Cabinet of Ministers Regulations No. 1209 in Riga 2009 October 20 (pr. No 72 29) the procedures for granting state aid in the European Union and open project submissions in the form of a competition event "modernisation of agricultural holdings" Issued under the agricultural and rural development Act article 5, fourth paragraph i. General questions 1. determines the order in which the State and the European Union support the open project submissions in the form of a competition event "modernisation of agricultural holdings" (hereinafter referred to as aid). 2. acceptance of application projects, project submissions shall evaluate and select, adopt and communicate, as well as support for the request in accordance with the laws and regulations on the procedures for granting state aid in the European Union and the development of the fisheries field. 3. Measure the "modernization of agricultural holdings" (hereinafter measure) the objective is to modernise agricultural holdings to improve their economic performance and competitiveness. Economic performance shall be assessed in accordance with the rules laid down in these economic viability criteria. II. conditions for receiving the aid measure implemented in 4 in Latvia. 5. the applicant is: 5.1 a legal or natural person who produces in annex I to the Treaty establishing the European Community these processed agricultural products (agricultural products), with the exception of animals not covered by the law, and the breeding of fisheries products;
5.2. the agricultural service cooperative society, which comply with the regulations set out the eligibility criteria. 6. measures in support of the following activities: 6.1. new equipment investment, technique, equipment, information technology and software purchase and installation, intended for the production of agricultural products (including packaging);
6.2. new agricultural production structure construction (govkopīb, if the animal accommodation for not less than 50 dairy cows, if one supports the applicant is already implementing a project for the rural development plan 2004-2006 under "Standard of achievement"), reconstruction and purchase of the necessary materials. 7. In one project submission (annex 1) can include several activities. 8. the applicant shall meet the following conditions for receiving public funding: 8.1. the project reaches the event target;
8.2. do not replace your assets;
8.3. the project showing support in the application of the economic viability of the applicants according to these rules 10, 11 and 12 point those requirements;

9.3. new construction and reconstruction, also simplified reconstruction. 10. application of the project, with a total amount of eligible costs to a maximum of 150 000 lats: 10.1 adds a simplified business plan, which include a cash flow statement over the years to the application of the draft year, in subsequent years up to the end of the project, and a year after the implementation of the project;
10.2. the summary of the evidence of the applicant's economic viability, production and costs. The economic viability of the positive cash flow in the project report in the year of application, all project implementation years and years after the implementation of the project. 11.2. the compilation of evidence supports the economic viability of the applicants last year concluded the project before the application. Support the applicant must meet at least two of the following indicators: 11.2.1. equity to total assets is greater than or equal to 0.20;
11.2.2. working capital ratio of short-term vendor is greater than or equal to 1.00 (short-term creditors be deleted short-term deferred income included in the composition of the State and the financial support of the European Union);
11.2.3. the net profit and the depreciation of the product with a 50 percent total is greater than or equal to zero;
11.3. 12.1.2. the company's management system;
12.1.3. the company's current operations;
12.1.4. company objectives (short-and long-term);
12.1.5. market research;
12.1.6. marketing system;
12.1.7. competition;
12.1.8. cooperation with other partners and with other projects;
12.1.9. production and technological process description;
12.1.10. problems, marked and vulnerabilities;
12.1.11. the necessary investment;
12.1.12. deadlines for implementation of the project (by stages);
12.1.13. production costs, accounts receivable, fixed assets, and creditors, the profit and loss statement, the balance sheet for the last year concluded, the subsequent years up to the end of the project implementation and for three years after the implementation of the project (excluding production and cost), cash-flow statements over the years about the project the application year, all years and years after the implementation of the project, the cash flow statement for the two subsequent years. Cash flow cash balance at the end of each year must be positive;
12.2. Add a summary of the evidence supports the economic viability of the applicants last year concluded before the application of the project, meeting at least two of these rules mentioned in paragraph 11.2. bottom indicators;

12.3. Add a summary of the evidence of the applicant's economic viability in the years after the implementation of the project, corresponding to the rule referred to in paragraph 11.2.2. indicator and at least one of these rules or 11.2.3. in paragraph 11.2.1. these indicators, as well as an increase of at least 0.05 one of 11.2.1. these provisions or 11.2.2. aid referred to in the applicant's economic viability indicators, in comparison with the last year before the project entered into the application. III. Application procedures, project evaluation and application documents to be submitted Before 13 rural support service shall issue a project application making the rounds, the Ministry of agriculture shall take a decision on these rules provided for the allocation of public funding between the rural support service of regional agricultural authorities and establish a single, available funding for this rule 5.2. aid referred to applicants without dividing them between the rural support service of regional agricultural administrations. If, on the expiry of the project application to the adoption, in one of the rural support service of regional agricultural authorities arises, the allocated funding surplus agricultural Ministry shall decide on the reallocation of the Field support service regional agricultural administrations, which have a round of funding allocated to the shortage. 14. 14.3. a credit institution, leasing companies or cooperative credit society for the provision of credit (if the project will take credit) together with the project submission, or within six months after the rural support service of the decision on the approval of the project application to the date of its entry into force. The certificate indicates a creditor and borrower's property and the loan amount. If the project supports the tenderer intends to invest private or any other money funds, it shall submit the documents that prove the availability of funds;
14.4. the annual report for the last year concluded the full set of copies (the original show);
14.5. the annual income declaration and its annex "revenue from operating activities" for the last year signed copies (the original show);
14. with regard to new construction, reconstruction or purchase of fixed asset – land registry Department issued a copy of the shore type (the original show) or certificates of land real estate copy (the original show), or long term rental contracts registered in the land registry for a minimum of seven years from the date of submission of the application, a copy (the original show) on real estate, which, by implementing the project, intended to install fixed equipment;
14.7. the procurement procedure of the supporting documents;
9.2. for the new construction and reconstruction projects in addition to submit: 14.8.1. the planning and architectural task copies (the original show), if on the date of submission is not approved the technical design;
14.8.2. If for a simplified proof of the reconstruction – maps and plans, copies of documentation (the original show), as well as those prepared by the tenderer;
14.8.3. purchase building materials, accept a construction (technical design stage) or a copy of it (the original show);
14.8.4. accept projects (technical design stage) or a copy of it (the original show), a copy of the building permit (presented in the original);

When assessing the project submissions in accordance with the laws and regulations establishing procedures for granting national and European Union support for the development of rural and fisheries, rural support service evaluates the project submission compliance with key aid conditions established in this provision, paragraph 3 and 5, as well as in the 11.2, 11.3, 10.2, 12.2 and 12.3. above. 19. If the project submissions, listing after project selection criteria (annex 2), the number of points in the selection is the same, the benefits of receiving public funding is supporting the applicant, which is less a factor-the received public funds from the special pre-accession programme for agriculture and rural development (SAPARD) and the single programming document 4. priorities the measures against net sales last year concluded the project before the application. If both have the same number of points, though, the benefits of receiving public funding is supporting the applicant having been concluded in the last year is higher net sales from agricultural production, but, if eligible for support agricultural service cooperative society, the benefits of receiving public funding is a cooperative company with a larger number of members. 20. the beneficiary with the last payment request Field Support Services report on the implementation of the project results (annex 3) and the report on the beneficiary of economic indicators (annex 4). 21. Starting from the next year after the implementation of the project, the beneficiary of the five-year period in each year up to 30 April of the Field support service report on the beneficiary of economic indicators (annex 4) for the preceding calendar year. IV. Public funding, and about 22. Aid intensity determines the cost of each activity individually: 22.1. single applicant throughout the 2007-2013 period (hereinafter referred to as the programming period) – 40 percent of the eligible costs (up to 35 000 lats), associated with the investment of new equipment, technique, equipment, information technology and software purchase and installation, intended for the production of agricultural products (including packaging), and general costs;
22.2. the projects that have been submitted to the 2010 December 31,-35 Pro cents of eligible costs (more than 35 000 lats), associated with the investment of new equipment, technique, equipment, information technology and software purchase and installation, intended for the production of agricultural products (including packaging), and general costs;
22.3. the projects that are submitted after December 31, 2010,-25 Pro cents of eligible costs (more than 35 000 lats), associated with the investment of new equipment, technique, equipment, information technology and software purchase and installation, intended for the production of agricultural products (including packaging), and general costs;
22.4. the 40 percent of the eligible costs related to the investment in the new plant, machinery, equipment, information technology and software purchase and installation, intended for the production of agricultural products (including packaging), and general costs, if the investments carried out in organic products manufacturer who is logged into the support payments and deal with organic farming, not less than two previous closed years before submission of the application for the project, and has also entered into new commitments by the Latvian rural development programmes 2007-2013 measure "agri-environment payments" Sub-measure "organic development";

22.5.40 percent of the eligible costs associated with investments in agricultural production in the new premises construction, reconstruction, acquisition of necessary materials, as well as those built by the fixed installations and on-board equipment, which is presented in the technical project and general costs;
22.6. the 40 percent of the eligible costs related to the investments in irrigation equipment and systems for the acquisition and installation of fruit, vegetable and ornamental plant industry, and the overall cost. 23. the applicant who is a member of the cooperative society proper, that rule 22.2 and 22.3. in point. the aid intensity shall be increased by five percent. 24. the applicant who made the investment in less-favoured areas in accordance with the statutory procedures for granting national and European Union aid for rural development, the environment and the countryside, to improve the provisions laid down in point 22 of the aid intensity is increased by five percent if: 24.1. in implementing this rule 6.2. activity referred to below, after completion of the project for the construction of agricultural production in less-favoured areas;
24.2. in implementing this rule 6.1 the activity referred to below, are located in less-favoured areas: 24.2.1. at least 50 percent of these rules 5.1. aid referred to in the applicant's the previous year the single area payments for approved areas;
24.2.2. this rule 5.2. aid referred to in the applicant's registered office (at least one year prior to the application of the project). 25. the programming period to one support applicants to the total amount of eligible costs not exceeding 421 000 lats. 26. supports the applicant – natural or legal person – the amount of the eligible costs activity increased to 1 400 000 lats, if its net sales from agricultural production last year concluded there are at least 250 000 lats. 27. the agricultural service cooperatives, which operate for at least three years before the application date of the project, eligible costs add up to 7 028 040 lats. 28. These rules eligible costs aid be combined with other aid, up to a Council of 20 September 2005 Regulation (EC) No 1698/2005 on support for rural development by the European agricultural fund for rural development (EAFRD) (hereinafter referred to as the Council Regulation No 1698/2005) the aid intensity laid down in the annex. 29.1.2. soil processing machinery and equipment, including rock harvesting techniques and equipment;
29.1.3. sowing and planting machinery and equipment;
29.1.4. agricultural crops harvesting techniques and equipment, and also of feed preparation and harvesting techniques and equipment;
29.1.5. volume, plantation care techniques and equipment, fertilisers, plant protection equipment and techniques;
29.1.6. load lifting, handling and transportation equipment and facilities;
29.1.7. of primary agricultural products and storage equipment and installations, including the cold technique and equipment, storage and refrigeration Chambers;
29.1.8. seeds and planting material processing technique and equipment;
29.1.9. computer-aided production management and control techniques and equipment (including software), including mobile and stationary weights;
29.1.10. techniques and equipment necessary for holding animals, including farm and grazing land equipment, watering, feeding, and grooming of animals blip technique and equipment;
29.1.11. mechanization techniques and farm equipment, including manure storage facilities and technique of mechanization;
29.1.12. dairy milking and cooling techniques and equipment;
29.1.13. laboratory and quality control techniques and equipment;
29.1.14. machinery maintenance and repair station machinery and equipment, including washing, disinfection techniques and equipment;
29.1.15. enerģētiskaj equipment and techniques, including heating and ventilation techniques and equipment;
29.1.16. water supply and sewage, waste water treatment plants and equipment;
29.1.17. watering technique and equipment;
29.1.18. greenhouse techniques and equipment;
29.1.19. specialised vehicles that are constructive and manufactured special meanings for the carriage of goods or the performance of specific work and have set up specific tasks for equipment as well as equipment needed in the project specific objectives;
29.1.20. other techniques and equipment necessary for the achievement of the objectives set out in the project;
29.2. new construction and reconstruction costs, also of submersible installation, as well as the installation of water reservoirs to ensure irrigation cultivation, market gardening and ornamental plant sector, on the basis of contracts with third parties, responsible for carrying out the work, but not exceeding the rules referred to in annex 5;
29.3. the purchase of building materials, on the basis of projects submitted are accepted along with the project application, or support the applicant estimates drawn up by the simplified reconstruction, not exceeding the provision mentioned in annex 5;
29.4. General costs (including architects, engineers and consultation fees, legal services, the technical-economic justification, patents and licences costs) directly linked to the project preparation or implementation. If the General costs represent only the costs referred to in this provision, the 29.1. not more than two percent of this rule 29.1. the costs referred to in point. In other cases, the General costs shall not exceed eight percent of eligible costs. 30. If the applicant does not provide public funding for installation, it is to be installed and put into service according to the regulations for installation and use procedures. Public funding of these facilities only receive after their commissioning and supporting documents of the Field support service. 32. The maximum eligible costs public financing statement includes all the object construction-related costs (including external and internal plumbing, internal and external sewerage, internal and external power supply, ventilation and heating system costs). The structure of the technical project of the fixed installations and equipment acquisition cost shall not be subject to this provision listed in annex 5. 33. If a project for new construction, reconstruction costs for the respective type of construction exceeds the maximum eligible costs and the need to achieve the objectives of the project, the project application will not be rejected, but the cost difference shall be borne by the tenderer in full support. 34. only projects Eligible are those positions and building materials that are directly tied to the achievement of the objective of the measure. 35. the following are considered eligible costs directly related to production costs, if their amount does not exceed 30 percent of the total eligible cost of construction: 21.8. the new administrative space construction or reconstruction of existing premises;

36.4. the costs associated with the supply of any services or work for which there is no appropriate procurement procedures carried out in accordance with the laws and regulations on the application of the procurement procedure;

22.8. remuneration of personnel;
22.9. taxes and fees;
22.9. the General-purpose vehicles, except in specialised vehicles that constructive and manufactured special meanings for the carriage of goods or the performance of specific work and have set up specific tasks for equipment;
36.10. costs incurred prior to project approval submissions, except that rule 29.4. the costs referred to in (a);
36.11. other costs that are not eligible under Council Regulation No 1698/2005 and Commission of 15 December 2006 Regulation (EC) No 1974/2006 laying down detailed rules for the application of Council Regulation (EC) No 1698/2005 on support for rural development by the European agricultural fund for rural development (EAFRD). 37. the costs incurred by the rural support service evaluation calculations, a year more than the average market price, as well as the implementation of the activities and objectives of the time period specified in the schedule don't finished work be considered eligible costs.
