensure the preparation and submission of the report of the authority in accordance with the cooperation agreement.
39. If the beneficiary is not the national budget authority, after the conclusion of the cooperation agreement of the authority including the beneficiary's account in advance payment of 20% from the European regional development fund co-financing and Government funding.
40. the amendments to the arrangement shall not be made if not actual 24.9.: eligible costs in relation to the project originally specified not eligible costs varies by less than 20 percent;
40.2. If the physical indicators of the project changes during the implementation of the project shall not exceed five percent of the approved amount of the projects monetised;
40.3. If changes in the project's procurement plan does not change the total amount of the purchase.
41. If the beneficiary does not comply with the regulations governing the procurement requirements, the costs arising from the conclusion of contracts, are considered non-eligible costs of the project.
VIII. monitoring activities after project implementation 42. The beneficiary is responsible for the implementation and results of the project is maintained for at least five years following the last payment on the project.
43. The beneficiary of five years following the last payment once a year in accordance with the provisions of annex 3 provides information on the responsible authority: 43.1. the results achieved under the project in compliance with project objectives defined in the application;
43.2. the framework of the project the project achieved the outcome and result indicators;
43.3. the asset owner's legal status;
43.4. public information activities about the project results and benefits to society.
44. The beneficiary of these rules referred to in annex 3 form for the first time submitted to the responsible body within one year of the last receipt of payment for the project, and every year in accordance with the agreement.
45. the competent authority for at least five years following the last payment for the project (if the agreement specifies a longer period) to ensure information accumulation and analysis of the achievement of the objectives of the activity.
