Cabinet of Ministers Regulations No. 1040 Riga 2009. on 8 September (pr. No 56 45) milk quota administration rules Issued under the agricultural and rural development Act 7 the second subparagraph of article i. General questions 1. determines: 1.1., arrangements are made to milk quotas;
1.2. milk quotas and control arrangements;
1.3. the arrangements made for the milk quotas;
1.4. procedures for the consideration of the term is to be not direct sales and delivery quotas for the annual declaration. 2. Milk, which milk producer (hereinafter producer) is used for domestic consumption, and the feed quota is not determined. 3. the State Agency "agricultural data centre" (hereinafter referred to as the data center) administers the milk quotas, calculates the payment for the milk quota, as well as calculated and collected payment for a period not direct sales quota year, the Declaration and the Declaration of the supply quota year. 4. for the approval of the purchaser, the purchaser (buyer) shall provide data center application for approval of the purchaser (annex 1). 5. Data Center after this provision referred to in paragraph 4, the receiving application to assess the compliance of the applicant of the Commission of 30 March 2004, Regulation (EC) no 595/2004 laying down detailed rules for applying Council Regulation (EC) no 1788/2003 establishing a levy in the milk and milk products sector (hereinafter Regulation No 595/2004), and the requirements set out in these provisions and shall take a decision on the approval or refusal of the buyer to grant approval and the month following receipt of the application, inform the buyer in writing of the decision taken. 6. Data Center confirms the buyer and give it a registration number. The approved list of customers data center on its homepage on the internet. 7. Data Center decisions on refusal to approve buyers, as well as decisions on the national quota reserves distribution can be a challenge and appeal to the State agencies "agricultural data centre" in the regulations and the administrative procedure law. 8. food and veterinary service (hereinafter service) take control of milk quotas in accordance with Regulation No 595/2004, chapter IV, section 1, and the requirements of this regulation. II. obligations of Manufacturer 9. Manufacturer: 9.1. written agreements with the buyer closed on milk supply;
9.2. within five working days of submitting the data center application for renewal of the milk quotas the quota holder's change of legal status;
9.3. within five working days after the renewal of the milk quota data centre shall inform the buyer in writing of a change of legal status;
9.4. the time limit referred to in the communication of the data center payments specified account for the term, not direct sales quota year declaration if the Declaration is lodged in accordance with Regulation No 595/2004, article 11, paragraph 3 and 4 of these requirements;
9.5. the payment for the 12-month period concerned in excess of the amount of milk quotas in accordance with Regulation No 595/2004 article 15 paragraph 1;
9.6. within five working days after the conclusion of the milk procurement contracts shall inform in writing the data center for the buyer to make payment for the producer, the milk quota, if the milk is sold to multiple buyers;
9.7. before the quota transfer transaction, the data center, whether the sale to no restriction has been imposed. 10. the manufacturer shall ensure delivery and direct sales quota enforcement records in accordance with Regulation No 595/2004 article 24, paragraphs 5 and 6. 11. the manufacturer who has direct sales quota data center: 11.1. the half-yearly declarations of direct sales for the period from 1 April to 1 October (annex 2) – each year, up to 10 October;
11.2. direct sales quota year Declaration (annex 2), in accordance with Regulation No 595/2004, article 11, paragraph 1 and 2 above. 12. the manufacturer before the milk quota transfer transaction can be submitted to the data center of the milk quota sales or purchase offer. 13. the manufacturer (natural person) in the event of death, the person who until the approval of the law of succession act with the herd and milk quota, shall be provided to the data center application manager status for registration. 14. Data Center within five working days after receipt of the application, shall take a decision on the Manager's status that the person referred to in paragraph 13. 15. This provision, paragraph 13 of the Manager to fulfil all obligations of the manufacturer with regard to milk quotas up to the approval of the law of succession. III. Dealing with the milk quota. If the disposal of milk quotas or transform, the manufacturer shall provide data center application (annex 3). 17. Data Center within five working days after receipt of the application, checks the specified information, register and inform in writing the parties to the transaction. 18. in order to ensure the replenishment of the national reserve, data center, registering a milk quota transfer deals, including to the national reserve of one percent of the quota volume sold. 19. milk quota transfer transactions are performed in a given 12-month period from 1 April to 1 March. 20. milk quota can buy the manufacturer that has the data center's animal and herd register registered herd of dairy cows or heifers over 18 months. 21. the manufacturer may sell all available milk quota, where the quota amount used, or part of it. The portion of the quota used quotas to the buyer may be used in the next 12-month period. 22. The manufacturer may modify the delivery quota for direct sales quotas or direct sales quota – about deliveries, submitting data center application on the transformation of milk quotas: 22.1. Permanent transformations, up to 31 December;
22.2. for temporary conversion – to 15 March. 23. If the manufacturer all direct sales quota is converted to a supply quota, quota application for conversion to add direct sales quota year Declaration. 24. the manufacturer may opt-out of the milk quota in a given 12-month period, written notice of a data center. Milk quota quantity from which manufacturer is refused, the data center will be placed in the national reserve. IV. obligations of the buyer 25. Buyers each month until the tenth date data center: electronically 15.6. information on milk supply for the previous month, indicating for each manufacturer: 25.1.1. personal number or registration number of the commercial register;
25.1.2. milk quota registration number;
25.1.3. herd registration number;
25.1.4. amount of milk purchased in kg;

25.1.5. milk bought in the average fat content percentage that is defined using the terms referred to in paragraph 27 of the results of the analysis and the method of vienprocentīg in milk-sold each period in the milk fat content shall be multiplied by the respective period the quantity of milk sold in kilograms, the results obtained for each period counts and the amount sold during the month divided by the total quantity of milk;
25.2. the milk balance for the previous month (annex 4): 25.2.1. total volume of purchased milk in kg value (without value added tax rates), the milk fat content and protein content percentages of percentages;
25.2.2. processed milk volume kilo grams;
25.2.3. other persons, kilogrammes of raw milk sold by volume, indicating the name of the person concerned;
25.2.4. from other people bought raw milk volume in kilograms;
25.2.5. imported and exported in kilograms of milk volume, respectively, indicating origin and country of destination ISO code. 26. The buyer: 26.1. in full (but not less than once a month) to pay for the milk delivered to the manufacturer, taking account of the quality of the milk and the milk composition indicators;
26.2. subject to the provisions of Regulation No 595/2004 article 15 paragraph 1 laid down, charged from the manufacturer payment for the previous 12-month period exceeded the supply volume of the quota, the total national milk quota after equalization is exceeded;
16.3. each year, in accordance with Regulation No 595/2004 article 8 1 and 2 of the above requirements, prepare and send the data center supply quota year Declaration (annex 5) the quota of each producer. If the delivery quota year is presented in the form of paper documents, the buyer shall submit all the additional information contained in the document, using the available electronic media;
26.4. writing to the data center for the bankruptcy or insolvency of the Declaration and to submit annual declarations to the supply quotas;
16.5. within 10 days after the rules referred to in paragraph 5, approval at the time of the suspension, termination, or resume writing inform the manufacturer;
16.5. the notice period referred to in the data center to the specified account on the payment term of delivery quotas submitted annual declaration, if it is not filed in accordance with the provisions of Regulation No 595/2004 article 8, paragraph 3 and 4 of these requirements;
16.6. upon the request of a service submit milk sampling schedule according to the collection routes and provides the Inspector the access service accounting and reporting documents as well as production facilities and other infrastructure. 27. The buyer of raw milk fat content shall be fixed at least once every 15 days, but not less than twice a month testing laboratory accreditation in the field of physico-chemical and microbiological testing, which is accredited by the society with limited liability "the standardization, accreditation and Metrology Centre ' to the standard LVS EN ISO/IEC 17025:2005" the competence of testing and calibration laboratories-General requirements "and for which the economic Ministry has published a notice in the newspaper" Gazette "(hereinafter referred to as the testing lab) and providing the test results into that 29.9. database referred to in subparagraph. 28. If the buyer stopped buying milk for more than six months, this provision approval referred to in paragraph 5 shall be cancelled. V. dairy quota administration 29. Data Center: 29.1. monitor the overall implementation of milk quotas and make each producer and direct sales quotas and the delivery of spare parts quota reallocation;
29.2. maintain register of producers of milk quotas;
3. after each operation, notify the manufacturer in writing of the amount of quota changes to quotas for milk producers register;
29.4. record milk delivery and direct marketing data, milk quota transaction submissions and transactions, changes to the manufacturer's and the buyer's legal status and quota allocation of the national reserve;
29.5. maintain milk quota sales and purchase offer informative database;
29.6. each year, before 1 June producer and align national quotas of delivery in accordance with Regulation No 595/2004 article 10;
18.5. each manufacturer calculates the payment for the amount of the quotas and inform in writing: 29.7.1. each buyer and producer – each year, up to 1 august;
29.7.2. the rural support service and the Ministry of Agriculture – each year up to October 1;
29.8. each month until the sixteenth day to inform the Central Administration of statistics about each buyer's purchased quantity of milk, value (without value added tax rates), the milk fat content and protein content percentages of percentages;
29.9. maintain single milk sample test results database (hereinafter database) and provides service to access this database;
29.10. conclude arrangements with the testing laboratory for the testing of the milk sample reporting results in accordance with the provisions of paragraph 27;
29.11. inform the buyer about the breach related to the milk quota;
29.12. at the request of a service provided under these rules. information from 25.2 per buyer;
29.13. calculate the delivery quota, the representative fat content of the manufacturer, if after the deal with the milk quota, this fat content changes;
29.14. until 1 august submit to the Ministry of Agriculture annual quota enforcement questionnaire of Regulation No 595/2004, art. 26;
No 29.15. cancels this provision referred to in paragraph 5, if the approval of the purchaser buying milk is interrupted for more than six months, or if the buyer has not complied with Regulation No 595/2004 article 8, paragraph 4, and place the information about the withdrawal of approval Data Center home page on the internet;
29.16. month assess the application of the purchaser and shall decide on the terms of the approval referred to in paragraph 5. 30. Service on the producer's holding checked: 30.1. delivery quotas and direct sales quota tracking, in accordance with Regulation No 595/2004 article 24, paragraphs 5 and 6;
30.2. the first half-yearly reports on the implementation of the quota of direct sales, direct sales quota year, declarations and data center applications submitted on the milk quotas for the accuracy of the information provided and of the period;
30.3. the manufacturer's compliance with Regulation No 595/2004 and the requirements contained in these provisions. 31. the service buyer inspected: 31.1. the company's compliance with Regulation No 595/2004 and article 23 requirements in these rules;
31.2. accounting and reporting documentation of purchase, sales, and redrafted the milk;
31.3. collection route accounting documentation;

19.5. dairy sampling, identification, collection and testing, as well as sending them to laboratories for testing compliance with the laws and requirements of the raw milk quality control laboratories. Vi. The national reserve 32. national total milk quotas national reserve (national reserve) represents the quantity of allowances in accordance with these rules is derived from transactions with the milk quotas and sanctions applied. 33. milk quota from the national reserve to the producer who meets one of the following conditions: 33.1. manufacturer's data center in animal and herd register registered herd of dairy cows or heifers over 18 months, and not the corresponding 12-month period, not the previous 12-month period has not been assigned to the milk quota;
33.2. the manufacturer to 31 March 12 month period concerned has fulfilled 100 percent of milk quotas or more. 34. Data Center distribution between this rule 33.1. the producers referred to in subparagraph provides for no more than 30 percent of the country's reserves, the available quantity of milk quotas, but the distribution between this rule 33.2. producers, referred to no less than 70 percent, if necessary, using also the quantities that were not divided between the rule 33.1. the producers referred to in the subparagraph. 35. Manufacturer: 21.8. corresponding to this rule 33.1 below. referred to in point nosacīj ating log on milk quotas from the national reserve to grant, in submitting applications to the data center where the 12-month period to June 1;
35.2. corresponding to this rule 33.2. bottom nosacīj ating mentioned in paragraph, applies additional milk quota allocation of the national reserve shall be submitted to the data center application to the 12-month period 1 July. 36. In the month following this provision, the period referred to in paragraph 35, the data center applications, determine the appearance of the national reserve to the amount of milk quotas and inform the manufacturer in writing of the assigned or changed the volume of the quota. 37. A producer who complies with this rule 33.1. (a), of the national quota reserve for each dairy cow and heifer, older than 18 months, but not more than 50 percent of the Central Administration of statistics calculated the average milk yield table of the Republic during the calendar year. 38. the manufacturer who has made an application for the granting of quotas from the national reserve in accordance with this rule 33.2. the conditions referred to in the milk quota is calculated using the following formula: K = (G + T) x V-P, where K-milk quotas to be granted;

T – number of calves, over 18 months, the 12-month period 1 April;
V – data center estimated the average milk yield of monitoring monitoring farm year or of the Central Statistical Bureau estimated the average milk yield in the country in a calendar year;
P – the quota amount for the 12-month period April 1. 39. the manufacturer who has been granted from the national reserve to the milk quota, you can take the milk quota sales, not earlier than the third quota year thereafter, unless the manufacturer without dairy farming and sell all the milk quota. 40. the manufacturer will not be eligible for milk quotas from the national reserve, if their milk quota or part thereof have been sold or given in the previous 12-month period. 41. If the producer requested total milk quota is higher than the national reserve, the amount to be allocated shall be reduced proportionately for all applicants. 42. If the producer of milk quotas from the beginning of the period of 12 months the implementation of less than 85 percent, in the next 12 months manufacturer's quota will be reduced by 50 per cent of the outstanding amount and the amount of the exempt quota placed in the national reserve. 43. If the producer in the 12-month period is not sold at all, all producers of milk quota placed in the national reserve. 44. This provision 42 and 43 in these conditions shall not apply if the manufacturer up to 15 April submitted data center application for quota, application adding: 44.1. a practicing certificate issued by the official veterinarian: 44.1.1. animal diseases that affected the health of farm animals or caused by their death and which have decreased milk production on the holding;
44.1.2. forcibly remove animals;
44.2. the institution issued identity documents: the death of the producer 44.2.1. (submit quota Manager);
44.2.2. incapacity of the producer that is not less than one month;
44.2.3. for natural disasters, which it was not possible to continue milk production in the preceding volumes;

44.3. the purchaser's receipt for the purchase of milk, which the manufacturer, the 12-month period was not possible to market milk at least two months. 45. The milk quota, which saved this provision in the order mentioned in paragraph 44, sale is allowed not earlier than the third 12-month period after saving, unless the manufacturer without dairy farming and sell their entire quota. 46. milk quota that entered the national reserve in accordance with the Council of 22 October 2007 Regulation No 1234/2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (single CMO Regulation) (hereinafter Regulation No 1234/2007) point 1 of article 72 of the conditions of the first subparagraph, the data center can restore the manufacturer no more than 50 percent in accordance with Regulation No 1234/2007 article 72 (1) of the conditions of the second subparagraph. VII. Payment calculation and collection of the data center 47. payment on delivery is not submitted within the quota calculation of the yearly declarations and inform the buyer in accordance with Regulation (EC) no 595/2004 article 8, paragraph 3 and 4. 48. Data Center payments on term do not submit direct sales quota calculation of the annual declaration and inform the manufacturer in accordance with Regulation (EC) no 595/2004, article 11, paragraph 3 and 4. 49. Data Center calculated payment is charged from the manufacturer about the term, not direct sales quotas for the annual declaration and from the buyer — not submitted within the time limit of delivery quotas for the annual declaration. 50. Data Center payment for the milk quota is calculated in accordance with Regulation No 1234/2007 article 78, paragraph 1 of the said requirements. 51. the rural support service charged this provision in paragraph 50 the down payment and transfer them to the European agricultural guarantee fund, pursuant to Regulation No 1234/2007 article 78, paragraph 2 of the said conditions. Field support service payment for the milk quota shall be charged in accordance with the data center. VIII. Closing questions 52. Buyers who are approved to this provision to the date of entry into force of the approval will be valid after the entry into force of these regulations, unless it is revoked in accordance with the procedure laid down in these provisions. 53. Data Center 2009./2010 milk quotas from the national reserve until the 2009 December 15, granted to producers, which until 2009 November 1, had submitted data center application for quota allocation of the national reserve and up to 31 March 2009 had met their quotas for milk 100 percent or more.
