Cabinet of Ministers Regulations No. 1040 Riga 2009. on 8 September (pr. No 56 45) milk quota administration rules Issued under the agricultural and rural development Act 7 the second subparagraph of article i. General questions 1. determines: 1.1., arrangements are made to milk quotas;
1.2. milk quotas and control arrangements;
1.3. the arrangements made for the milk quotas;

9.5. the payment for the 12-month period concerned in excess of the amount of milk quotas in accordance with Regulation No 595/2004 article 15 paragraph 1;
9.6. within five working days after the conclusion of the milk procurement contracts shall inform in writing the data center for the buyer to make payment for the producer, the milk quota, if the milk is sold to multiple buyers;
9.7. before the quota transfer transaction, the data center, whether the sale to no restriction has been imposed. 10. the manufacturer shall ensure delivery and direct sales quota enforcement records in accordance with Regulation No 595/2004 article 24, paragraphs 5 and 6. 11. the manufacturer who has direct sales quota data center: 11.1. the half-yearly declarations of direct sales for the period from 1 April to 1 October (annex 2) – each year, up to 10 October;
11.2. direct sales quota year Declaration (annex 2), in accordance with Regulation No 595/2004, article 11, paragraph 1 and 2 above. 12. the manufacturer before the milk quota transfer transaction can be submitted to the data center of the milk quota sales or purchase offer. 13. the manufacturer (natural person) in the event of death, the person who until the approval of the law of succession act with the herd and milk quota, shall be provided to the data center application manager status for registration. 14. Data Center within five working days after receipt of the application, shall take a decision on the Manager's status that the person referred to in paragraph 13. 15. 25.1.3. herd registration number;
25.1.4. amount of milk purchased in kg;

25.1.5. milk bought in the average fat content percentage that is defined using the terms referred to in paragraph 27 of the results of the analysis and the method of vienprocentīg in milk-sold each period in the milk fat content shall be multiplied by the respective period the quantity of milk sold in kilograms, the results obtained for each period counts and the amount sold during the month divided by the total quantity of milk;

25.2.5. imported and exported in kilograms of milk volume, respectively, indicating origin and country of destination ISO code. 26. The buyer: 26.1. in full (but not less than once a month) to pay for the milk delivered to the manufacturer, taking account of the quality of the milk and the milk composition indicators;
26.2. subject to the provisions of Regulation No 595/2004 article 15 paragraph 1 laid down, charged from the manufacturer payment for the previous 12-month period exceeded the supply volume of the quota, the total national milk quota after equalization is exceeded;
16.3. each year, in accordance with Regulation No 595/2004 article 8 1 and 2 of the above requirements, prepare and send the data center supply quota year Declaration (annex 5) the quota of each producer. If the delivery quota year is presented in the form of paper documents, the buyer shall submit all the additional information contained in the document, using the available electronic media;
26.4. writing to the data center for the bankruptcy or insolvency of the Declaration and to submit annual declarations to the supply quotas;
16.5. within 10 days after the rules referred to in paragraph 5, approval at the time of the suspension, termination, or resume writing inform the manufacturer;
16.5. the notice period referred to in the data center to the specified account on the payment term of delivery quotas submitted annual declaration, if it is not filed in accordance with the provisions of Regulation No 595/2004 article 8, paragraph 3 and 4 of these requirements;

29.4. record milk delivery and direct marketing data, milk quota transaction submissions and transactions, changes to the manufacturer's and the buyer's legal status and quota allocation of the national reserve;
29.5. maintain milk quota sales and purchase offer informative database;
29.6. each year, before 1 June producer and align national quotas of delivery in accordance with Regulation No 595/2004 article 10;
18.5. each manufacturer calculates the payment for the amount of the quotas and inform in writing: 29.7.1. each buyer and producer – each year, up to 1 august;
29.7.2. the rural support service and the Ministry of Agriculture – each year up to October 1;
29.8. each month until the sixteenth day to inform the Central Administration of statistics about each buyer's purchased quantity of milk, value (without value added tax rates), the milk fat content and protein content percentages of percentages;
29.9. maintain single milk sample test results database (hereinafter database) and provides service to access this database;
29.10. conclude arrangements with the testing laboratory for the testing of the milk sample reporting results in accordance with the provisions of paragraph 27;
29.11. inform the buyer about the breach related to the milk quota;
29.12. at the request of a service provided under these rules. information from 25.2 per buyer;
29.13. calculate the delivery quota, the representative fat content of the manufacturer, if after the deal with the milk quota, this fat content changes;
29.14. until 1 august submit to the Ministry of Agriculture annual quota enforcement questionnaire of Regulation No 595/2004, art. 26;

30.3. the manufacturer's compliance with Regulation No 595/2004 and the requirements contained in these provisions. 31. the service buyer inspected: 31.1. the company's compliance with Regulation No 595/2004 and article 23 requirements in these rules;
31.2. accounting and reporting documentation of purchase, sales, and redrafted the milk;
31.3. collection route accounting documentation;

Vi. P – the quota amount for the 12-month period April 1. 39. the manufacturer who has been granted from the national reserve to the milk quota, you can take the milk quota sales, not earlier than the third quota year thereafter, unless the manufacturer without dairy farming and sell all the milk quota. 40. the manufacturer will not be eligible for milk quotas from the national reserve, if their milk quota or part thereof have been sold or given in the previous 12-month period. 41. If the producer requested total milk quota is higher than the national reserve, the amount to be allocated shall be reduced proportionately for all applicants. 42. If the producer of milk quotas from the beginning of the period of 12 months the implementation of less than 85 percent, in the next 12 months manufacturer's quota will be reduced by 50 per cent of the outstanding amount and the amount of the exempt quota placed in the national reserve. 43. If the producer in the 12-month period is not sold at all, all producers of milk quota placed in the national reserve. 44. This provision 42 and 43 in these conditions shall not apply if the manufacturer up to 15 April submitted data center application for quota, application adding: 44.1. a practicing certificate issued by the official veterinarian: 44.1.1. animal diseases that affected the health of farm animals or caused by their death and which have decreased milk production on the holding;
44.1.2. forcibly remove animals;
44.2. the institution issued identity documents: the death of the producer 44.2.1. (submit quota Manager);
44.2.2. incapacity of the producer that is not less than one month;
44.2.3. for natural disasters, which it was not possible to continue milk production in the preceding volumes;

44.3. the purchaser's receipt for the purchase of milk, which the manufacturer, the 12-month period was not possible to market milk at least two months. 45. VII. Payment calculation and collection of the data center 47. payment on delivery is not submitted within the quota calculation of the yearly declarations and inform the buyer in accordance with Regulation (EC) no 595/2004 article 8, paragraph 3 and 4. 48. Data Center payments on term do not submit direct sales quota calculation of the annual declaration and inform the manufacturer in accordance with Regulation (EC) no 595/2004, article 11, paragraph 3 and 4. 49. Data Center calculated payment is charged from the manufacturer about the term, not direct sales quotas for the annual declaration and from the buyer — not submitted within the time limit of delivery quotas for the annual declaration. 50. Data Center payment for the milk quota is calculated in accordance with Regulation No 1234/2007 article 78, paragraph 1 of the said requirements. 51. the rural support service charged this provision in paragraph 50 the down payment and transfer them to the European agricultural guarantee fund, pursuant to Regulation No 1234/2007 article 78, paragraph 2 of the said conditions. Field support service payment for the milk quota shall be charged in accordance with the data center. VIII. Closing questions 52. Buyers who are approved to this provision to the date of entry into force of the approval will be valid after the entry into force of these regulations, unless it is revoked in accordance with the procedure laid down in these provisions. 53. Data Center 2009./2010 milk quotas from the national reserve until the 2009 December 15, granted to producers, which until 2009 November 1, had submitted data center application for quota allocation of the national reserve and up to 31 March 2009 had met their quotas for milk 100 percent or more.
